Requesting assistance with the following. My ex spouse has garnished my wages for spousal support. As I am nearing the term of payment, my concern rests with the turnaround from the court, from which I will receive the termination order, which will then have to be sent to my employer (Department of Defense Financing and Accounting). The turnaround time is typically 60 - 90 days for DFAS to shut off the garnishment.
My concern is, until the termination of garnishment from my pay is complete, my ex will continue to be rewarded spousal support post what was ordered by the court (overpayment). How do I go about obtaining reimbursement? My ex has already confirmed that she is not going to return any overpayment. Will I have to drag this back into court? Furthermore, isn't she in contempt? What is the likelyhood of me obtaining court costs from her (I make much more than her, but in this case, I think that shouldn't have any bearing on the matter). Essentially, she's keeping money overpaid to her and minus any court order, she'll not return it.
