I am a Police Officer in Ga and have a disagreement with my supervisor on reckless driving. If a person is stopped for excessive speed and the officer is going to use it as the basis for reckless driving, can you write a ticket for both charges? Also if you do have an answer any case law or anything backing up your answer would be greatly appreciated. I feel that is that is my basis for reckless driving I can not write for both, because I am essentially charging you twice for the same violation. I believe it is the same as jeopardy but I could be wrong. My Sgt sees it differently and feels I am required to write both citations. His reasoning is you need something to support the reckless otherwise you have no idea why they are being charged. He did not like it when I told him that is why we write reports.
