In February of 2008 we bought a new house in WA State and got a loan with Countrywide/BOA again (old house was not sold at this time).We adjusted the price for the old house already multiple times. I took on a weekend job (2x12 hour shifts) from Feb 08 &amp;ndash; April 09 to substitute for the 2 mortgage payments, my wife worked more hours, so we spent more time working and trying to do the right thing and pay 2 mortgages up until I lost my weekend job in April 09 , yes I worked for 14 month 7 days a week. During this time I called BOA/Countrywide multiple times to get a loan modification, without success. We had dropped the price for the house by than to our lowest price possible. We could not afford the extra mortgage and stopped paying the mortgage for the old house in May 09. Our Agent started to work on a short sale with the lender and we found a buyer2 month ago. After month of working with all interested parties the BOA finally agreed on the short sale package, but the Mortgage Insurance put their Veto into this and requested now an additional $ 22K from us to agree on the short sale, because they consider the old house an investment property. Well we don&amp;rsquo;t have anything left after paying for 2 houses for 15 month. Other than the financial impact we already have, it had a big impact on our family life (3 Kids).&lt;/p&gt;  &lt;p&gt;Ideas or advice?&lt;/p&gt;  &lt;p&gt;Thank you&lt;/p&gt;  &lt;p&gt;Question 1: How can we force the Mortgage Insurance to agree on this deal?&lt;/p&gt;  &lt;p&gt;Question 2: Can we precede any legal steps against BOA or MI? Our buyer wanted repairs, our agent got estimates totaling 3 grand. &amp;nbsp;We told our agent we didn&amp;#39;t have that kind of money, and after negotiating each agent agreed to pay one thousand and we would put in a thousand towards repairs. I have a piece of paper indicating what each party would pay at closing, but it is signed by no one.&lt;/p&gt;  &lt;p&gt;We never saw any estimates or repairs contracts in writing, we never even so much as got a phone call from any contractors. Nothing. &amp;nbsp;Our deal fell through and the earnest money was recently turned over to us (it just barely covers the mortgage for one month). &amp;nbsp;Anyway, it was then that the realtor told us that the contractors would like to get paid for the work that they did on our house. &amp;nbsp;We were flabbergasted, I didn&amp;#39;t authorize the work and neither did my spouse, nor did we authorize our realtor to act as our agent in this capacity. We did however sign the contract for sale saying that we would fix the problems prior to closing, but that contract died. &amp;nbsp;Since we didn&amp;#39;t close on the house how can we be bound by that contract&amp;#39;s terms? It turns out that our realtor told the repairmen to do the work, her name is all over the invoices.&lt;/p&gt;  &lt;p&gt;One of the stipulations is our signed seller&amp;#39;s agreement is that the realtor is not to act as our agent in any capacity outside of selling our home. &amp;nbsp;Clearly our agent violated this and we believe that we can fire them for cause and without recourse. For some reason this past week I have received several legal advertisement stating that foreclosure has been filed against me. This does not make sense. I was about 6 months behind on my loans before the short sale closed. I never received any information from the banks that the foreclosure process would be starting nor was I served any papers.&lt;/p&gt;  &lt;p&gt;Maybe the bank recoreded it incorrect and put it down as a foreclosure? I am not sure what is going on. The real estate attorney who handled the closing for me doesn&amp;#39;t know what happened so he is useless. Do I need to contact the bank myslef and find out? What scared me is that I am going to have a foreclosure on my record now and this is public information that anyone can find out from a civil court. For example if I go to rent an apartment most realtors perfrom background checks and when they see a previous foreclosure filing you&amp;#39;re most likely out of the running. A will was drafted in the US putting everything in a trust. In the Netherlands the notary and the accountant said since the&amp;nbsp;will was drafted in the US it held no legality in the Netherlands. Therefor I was 100% owner of the estates in the Netherlands, and under no circumstances would I have to abide by any stipulations in the will.