    Homeowners Association document clarification

    Hi, I just bought a home in a community with a HOA. I have an ambulance style truck that I need to bring home from work and park in front of my house. I got a notice from the HOA that I cannot park here. I asked why and the article says this " No automobile, truck, camper, motor home, mobile home, boat or other vehicle, trailer, machinery or equipment of any kind shall ever be parked on any lot or on any street right-of-way, easement or common area adjacent to any lot, except for temporary parking incident to the contemporaneous use of such object or as otherwise approve, upon strict and compelling circumstances, by the Board of Directors or the hereinafter named Association,nor shall any such object be left parked or stored on any lot or on any adjacent street right-of-way, easement or common area unless parked or stored inside a garage." Does this mean that nobody is allowed to park any car outside your house? I don't understand this paragraph. Can somebody translate this paragraph for me. It seems unreasonable to not let any homeowner park their own cars in their driveway.

    Sounds like you have interpreted it correctly; wow, I thought our HOA was tough!  Have you noticed that the streets and driveways are strangely empty?  If so, I would have to assume your intrepretation is correct.

    Actually, there are several work trucks and tons of cars parked outside, there's even some boats, which is why we chose this neighborhood. We mistakenly assumed that it would be okay to park outside since we noticed so many others were already there. We are going to ask for permission but otherwise it seems like we are going to have to buy another car and rent some sort of garage which is expensive and very inconvenient.

    It sound like vehicles can be parked there on a temporary basis; if these vehicles belong to the owners, have you questioned the hoa?

    The management company sent a notice that I  was in violation of the parking regulations. I called and she wasn't sure were the violation was. When she called me back she referred me to this paragraph which to me it seemed a little extreme. I assumed I was reading it wrong. When I first read it I understood that you couldn't leave your vehicles stored or parked for long periods of time,  which made sense to me. But when she referred me to it I was a little concerned that I wouldn't be able to park any vehicle at any time which seems ridiculous. So I was hoping that I was just misunderstanding it. I was going to make an appointment with an attorney but if that is what it says I doubt that there will be much he can do.

    I think you are being singled out because your large ambulance type vehicle (correct me if I'm wrong) is a commercial vehicle owned by your employer and used daily in the business of your employer and does not fit the exception "for temporary parking incident to the contemporaneous use of such object."

    That could explain why other residents who own campers, boats and work truck are getting away with it.

    Even if I'm wrong, you'll quickly learn that HOAs are not democracies, and there's nothing prohibiting an HOA from selectively enforcing the rules.

    If you do get an attorney, do get one that is not associated with Community Associations Institute or any of the local offshoots. They are very anti homeowner. And get one familiar with corporate law, as an hoa is a corporation.
