I am fired up about it for a number of reasons. My employer has mad a number of passive aggresive threats to employees invoking what should be their right. Large employers hire dozens of staff lawyers and HR departments to find ways to deprive people of their benefits, my employer is no exception. If they found a minor technicality in my paperwork that would allow them to deny my FMLA or PTO they would not hesitate at all, they would just do it.
It seems like the FMLA was written with the best intentions to protect citizens and it has been totally mangled and declawed by business interests. Employers can and do use the provisions allowing them to force the use of earned benefits as a truncheon to keep their employees from exercising their FMLA rights through the threat of lost leave. Many of the posts that I have had in response to an honest inquiry seem to be saying to just resign myself to this fact. I myself have never taken any sick days in five years of employment and this. apparently counts for nothing. My HR department has been hostile in the extreme about my use of this time, and when I come back I am fighting fire with fire and hang the cost and consequences. They have made enough mistakes that this should be easy.
