    Thread problem

    Something is wrong with the thread about "attorney malpractice in divorce case"; there are not 9 responses on it and nothing at all by the poster listed as the latest post (something like 4min25sec?).

    This is only a guess, but I moderate another forum and my guess is that the thread has had some posts deleted by the moderator.

    Considering that I've personally reported posts by that particular poster, it wouldn't surprise me.

    The posts were removed.  The subject became too argumentive and his retorts were putting the spotlight on him.

    (I avoided responding to that post because of him.)

    Cica, Please explain whether it was 4min25sec or another member to help clarify this. I remember that I had placed two positings in different topics and was deleted from one of them. I was notified that I should keep it in the same thread. Those were my first postings.

    Since then, there have been postings that have been taken down without warning. This has been happening to more than just one of us and nobody had any warning or had ever been told that it was becoming too argumentive.

    Denise, There have been replies made by some of us that have been taken down without notice and without any explanation having been given. None of us were ever given the chance to [be less argumentative] or dispute the contention that we were.

    I personally feel that there have been attacks on my credibility from people who say such things as "he clearly has no understanding of the law" or "In legal terms, that is baloney" or "he doesn't know what he is talking about"  LynnM is one of several who are particularly bad about this.

    Please take time to read the postings and see who is attacking who without cause. There are several of us who did not make any negative remarks before being put down by LynnM, Adjuster Jack, Jo Braver and Ford. They maybe longtime members and they may or may not be attorneys with the experience that they claim. That is not the issue. The issue is that they do not represent the legal community that practices law in Texas and do not have sufficient knowledge of the laws of Texas to say that I or anyone else doesn't understand what the law is.

    There are people from California, Pennsylvania, Florida and elsewhere who automatically understand Family Law in Texas without ever having read the Texas Family Code. Coincidentaly, I have never found any attorney who practices family law in Texas who replies to this forum.

    Please read the posts and tell me who you think adequately supports their positions with case law references as well as direct quotations of the statutes themselves. Adjuster Jack has just started doing so with his last reply.

    The big problem that I am finding is that the same errors have been repeated for so long that people are starting to believe them without questioning the source.

    I think it would only be fair to give warning if someone is being "argumentative" but it should be done so evenhanded to those who want to provoke rather than substantiate their position with reference to the specific statute or case law.

    If a lawyer has never studied in Texas or practiced law in Texas, it is not for him or her to try and discredit someone from Texas who accurately states what the law states.

    I would greatly appreciate your attention in this matter and hope that it can be resolved amicably.

    P.S., I don't understand what can be taken from Cica saying:

    This could have been addressed directly by Cica by posting any displeasure with postings that offended. I am sure that most of us are adult enough to take any due criticism.
