    " Blanket Security" get priority over a secured debt

    Can a bank  imperfect "Blanket security" get priority over a perfected secured Note?I went in a silent partnership with a crookwith 300,000.00 cash investment , I purchased all equipment he signed a security agreement that we filed as a UCC and perfected it by recordation in Riverside County California.

    Now the guy has sneaked out made sweatheart deal got $100000.00 under table cash from the buyer opened an escrow for 150000.00 dollars and even the UCC search I am the first and second registered creditor refuse to pay me the money on the ground that the seller had a "Bank Blanket security" not registered or perfected on this location but in all his other location which he got financing by the Bank.

    I am a first lien s... and perfected and has priority over every one why the Escrow does not release my money?   Where can I find rulings on this ? and how can I get help to release my assets?

    CAN it?

    Apparently it CAN, because it already DID. 

    Frankly, for 300,000 you get yourself a lawyer real fast and get a lawsuit filed.

    If you aren't willing or able to do that you can kiss your money goodbye because talking and pointing to your lien isn't going to get you a nickel.

    Why do think that an unregistered and imperfect "Blanket Security" by the bank can take priority over a Secured and perfected Security on a location in California. Even in Bankruptcy they "prioritize" notes by recording dates of security the first Note by date and even hours of registration&n... priority over the second note  . The question is how an unknown "blanket" security which is not registered on a property can override a recorded note on a specific property. There is no way for an investor in a new location check the county record for something which did not exist before, all you check is if there is a UCC registered or a lien is registered and when it shows none you assume that there is none , then you enter into an agreement to finance, I have a first Note secured by a property therefore the bank Blanket Security, which was not registered, cannot take priority over my note. I am willing to hire a lawyer but where is one who knows how to act!

    You keep writing about what can and cannot be done.

    The bottom line is that the bank has done it and now you are seeking a remedy based on who has what note.

    That's going to take a lawyer and a lawsuit.

    The way you find a lawyer is call up lawyers and interview them about their background and experience, specifically any successes they've had in similar matters.

    No, the Escrow has not closed. no bank has got any money out of the Escrow! do you get it, there is just this question, is an unregistered blanket security ,secured on other assets prior to this store become into existence superior to my secured note which is perfected. I was supposed to ask this question and a lawyer res... , then i go and get a lawyer.; but it seems that all i get is no answer!

    I'm confused.

    Are you entitled to money and somebody won't give it to you, or what?

    Maybe you could explain it better.
