I know its wrong to leave the kids in the car but not all of us has maids or baby sitters to take care of our kids 24 hour.
My wife wend down to buy few things from the store and I stayed in the car with my 2 kids. For sure its Hot in Texas in August and I had the AC running on high. car was nice and cool and the kids went to sleep. I had pulled under a tree to avoid the hot sun and this just made the car stay cool. after the kids went to sleep, I was also snoozing and had to turn down the AC since it was too cold. I had noticed my wife had forgotten to take her purse (thus not having any cash on her to pay for the grocery).
With the car being cold, under a tree, I thought to myself, just maybe I can run in, find her, give her the money and run back. I though to better lock the car, thus had to shut the car off and lock the doors. I did crack the windows a little. So I ran in and looked around to find her. It took more then 10 minute to find her.
As I found her, I heard the police cars so I ran out as fast as I can to find three police cars, an Ambulance ... in and a two truck.
I was running to the car screaming "its my car" as I noted they had the two truck driver pulling a slim jim to unlock the car. I reached with the keys and opened the car. My wife was right behind me. I was pulled against the police car (with three officers pulling me aside).
The kids were still asleep and were woken up by the medics. My wife went into shock from seeing the police officers pulling my hand and they put hand cuffs on me and through me in the back of the police car (with hand cuffs behind my back).
Now see what came next.
The kids were fine, as they took them to the ambulance&nbs... checked them. Since the car had the AC running for 30 minutes before&nb... shut it off, it was still cool (aside from that it was parked under a tree and not in direct sun light).
I was actually ... the back of a police car, sitting in the hot sun for 30 minutes. The police car was not running and all doors were closed. I know it was hot and the police officer was making a point but could not believe he would do such a thing and take the law in his own hands.
While I was waiting in the back seat, the medical personal from the ambulance&nbs... with a police officer) put a thermometer&nbs... my car and closed the door to test the temperature. I heard them say it was cooler then outside temperature.
After my 30 minutes in the back of the cruiser, they noticed that I was sweating and opened the door to tell me that I was wrong to keep the kids in the car and it is against the Texas Law and what if the car was stolen with the kids in it or what if anything happened to me and the kids will stay in the car and die.
I can not believe ... punched me like this and my wife could not understand why would the officer acted like this when they are suppose to behelpings instead of treating us like criminals.
The cops gave me 2 tickets (one for each child) as a violation for keeping "Child in unattended car". This was August 11.
The ticket noted Sept 16th as a Court date and to check in with the Court after 7 to 10 days.
I received a letter confirming Sept 16th as Court date with options:
- Please guilty and pay fine of 475 for each citation (950 total)
- Please not guilty and go to Court for hearing.
- Plea No constant and go to trial.
I have follewed&nbs... with the Court to seek options and as of today (Sept 3rd), thy still have not received ... the officer so I have been advised to reschedule my Court date until they get the documents from the police officer.
I am upset and have no issue of paying the fine . But I am truly upset about the police officer taking the law in his own hand and what he did to me and my family is not right. I am 46 years old and has never got any ticket (other then once for not having my seat belt on) in my entire life. I do not understand what give him the right to treat anyone like this.
What are my options???
