careless driving in lowell arkansas

    careless driving in lowell arkansas

    My question involves a careless driving ticket from the State of: Arkansas
    On 9-28-09 at 12:16 pm i was driving threw lowell, ar and i was in the inside lane at a stop light

    i was the 3rd car back and next to me was a chevy pickup pulling a trailer the light turned green and we went

    well there was enough room for me to change lanes into the outside lane with no problems so i did i used my turn singal and moved over

    well i speeded up close to the speed limit which was 45 mph and the rig in front of me about 3-4 car lengths was turning right so i turned on my signal and moved into the inside lane pretty fast but didnt cut anyone off

    well there was a cop in the turn lane coming at me about 4 car lengths and he saw me do this well after me and about 4-5 other cars went by he turned and pulled a u turn and came after me he cut in and out of traffic without any blue lights he used his turn signal then when i finally caught up to me which was like 2-3 blocks or about 2500 feet he turned on his blue lights and pulled me over

    i never was going fast than 45 mph which was the speed limit and he pulled me over because he told me i had cut the cars off when i changed lanes both times and he asked me if i was in a hurry and i said i just want to go home and go to bed thats it then he came back wrote me a ticket for careless/ prohib. driving 27-51-104 and everywhere i looked up online says the ticket will only be 100 bucks but i called up there and they want 185 for it

    they didnt say if that was with court cost or not and im going to fight this ticket so honestly did i mess up or is it cause he wanted to write a ticket for his quote and when i asked for my driver license and insurance but never asked for my registration which i had and i got a clean record i pleaed non guilty and i got court on 11-9-09 at 1pm so should i talk to the protector or what should i do?

    You should stop driving in a manner that attracts attention from cops.  Just because the vehicle ahead of you is turning that doesn't REQUIRE that you make a sudden lane change.  Moreover, it is dangerous to do that because to properly make the lane change you have to check your blind spot, which means you aren't looking forward at a vehicle that is slowing from a speed of 45 mph, and which could quickly slow down such that you hit it.

    You can fight the citation but it is your word against the officer's, and the hearing officer/judge is likely going to believe the cop.

    It isn't relevant that he didn't ask for your registration.  He isn't even obligated to ask for your license or insurance.
