I work title in PA, Pocono area mostly to be more specific and I see most of the associations collect a Transfer/Capital Improvement fee. In most cases when I close I will have the new buyer sign the check for this fee showing that they agree to take it to their new association when they register as the new owner. I also provide them with a HUD and a copy of their new Deed. Upon excepting this check require them to provide these items to you.
If the check is coming directly from the title co. then simply write on the HOA request for dues (that all title companies send out prior to close)that a copy of the Deed and/or HUD be sent with the dues and fees post close, most title agencies will accommadate this request.
You might also make it known to your realtors who typically order the resale that these items are needed so they can convey this information to their buyer. hopefully this will help resolve this issue without alot of legal effort
