While I'm not going to disagree with what you've been told in theory, my experience was somewhat different.
I am in Illinois. My ex owned the house before we got married. While we were married we made many modifications to the house, which increased the value of the house by almost 100% (house was purchased for $40K, and when we had it appraised during the divorce it was appraised around $79K).
I had proof that I had contributed to the increase of the value of the house, BUT I did not receive anything from the increase of the value in the house in my divorce.
The Judge stated since it was property in my ex's name that he held before we were married it didn't matter what I had contributed.
Just be warned. Just because you SHOULD doesn't mean you WILL.
I would have a long talk with your DH to get to the bottom of why he won't add you.
