I was employed at a base salary with quarterly bonuses. The bonus was based on number of children enrolled in the school. If the enrollment was not over a certain # a base bonus was paid.
I was not given written policy regarding my bonus. Just the initial chart of amount to be paid based on enrollment numbers. I began employment with only three weeks left in the quarter. I was paid a prorated base bonus based on the time worked in that quarter.
I resigned my position five weeks into the first quarter this year. When I requested my prorated bonus to be paid on my last check I was told I would not get a bonus because employment through the whole quarter was required.
I'm thinking about filing a small claims case to fight for my bonus. Does the fact that she paid me a prorated bonus previously establish a pattern? Does she have a right to change the rules (make up the rules) as she goes along.