&lt;/p&gt;  &lt;p&gt;A few months later I am back in the New York and I received a letter from the firm demanding that I provide documentation that I am in school as dictated in the will if I want any funds to be released from the estate, that a few months prior I was supposedly 100% owner of.&lt;/p&gt;  &lt;p&gt;My father had also gone against the contract we made with me stipulating in writing that as long as I was in school he would take care of my rent. Now his stance&amp;nbsp;is I can pay my own rent (this seemed a little opportunistic).&amp;nbsp;However naturally I was stunned by the harsh language in the&amp;nbsp;letter from the Netherlands accountant and I sent him email after email after email asking how is this possible considering what was said and signed in the meeting. he would not respond to any of the emails. at the time was 20 and a little naive I assumed my father would be able&amp;nbsp;to help me with acquiring legal representation, instead he says I need to be grateful with what I have, I need to stop trying to manipulate the situation, I need to just abide by my mother&amp;rsquo;s instructions and attend school.&lt;/p&gt;  &lt;p&gt;I was surprised and also shocked by his unwillingness&amp;nbsp;to hear me out and help me but I thought this is my father he knows better than i do and he is rite&amp;nbsp;morraly and&amp;nbsp;I need 2 make the best from this situation and just focus on school.&amp;nbsp;considering my father is Dutch just like the accountant I suggested since my accountant refuses to communicate with me he could b my liaison to the accountant. worst decision of my life!!!&lt;/p&gt;  &lt;p&gt;Before I know it I am completely out of the loop and left in the dark about what is going on with my affairs. My father succeeded in his bloodless coup d&amp;rsquo;etat and took over&amp;nbsp;in effect&amp;nbsp;when I only asked him to be a liaison. He was making decisions behind my back,&amp;nbsp;&amp;nbsp;I never received a spreadsheet in 6 years, my accountant has authorized funds released to my father to compensate him for school rent and other things that he would decide on his own to spend or invest money on without my prior knowledge or consent and the accountant would never bother to confirm with me. the whole time my father&amp;rsquo;s attitude is one of &amp;ldquo;oh well, screw you.&amp;rdquo;&lt;/p&gt;  &lt;p&gt;Now it is 2009 this has gone on 6 years and the estate is in default because the accountant &amp;ldquo;ran out of money to pay the mortgages&amp;rdquo; now I am back in control after my father said &amp;quot;and oh by the way&amp;nbsp;u might need&amp;nbsp;to sell everything because there is no money left.&amp;quot;&amp;nbsp;I cursed out my father and demanded he never have anything more to do with the accountant in the Netherlands. I got backing from the trust here in the US and they acquired an attorney in the Netherlands. &amp;nbsp;I need to sell everything before the bank forecloses, but after 4k worth of mortgage payments there isn&amp;rsquo;t much left. &lt;/p&gt;  &lt;p&gt;I feel my father is 50% responsible and my accountant 50%. my father should know something is wrong when an accountant refuses to communicate with a client after such a drastic policy change. I feel he was trying 2 take advantage of the father son relationship and manipulate me and the situation from day one. And my accountant just totally dropped the ball if not cooperated with my father,&amp;nbsp;no spreadsheets, paying out of principal, sending baseless letters and refusing&amp;nbsp; explain them, releasing funds to my father&amp;rsquo;s account without my permission consent or knowledge in effect bleeding me dry over 6 years causing me considerable stress bringing me to the verge of losing my mind I&amp;rsquo;m just in a constant state of depression about this I can&amp;rsquo;t concentrate on anything school relationships jobs I&amp;rsquo;m a mess mentally and emotionally over this situation. &lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;I have a question from a Real Estate Lawyer with regards to HOA.