Bought a Mercedes Benz 560 sel, year 1988, from a private seller on May 12, 2007 in Illinois Lake County. We were told that the car was in storage for a couple of years after his friend, who is the owner of the repair shop that bought it at auction (from an insurance company). We understood 2 things:
The car had some minor damages and
The car had 88,000 miles.
Based on the low mileages we made the purchase. This car, we are told can run up to more than 200,000 miles. It was bought by my son who is 17 years old in order to go to work and school.
We have made many repairs along the year, until 3 months ago when the transmission gave up. We cannot finance the repair which costs between $2500 and $4000.
We subsequently put the car at auction on ebay. A day later ebay cancelled the auction because the car did not have a clean history.
We went online and bought the auto check report.
It shows the car had a reported 162,000 miles in 2002. Also shows the car has a Salvage/Rebuilt title. We were not aware on any of this.
The seller is a professional mechanic who bought it from his friend who owns the repair auto shop. He does not want to hear about refund or any liability. He said he knew it was salvage and that the title states the car is rebuilt. We did not notice on the title until yesterday when he told us.
All in all, we made the purchase because the mileage was so low and subsequently the major parts of the car were not overused.
Title was never registered to our son' s name . We have a contract of sale and the title of the car still register to the seller.
Can we get our $2,000 purchase back? without even asking for the $1,000 dollar of repairs.
