    Car accident injury

    This is regarding to the GA small claims court. What type of the damages can the judge award in an auto personal injury case, medical bills, wage loss, pain and suffering, future medical  and wage loss or more?

    If you are truly in small claims court, the answers likely are:

    1.  Actual medical expenses incurred?  Probably yes.  May be subject to a test of reasonableness.  Don't expect to get reimbursed for 100 visits to a chiropractor, for example.

    2.  Actual wage loss, maybe.  Will need to be verified.  Moreover, the physician who told you to stay off work may need to testify.  That can cost major bucks that you likely would need to pay, enough that you may ned to take your case to regular civil court where you might have some hope of reimbursement.

    3. Pain and suffering are almost never compensible in small claims court.

    4.  Future medical costs and wage loss almost never are compensible in small claims court.  Small claims court does not deal with "conjecture" about what might happen.  Moreover, these numbers often exceed the limit for small claims court in most jurisdictions.

    The GA small claims court limit appears to be 15k and thats the limit for all claims in total, not each particular claim individidually.

    As long as it is the small accident that gave rise to the various claims, the total overall limit applies.

    I answered that question for you last month and gave you two links to references to pain and suffering in magistrate court so it stands to reason that whatever you ask for up to the 15,000 limit (that you can PROVE) could be awarded.

    Thanks for correcting someone above. You said “ you can PROVE.” Can you take examples and explain how to prove the pain and suffering?

    With evidence and expert testimony.

    And if you have to ask for an explanation of that, you need an attorney.