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;We purchased a HOA house about 6 months ago.&amp;nbsp; At the time, my wife, who is self employed, had a studio to provide chiropractice and Pilates to her clients.&lt;/p&gt;  &lt;p&gt;However, the economy did it&amp;#39;s toll and we were forced to close the studio to save on rental costs.&amp;nbsp; We however, needed her income, in addition to mine, to survive, so she continued to see her clients at home.&amp;nbsp; &lt;/p&gt;  &lt;p&gt;Now, one of the neighbors (who is a lady that every other neighbor was warnning us about) has made a complaint to the HOA and HOA today sent us a letter stating that they have received information that we are running a business out of our house and that is illegal.&lt;/p&gt;  &lt;p&gt;Here are the facts: &lt;/p&gt;  &lt;p&gt;first of all, my wife only sees upto 2 clients at any point of time, and we have adequate garage space to make sure their cars are not park in the public areas.&amp;nbsp; &lt;/p&gt;  &lt;p&gt;Secondly, the business is completely conducted inside the house, so there is absolutely no noise or any other issues that could potentially bother any of the neighbors&lt;/p&gt;  &lt;p&gt;The HOA CCRC says the house should be only used for private reasons.&lt;/p&gt;  &lt;p&gt;and Here are my questions:&lt;/p&gt;  &lt;p&gt;1)&amp;nbsp; First of all who has the burden of proof that we are running a business&lt;/p&gt;  &lt;p&gt;2)&amp;nbsp; What happens if we stop charging the clients and still let them come home, are we not allowed to have people at home?&lt;/p&gt;  &lt;p&gt;3)&amp;nbsp; what are the powers of HOA? and could a good lawyer help us if we decide to fight this?&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;Thanks verymuch for your help, please advise.&lt;/p&gt;  &lt;p&gt;We have been approached by our&amp;nbsp;city sewer&amp;nbsp;manager and a hired engineer to discuss the city&amp;#39;s *need* for a new gravity fed sewer easement across our property.&amp;nbsp; We have owned our property for 24 years, and 23 years ago felt truly forced (we were young and naive and there was talk of eminent domain) to grant an approx. 900 ft vacuum sewer easement across our property.&amp;nbsp; &lt;/p&gt;  &lt;p&gt;Now the city is back, this time wanting a completely new easement, while still retaining the existing one.&amp;nbsp;&amp;nbsp;&amp;nbsp; They propose a 700 ft (give or take) permanent easement, 20 ft wide, with approximately 6 manholes, and the pumping station will be set just behind our property.&lt;/p&gt;  &lt;p&gt;When first approached, we were told the pumping station would be set approximately 200 ft (more or less) behind our property.&amp;nbsp; They are now saying Federal guidelines prevents them from placing it further back due to land drop-off. &amp;nbsp;So now it will sit back only 50 ft or so, maybe less. &lt;/p&gt;  &lt;p&gt;When planning first started, monies were expected from impact fees charged to the builders of two proposed large housing developments set to go in across the street from us.&amp;nbsp; The economy tanked and those were put on hold, the sewer expansion was put on hold also. &amp;nbsp; &lt;/p&gt;  &lt;p&gt;When stimulus money became available, the city applied and was granted funds for this project.&amp;nbsp; They are saying their timeline is extremely tight now and they must have our answer within a few days. &lt;/p&gt;  &lt;p&gt;They tell us that there are a multitude of reasons,&amp;nbsp;extra costs, possible damage to the old line, etc..&amp;nbsp;for not staying along the existing easement, but they &lt;strong&gt;will &lt;/strong&gt;stay there if we refuse the new one.&amp;nbsp; They say one way or the other the new line is coming. &amp;nbsp;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;It is our thinking that two easements are much less desirable than one, and the approx. $4000 offered for the new easement will not offset that.&amp;nbsp; Also, we are truly worried about the property value &amp;nbsp;impact of having a pumping station just behind the back of our property.