    Can a 15 year old be pulled out of school by cops

    for being a witness to alleged incident  without a parent or guardian present? He was also held for over 2 hours and when mom asked repeatedly(in that 2 hours) why he was there and what was going on, she was told to have a seat and was not told of what was going on. She was not allowed to see him. No lawyer was present with him either. She only found out AFTER he was released that she found out by her son what happened. Forgot to add this in on Long Island, Ny. thanks again

    Yes.

    Consult an attorney if you think the cops did anything wrong.

    You need to consult an attorney in NY.  Federal law has no extra protections for children.  Few to no states allow children to hide behind their parents.  Government processes are often more important than individuals, even children.  For instance, the government can execute people and send them off to fight wars involuntarily.

    I suppose the average teen has seen enough TV to say in effect let me go or charge me or I want a lawyer and I suspect parent had right to insist on same on behalf of minor child  but I'm not sure NY requires cops to educate Mom.....a recent  case in PA supports in PA anyway that cops have no duty to advise minor as to rights to get parent involved!

    I don't think you can make that assumption, Drew. My oldest (17) is a pretty average teen, but he doesn't watch shows where he'd get that info. He's just not interested in them. Luckily, he has a parent who has instructed him. But not all parents know that, either.

    I always told my boys that if they ever got into trouble or were questioned by the police not to say anything without an attorney present.

    Of course, when one was questioned about a senior prank gone wrong, "the cops were really nice", so he blabbed everything!

    Just goes to show.
