Okay, here's an update. Dad has counsel. He has a lawyer.
This past weekend his ex, while he was with his son at a doctors appt, mind you waiting for Mom to show up and accompany him to this appt, was moving with the help of her parents to her friends or boyfriends house/apartment.
Only way Dad found out is after the childs appointment was over he drove past Mom's place and saw them putting mattress's on top of vehicles. When he tried calling her she kept ignoring the calls. Finally later on in the day she took his calls with all kinds of excuses and then tells him she's moving, but the story changed five different times to where she was actually moving to.
After about seven phone calls later Dad finally got an address and a phone number out of her. He went to court Monday morning and filed an emergency tempory custody order. Not sure if it'll do any good, his lawyer put it in as a modification arraignment.
I beleive he wants my son to also file again for the other smoking violations she's committed recently with her parents and boyfriend around the child. It just doesn't stop. I don't know if I mentioned it the previous posts but she did admit to the judge that her parents did smoke in front of the child. Even after the order was in place. Pretty much hung her self. Not that it'll do a lot, it's a first offense.
But the sneaky way she moved is on top of it all right now. She was told back on March 24th to get counsel, and if she couldn't afford counsel, to apply for a public defender that day, and we were right there watching the child for her. She had no excuse not to. She just chose not to.
Now there is a GAL assigned to case and my sons lawyer and she's left with no one representing her yet. My son told her the severity of the case and she just looked at him and walked away like she didn't give a hoot. I don't get it.
I'm so sorry for being long winded here.
No one right now knows what will happen. It's a little scary to me at this point.
