Looking for advice.
Hello, two months ago I was pulled over and arrested on a narcotics charge. I live in Michigan. I posted bail and got a court appointed attorney. On the police report it said that I sold an ounce of marijuana to an undercover police officer and a C.I. They do not have me on wire and they claimed this happened september 2nd, 2009. I have an aliby, I was out of state with a friend and she is willing to testify to that fact. She has no criminal history. Right away they offered to drop the felony drug charge to a high court misdemeanor, maintaining a drug house. This was before I presented my aliby. After stating I had an aliby, I expected them to either drop the charges, or offer me something with a lot less penalties. This is my first drug charge, and other then an M.I.P. of alchol I obtained when I was 20, this is my only other charge. I went into court a couple of days ago for a settlement conference to talk to my laywer. The prosecuter isn't willing to drop the charge any lower. So I told my lawyer to go to trial. I did some research on the high court misdemeanor charge and I would do jail time. I just started a job and can't afford to go to jail. I would like to know what is my next best move here. Is it likely that they will drop the charge down now that I want to go to trial? And what are my chances? And if I do take the deal, what can I expect? I'm not very familar with the court system, especially when dealing with a felony case. I'm very nervous about it. Thank you for any advice
