Question about termination from correctional facility

    Question about termination from correctional facility

    New Mexico, Girl friend was was walked off grounds for not reporting that she was involved with me (ex-felon) her job was medical records clerk on site through third party company. Granted I know how they are, was she was hired what she signed upon initial employment  stated if she knew or had any family members that were on prob/porole or currently incarcirated. The form they showed her was a different one that did say blah,blah, if she knew any one period which she signed 2 months later. There reasoning was they got a tip. And because I am on Probation for a missdimeanor now and nothing to do with what I went to prision for. That they were pulling her Sec. clearence. Now granted I am not her and this pretty acurate she will be home soon to fill in the blanks. Can they do this, and does she have grounds to argue her job back?

    They can do it, but they may have an appeal process.

    Hey this is the girlfriend here to give a bit more detailed info on my situation. I was given a form 2 days from when I orginaly accepted the job offer which yes asked if I currently had any relatives working for the Dep of Corrections on the same form it asks if I had any relatives currently on parol, probation or currently incarcirirated i answered NONE for both questions. Now about a month later I was told to complete a simular form at a meeting. This form is enitrely different from the first form I orginaly signed both state they are a NM Correctional Dep form. and this second form asks if I currently knew anyone incarcirirated, on parol or probation.Now my question is Will the first form I signed over power the second one given the fact that form one was signed on an earlier date? My first understanding was that I only had to report if I had a relative on probation. It is to my understanding that a "boyfriend" is not considered a relative!

    Contract for employment?

    Unless she has an actual contract for her employment, she can be let go for almost ANY reason, even a reason the employer contributed to through goofy forms.  They could even fire her for not liking her handwriting on the documents.  The answers are pretty much irrelevant because at will employees don't have a remedy for a false termination.

    Wrongful terminations require that the termination be in violation of some law that grants protection to employees, like discrimination laws, whistleblower laws, etc.
