    Where to Start

    I currently pay for my son's daycare and from time to time reimburse for his clothing and doctor's visits.The daycare payment alone adds up to bout 20 % of my net income.  And she continuously wants more and even threatens me with court ordered child support. I am under the impression that all  child support taken by the court is up to 17% for the state of Florida. By the way, my son lives in Florida but I now live in New York. Also, due to the fact that I was unemployed for most of last year, I did not really pay anything. Where do I fall according to the law! it? Is it Florida rules or New York Rules? Please help!!!!!!!!!!!

    You probably fall under FL child support laws since that's where the child and the custodial parent lives. But I'm no lawyer so you'll want to verify that with a lawyer.

    If you didn't pay anything for a year you could owe several thousands of dollars for which your feet could be put to the fire.

    I hope you are keeping careful records and receipts for whatever money you've been sending.

    You will owe child support only for the time from when she actually files a Petition for Support- not before or last year.  However,  support ( in Fl) is based upon guidelines not "17%".  You can use one of the online calculators which calculates her net income, your net income and arrives at a base support amount.  Added to the base support amount will be your percentage of daycare.  Generally,  support can be up to approx. 50% of your income.

    Correction: it seems in Fl, the ct has the discretion to make a support determination for a period of up to 24 months prior to the filing of an initial petition.

    FL Law governs your case.  Also, for 1 child your support should be from $350 - $550 per month.

    If your CS order is from NY, then the 17% rule may, in fact, apply.  So, which state issued the CS order?  Given that you still live in NY, if the original order is from NY, then that state's rules will apply as long as you remain in NY.

    If your income is cut you would be wiser to file for reduced CS--abesnt a change to order the arrearages just continue to pile up--uncool!
