    Disqualification of Opposing Counsel

    Other party has now filed papers for substitution of her 6th attorney in this case. Interestingly, however, I know this attorney personally (but did not know that he was licensed to practice law or that he had ever worked as an attorney). We attended the same church and I even ushered together with he and his wife. He was present at the last hearing but he stated that he was only there as a friend (and made no mention that he was potential representation .... the hearing included the granting of 5th attorney's motion to be relieved as counsel). I talked with him for a while before the hearing, unawares.

    When I first became aware of the change of counsel, I looked him up with the bar association and found that he was twice suspended in the last couple of years for failure to pay his dues and was not active for a substantial part of the last decade.

    Is there any basis to move to have this counsel disqualified (not on the basis of his bar association record ... he is active now)?

    If you are thinking conflict of interest, I don't see any potential for that.

    Anything he knows about you, your wife could tell him just the same.

    Besides, if he's a lousy lawyer, that's to your advantage, right?
