Im in Tennessee.
Just got two letters in the regular mail today ( not registered mail or anything..regular mail ..44 cent stamp ) one to my husband and one to me from [a law firm in] Knoxville, TN.. We're in Nashville )
The date at the top of the letters is October 10, 2011
Says Plaintiff : XXX
DATE OF JUDGEMENT APRIL 02,2002
Sumner County General Sessions Court
has the same docket number on both letters
same case number on each letter
Says a judgement was rendered against us April 02,2002 in the amount of 3,915.00 and as of dec 21,2011 , there is an outstanding balance of 7,734.19.
Says it is a motion for renewal or revival of judgement..
We were never given notice of an original court date or the original judgment.
Now they have a court date for Feb 7. 2011!! ??? ( Im assuming they mean 2012 ) ...
a few things:
I have no idea what XXX is...We have had old credit card debt but it is way past the statute of limitations.
We were never given notice of an original court date on this . We had a business that went under and have had judgements rendered against us because of that and both times , the police came to the door with the court notice. Both were settled. ( we are paying one off and the other is paid off ) There was never any notice with this though .. just these two letters now claiming a judgment against us in 2002.
So, what do we do? I am on disability and my husband is on Social security and thats it for income.. If they already got this judgement without us knowing about it , can they just clear out our social security money ?
