    I was recently suspended by phone because someone made a work place harrassment complaint agaisnt me they said. I then had a phone conference with them and got to answer the complaint. it was not work place harrassment, in fact the conversation they said happened never happend.

    During the course of the investigation i was not allowed to go to my office, 12 days, i wrote my own complaint on the 25th, then all heck broke lose,, they went through all my personal things, which i guess if you have that at work they can.  they are claiming they found a template on my personal zip drive that was in their computer, but it was not it was in my personal bag i take my lunch in,,of a dr's excuse.  that i had turned in dr excuses that were fake.

    (i did scan my dr excuses only 2 into a file so that i had a copy on my computer).  I gave my supervisior the orginal, this then made my employer contact the dr. They then sent all the dr statements they say were turned in by me and that the dr's office said they were not valid i was not under their care at those times.

    There were only 2 that were really from the dr, uh yes those are the 2 i had, they had 8 of them scanned to me,,,, I DID not turn those in, i feel this is a set up, i dont even know how you would do that? i am not the computer smart,, so they fired me for that instead of the original reason i was suspended the termination says in the course of investigating that, this came up so this is what i was fired for.

    How can the dr answer to any of those things? i thought there was some HPPA law that avoids them from doing this? so i am wanting some advice to this before i have to appeal the unemployment which they will fight, they have fired like 6 people now,, and i have been on the next list for a while,,

    I tried to get my things from my office today and they said they were sending it ups,, i have alot there been there 2 years, glasses i left on my desk,, etc what if i dont get all that is mine?

    I have never been asked to turn in a dr excuse and i feel like the 2 guys in that office set me up when they found the scan on my zip drive and they printed those. then they faxed this to the main office,, i did not do that, do i have a case against the dr and the company

    You can be fired for any reason not specificaly prohibited my law, even a mistaken one.

    It would not be a HIPAA violation for the doctor to confirm or deny that you were under her care on certain dates.

    Thank You for that.  I was just wanting to apeal the hearing for the unemployment, they  may be able to fire you but it has to be for a just reason to keep you from getting unemployment, and the things they have, well one is all false, the dr excuses, i dont know, thanks i guess there is no reason for me to think i have a chance at that.

    i thought there was some HPPA law that avoids them from doing this?  HIPAA only applies to information an employer may have obtained through their group health plan.  It does not apply to doctor's notes, anything you tell your employer and anything on your computer.  Since you scanned doctor's notes to the computer, I can understand why your employer thinks you generated fake doctor's notes.  It would be extremely easy to do.

    i have alot there been there 2 years, glasses i left on my desk,, etc what if i dont get all that is mine?  You contact your employer and give them a list of the items that they overlooked.

     i did not do that, do i have a case against the dr and the company  Neither.

    Hello, i tried to call and get my things, and i was told it was all being sent to me ups,, yet i have not gotten it yet, there are some things i really needed like my blood sugar tester, glasses, i have been without my things since the 19th,, it seeks like they would have to send that,, is there anyone i can seek help with to get my things?

    Since you were suspended while at home they might assume that these items are not life threatning items. They are probably inventorying everything to verify what they send you belongs to you and not the company.

    You could call HR and ask for a tracking number for your package.

    HELP, i got this letter from the unemployment office, and it went like this:

    Issues involved:

    Discharged for gross misconduct in connection with the work

    Discharged for just cause.

     

    circumstance of case

    The claimant was discharged for the alleged commission of a class a misdemeanor or felony? ( I am like what? I guess this has to do with the fake dr excuses?)  The claimant denies the allegation and has not been convicted of the charge.  Information provided supports a discharge for just cause.

     

    conclusion of case:

    The claimant was not discharged for misconduct in connection with the work.  It has been established that the claimant had not admitted to the act or been convicted of the charge.  The claimant was discharged for just cause. The claimants actions were a breach of duty reasonably owed to an employer by the employee (this must be the cpr class) in accordance with some law,,benefits will be suspended and reduced when this occurs.  Benefits are reduced and suspended as shown below.

     

    Legal result of case:

    Claimant: your benefits rights are suspended effective week ending 06/20/09 until you have earned your weekly benefit amount in each of eight weeks.

     

    A 25% reduction may be applied to your maximum benefit amount

     

    I don’t understand anything I did that would be criminal, do you? And am I facing charges or something?

     

    I finally got my things shipped,, it was terrible, all the glass was broke, like vases and my picture frames and my notary frame, and I tried to make a claim, but they the shipper has to, so that is not going to happen. They just threw it all in with no filler or anything,,

    I imagine forging notes from a doctor is a criminal offense but the UC Division is saying that you haven't admitted to nor been found guilty (by a court of law) of doing so.  However it appears they are saying that there is reasonable evidence that you forged doctors notes and therefore they are denying benefits.  (I have no idea what your comment "this must be about the cpr class" has to do with any of this.) 

    And am I facing charges or something?  No.  The UC Division only deals with unemployment benefits.

    they said that i had denyied that, i have not done that, i dont know how they got them,, i really dont, i got my unemployment but was suspended from getting it for 8 weeks, then i will get it.

    i also teach cpr and i taught a class outside my work, not on my companies time or their materials and i was acused of doing this also, when i did not, i was not able to answer any of the acuations, they e-mailed me the termintation with this all attached,,

    i am just concerned that this may lead to charges, when i did not do the notes, i feel i was set up by the guy who i made a complaint against on the 25th then i was let go on the 30th
