Sorry, but I don't think you are going to get anywhere with this.
I found a sample DE disclosure form.
The question you are referring to appears to be:
"Is there anything else you should disclose to a prospective buyer because it may materially and adversely affect the property, e.g., zoning changes, road changes, proposed utility changes, threat of condemnation, noise, bright lights, or other nuisance, etc.?"
That's a little wishy washy and "materially and adversely effect the property" may just be vague enough to be in the eye of the beholder.
Besides, you saw the tracks, and chose to believe the downplaying of the agent. I don't understand how anybody seeing a set of RR tracks can believe that trains don't come through (no matter what anybody says).
It's kinda like believing the doctor who's holding the hypodermic needle saying "This won't hurt".
