    INHERITANCE WITH NO WILL

    I LIVE IN NY , MY FATHER DIED AND LEFT NO WILL. I ASSIGNED MY BROTHER AS ADMINISTRATOR AND HE TOOK EVERYTHING. THERE ARE SEVERAL HOUSES THAT HAVE NO MORTGAGE THAT I KNOW I AM ENTITLED TO.  MY FATHER WAS LIVING WITH SOMEONE AND I KNOW WITHOUT A WILL THERE IS NO COMMON LAW UNLESS THEIR IS JOINT TENANCY , WHICH ISNT THE CASE, HOWEVER , ONE HOUSE IN PARTICULAR HAS BOTH MY FATHERS NAME ON THE DEED AND HERS AS HIS WIFE WITH HIS LAST NAME.  WHAT HAPPENS TO THIS HOUSE? AM I ENTITLED TO HALF. WE HAVE PROOF THEY WERE NEVER MARRIED. I ALSO NEED INFROMATION ON JOINT ACCTS. THERE ARE SEVERAL JOINT ACCTS WITH MY FATHERS NAME AND HERS. AM I ENTITLED TO HALF OF THOSE ACCTS. THERE ARE ALSO ACCTS "IN TRUST FOR' ,WHAT HAPPENS TO THOSE? MY BROTHER WAS IN A CONSPIRACY  WITH MY FATHERS GIRLFRIEND AND  THEY TOOK IT ALL. CAN I FILE CRIMINAL CHARGES AGAINS THEM? CAN I SUE THE LAWYER THAT CONDUCTED THIS ESTATE ERRONEOUSLY, KNOWING THAT THERE WERE TWO SIBLINGS?

    In the future, please note that the Rules of this site, by which you agreed to abide upon registration, state, "Format your message to look like the print in a newspaper, magazine or book by using capital and lowercase letters in a traditional manner. . . neither all caps, nor all lowercase. The use of all capital letters looks and feels like SSHHOOUUTTIINNGG on the board."  Messages in all capitals are harder to read than they need to be, so you may not receive as many responses as you might otherwise.

    Your brother most likley had a duty to split the net estate among Dads kids.

    But you need to lay out on paper the precise titles and names--stuff that was JWROS passed directly to other person, stuff in trust  passes as per trust--and odds are if stuff was titled to Mary Smith and its clear that Mary Smith is also knwn as Mary Jones and no fraud is intended that Mary Smith gets it --

     

    Its quite possible that Dad set it up so that his girl friend got it all and the NET in his pile was zippo

     

    Dad is NOT required to leave a dime to his kids in NY!  And if he left stuff by title that would trump both a will or no will sutuation!
