You can't get the medical records unless she signs them over. Having sort of the same problem, but she is my soon to be ex. She is bi-polar and has other mental issues. Currently is in the hospital for the 5th time in less than a year.
As far as your husband trying for custody, you would need a lawyer first. In Illinois, a judge can order a family psych evaluation. In other words, all family members would be evaluated. From there the court can make its desision without getting her records. This can be rather expensive. I was quoted around $5,000 for this.
Just because she is bi-polar doesn't make it a "done deal" of losing custody. If she is a threat to herself (my stbx's 15 suicide attempts) or a threat to others would probably have the other parent gain custody. If she is no threat to anyone and stays with her meds, as directed by her doc, it's a harder battle.
