If your case was heard in NY family court then I think you may be referring to a referee (not a magistrate). You do have the option to appeal the case to a real judge in NY State.
If you have an atty in NY state, he/she will know how to go about this. If you are pro se, call the local family court that first entertained your case to ask for advice.
