    Laid Off

    I was recently laid off and I posted my forum a couple weeks ago regarding if I had a claim. Well, I kept in contact with the company because they were trying to figure out what happened and how to come up with a resolution of my termination. So on Monday, I received a call from the HR Manager stating that they came up a resolution and was sending me a package to go over. I received the package and its a Separation and Release Agreement regarding my separation from them and offered me almost $4K lump sum, less all applicable income tax withholding and other lawful deductions. It listed status of employment, status of compensation and benefits and separations benefits, a waiver of release, stating that I agree to release and forever discharge the company and its respective parents etc.; covenant not to sue, confidentiality, employment references (they would not contest to me filing for unemployment benefits) payment of compensation, non disparagement, notice of revocation periods, return of property, remedies for breach of certain convenants, nature of agreement (that I agree and understand that nothing in this agreememtn is an admission by the company of any liability or unlawful conduct whatsoever) and 14 days to make my decision.   Do I really need to get find some money to see an employment law attorney or just sign the paper and accept the money?  I never asked them for money, just my job back!

    It should be obvious from that package and offer that you aren't going to get your job back, ever.

    It's your choice whether to take the 4000 and sign or go talk to an attorney.

    But you've already been given the opinion here that you have virtually no recourse against the employer.

    I hope you already filed for unemployment. It's been a week since your original post. If you didn't file when you got fired you flushed a week's worth of benefits down the drain since your waiting period starts the day you file.

    Apparently they are not interested in giving you your job back. it is up to you whether you want to accept the money or not.

    Yes, I have filed for unemployment. I did that the same day I was laid off.  I guess this is their way of trying to buy me off and shut me up. But I never asked them for money, just a reason to why did they hire me if that wasn't the position they wanted me to fill (which I never got the answer) and to get my job back.  Yes it's obvious that they don't want me back, but the amouth that they are offering me is only 4 weeks and from what I went through with them to hire me and fire me is just CRAZY.  As hard as it is to find a job that sure isn't going to last long.  Thanks for responding to the earlier post.

    Just fyi - I do not respond to private messages. And I cannot give you specific advice.

    Nothing in your post indicatesthey did anything wrong. You'll have to decide if you want to pursue it (which will be difficult without money to pay an attorney) or if you want to take the cash and move on.
