My son has been on probation for a year and a half. He was given a mandatory minimum 3yr sentence. he's passed every U.A. followed every rule, but he has always had problems in school. He was diagnosed with ADHD, depression, emotional disturbance, mood disorders and anxiety. He has been on numerous meds, but once he reached puberty, the meds stopped working, so psychiatrists he probably now has bipolar.
His probation officer started threatening him, saying Judge will lock you up if you get an F, (he's in resource math, gets F's all the time), then she said threatened, if you miss 3 days of school, it's truancy, Judge will lock you up (I excuse his absences when he's sick - he has all no truancies from school), then she repeatedly rings our door and pounds on the door freaking everybody out (my parents 73yo mom and 63yo dad live with us), she accuses him of smoking pot because it was his birthday weekend, yet he continues to pass every UA. She told my son on 2 separate occasions "stop taking those meds, you don't need it" (I believe her intentions were good, but I don't think it's appropriate for her to tell my son not to take his meds.
Here's where the trouble starts- I called the disability advocacy law office regarding all this - they advised me to contact her supervisor ( I told this law office that I feared repercussions because they are close, they stick together)....well, I spoke with her supervisor, didn't file a complaint, just voiced my concern......a week and a half later, probation comes to my door with a partner, orders me to put my dogs away, walks in and orders me to sit down because she needs to talk to me. She now confronts me and lies to my face - stating that she was referring to Lortabs my son's dr prescribed for a back injury. she then says she can't reach us by phone, she doesn't have the correct number (tho I've given it to her 3 times), she confirms by saying, there's a male voice on the answering machine, then says, but no one ever returns my calls. I point to the machine and say, "I never got any message from you." Smugly and challengingly she responded, "that's because I never left a message." My mother was upstairs, hiding, listening to the whole conversation. We are upset and appalled, but what can we do? it's all hearsay.
Next thing you know, we're being pulled into court. My son has a panic attack and passes out. He ends up in emergency. public defender advises court judge, but a bench warrant get issued anyway (because probation showed just attendance of numerous excused absences / school has no problem with this because they know my son has been going through alot, affecting school performance and attendance....
the following day, 3 probation officers arrest my son in school. she yells to my son in the hallway, "come here boy! rough handles him, squeezing the cuffs extra tight, he erroneously gets released the next day. (judge wanted him in juvie for 8 days - knowing that's what caused all his panic attacks). that weekend, my sons falls out of a moving veh - he says accidental, but I wonder if he wanted to hurt himself...friends say no. admitted into trauma, fx elbox, deep laceration above elbow, concussion. morphine, percoset and soma for pain...............now judge says he's a druggie and i'm an enabler (also because excused absences). the day after hosp discharge, we're in court again, she takes my son into custody Tues-Fri, says she'll released him on home arrest and ankle monitor,,,,come friday she changes her mind and wants to send him to a group home, but no beds avail so she wants to keep him in juvie till one opens up. The dressing on his arm is oozing blood and pus...he's in pain. .....Public defender tells judge not to take it out on my son or punish him just because she's upset with me.....he gets released to me, BUT, if h screws up, he goes away, I go to jail for 25 days and pay a fine.
So, staff in detention making copies of judges zero tolerance order, they tell him he will fail, they're going to hang these copies in their home. his probation officer comes by to taunt him in juvie, saying, you're never getting out, you're gonna end up in group home, judge never been this ticked before. As he's being released, another staff tells him "you're a drug addict"
probation officer twists the truth in court, tells judge lies, judge labels my son a 'con, liar, and prescription drug addict because of his history of meds. she yells at me saying, you drink alcohol and smoke pot, that's where he learns it.
I have been in public safety for 20 years (police, and now fire and ems dispatch). I have not had a drink of any kind in 11 years, haven't touched pot since 14 years old.........
WHAT DO I DO? If I report the retaliation, probation will tell Judge and they'll lock us both up. What do I do?
I've offered to take a polygraph, I've shown judge documents from doctors and psychiatrists and counselors, but she (the judge) says I coddle him and drug him and let him stay home from school. I can't get past the probation supervisor because the manager and director doesn't return my calls. Do we not have any human or civil rights here?
