Another "shoot the messenger" when they don't get the answer they want.
"I find it incredible that seemingly everyone here condones the actions of the manager. "
No one said they condoned it. We said her only LEGAL recourse is to find another job. She has no damages therefore no civil cause of action. If the manager HAD found anything illegal her remedy would be suppression of the evidence in a CRIMINAL case based upon an illegal search.
"Not a hostile work environment? Seriously?"
Yes. Under the LAW HWE means she was targeted for a Title VII reason: age, race, gender, religion etc, or being sexually harassed. Was her purse searched for any of those reasons? No. Then it is just a bad manager. The law does not address poor employees.
"what barometer are you using? "
"I own my own business, I've employed over 1000 people. I would NEVER allow one of my managers to conduct a search of an employees purse, wallet or person without notifying the person at the time of the search, the reason for the search and without their consent."
Her employer does not have to use the business model you do. Anything YOU do in your business has no bearing on any other private business.
"Our intervention so far, has only been to contact the CEO and notify him of the incident,"
As long as you continue to do that she will have a very unhappy career. Employers DO NOT want to deal with employees who have their parents interfering in the day to day operations of their business. If you keep doing that everytime something happens to her at work that makes her unhappy then you can expect her to change jobs A LOT and eventually be unhirable.
"So far as proof no action was taken"
ONE MORE TIME: They do NOT have to prove ANYTHING TO YOU or your daughter.
"I thought perhaps I might just get some useful guidance from some attorneys."
No, you were hoping to be told what you wanted to that your daughter had a million dollar civil suit against her employer. She can file a lawsuit. Anyone can sue for anything. However, they will get a summary judgement and she will end up paying her lawyer and theirs plus expenses. But feel free to find that one out the hard way too.
"That's just my opinion, then again I might be wrong." Dennis Miller
