lillianl: "can i sue the landlord for partial rent on rent that has already been paid? I just won the eviction court because I was able to prove that the landlord did not keep his end of the agreement. Can I now go back and sue for partial rent on all the months since the problem began?"

Auri: "I owned a small buisness and sold it by assigning the lease to the new buyer,I personally guarnteed the lease which had 1 1/2 yrs left with 2 5 yr options. the tennant was good but then sold the buisness and assigned lease again to a new buyer who had ammenments done to the lease taking more space,I never had any knowledge of this. The last tennant has been evicted after being 8 months behind in rent and I am now being sued for is late payments plus remainder of lease, it is now 9 yrs since I sold the buisness and yes would have taken space back if notified earlier, is this suit legal??? Auri"

Roger T. Dunaway: "I think you would only be responsible for guaranteeing the lease for your buyer. You did not contract to guarantee the lease for the party that is now in default. If you have been sued, you need to hire an attorney in your hometown to represent you in this case. Good luck..."

Roger T. Dunaway: "lillani: You may be precluded from going back to court if this case has already gone to trial. Most states have case law dealing with such situations. All issues between the parties should have been litigated in one case. See an attorney in your home state if you want a detailed answer to the question under your state's laws."
