    Auto insurance in Ohio

    In the State of Ohio, If I loan a car to a freind and the insurance lapses on it and my freind has an acident,  who is liable if he is at fault in the accident?   Also the state has strict penaltys for not haveing insurance.  Who would be penalized for not haveing insurance,  me or him?

    You can both be held liable.  Him as the driver and you as the owner of the vehicle.

    You.  The owner of the vehicle is responsible for the upkeep of the insurance at all times.

    Not necessarily.

    The driver, of course, is responsible for accidents caused by his own negligence.

    The owner is not responsible just by being the owner. The owner would have to be proven to have "negligently entrusted" the vehicle to the driver.

    "Negligent entrustment" has nothing to do with letting somebody drive without insurance.

    That's only half right. Both the driver and the owner are subject to penalties for not having insurance.

    Randy,

    Why are you loaning your vehicle that is in your name to someone else. Doesn't common-sense tell you that you are responsible for this vehicle. Come on.

    If this person has an accident in your vehicle you are responsible for all of the damages.

    For God's Sake, turn the brain that he gave you on and get YOUR car back.

    Yes, in most states it is against the law to operate a vehicle without auto insurance.