&amp;nbsp; It is being set on property owned by one of the developers involved in the original planning of the new easement, the development that will eventually be built across the street in front of our property, and the new pumping station is even named for that development. &lt;/p&gt;  &lt;p&gt;At the end of the last conversation we were given a few days to decide, whether to allow the new easement or not.&amp;nbsp; It was over-emphasized that they really &lt;b&gt;do not&lt;/b&gt; want to stay in the old easement.&amp;nbsp; And that if they do stay there, we will be plagued by repairs for decades to come.&amp;nbsp; &lt;/p&gt;  &lt;p&gt;We really don&amp;rsquo;t know what to do, we feel that we are not getting the whole story, and we feel pressured. &amp;nbsp;We also feel it unfair that the pumping station is being put behind us far away from the new development going in (at some time) across the street for which it is named.&amp;nbsp; We are the only home such affected, though there is a school affected also. &lt;/p&gt;  &lt;p&gt;Either we have manhole after manhole installed along our existing easement (there are none now) or we grant a totally new one and have them there.&amp;nbsp; It&amp;rsquo;s just a bad situation either way we look at it. &lt;/p&gt;  &lt;p&gt;We were forced to give the first easement, and then we had to sell land to the city for greenway crossing, now they are back for more.&amp;nbsp; One being that you don&amp;#39;t have a &amp;quot;mortgage&amp;quot; so going through a lender isn&amp;#39;t an option becuase you do not hold the deed.&amp;nbsp; However, we have also heard that you cannot enter into a land contract if there is still a balance on the home&amp;nbsp;(my grandpa still has about $50k of a HELOC).&amp;nbsp;However at the same time, my husband and I do not have $50k to pay it off so that puts a damper into the situation.&amp;nbsp;&amp;nbsp;... adding more to the confusing aspect of things) With the purchase we&amp;#39;d like to put an additon on the home&amp;nbsp;so&amp;nbsp;my grandpa&amp;nbsp;has his own living area.&amp;nbsp; Again, we&amp;#39;d need a loan for that as well.&amp;nbsp; And with no deed, comes no loan.&amp;nbsp; &lt;/p&gt;  &lt;p&gt;We are trying to do an agreement that gets the deed into our name so we can establish our equity again.&amp;nbsp; I called the city hall as soon as I received the certified mail and allowed the inspector in my basement within the next two hours of my call.&amp;nbsp; The fact is that I did not and do not have a illegal rental basement unit as the letter said.&amp;nbsp; Therefore, I was not afraid to welcome the city hall building inspector in.&amp;nbsp; As matter of fact, the city hall has just inspected my property last november per a&amp;nbsp; every 10 yr law.&lt;/p&gt;  &lt;p&gt;Unfortunately, this building inspector started to inspect my basement with a unhappy mood because he knew I was waiting for him for 45 mins in front of&amp;nbsp; my house according to the time he told me over the phone.&amp;nbsp; I did not saying anything but his mood looked unfriendly.&amp;nbsp; He looked around my basement and found no such illegal unit.&amp;nbsp; However, he started agitating by saying the electical wires in my basement.&amp;nbsp; He pointed the dates (which I never knew) on the wires which go into the playing room and laundry room and also with a bathroom.&amp;nbsp; He said I didn&amp;#39;t have permit for the electical wires.&amp;nbsp; At that moment, I was not quite sure whether I got permit for what he said.&amp;nbsp; I said no anyway and I said I did hire some electrician with liscenses.&amp;nbsp; He said it was my responsibility if the electrician did not applied permit.&amp;nbsp; I never prepared for this topic so he got more agitated and went in the bathroom saying I have new toilet and new vanity which may be newly built.&amp;nbsp; The bathroom was there when I purchased this house 10 years ago.&amp;nbsp; Yes I changed the toilet and the vanity.&amp;nbsp; He said I did not accept what he found and he had to inspect the whole house.&amp;nbsp; So he did.&amp;nbsp; He even forced me to keep knocking on my tenant&amp;#39;s door&amp;nbsp;and saying I am the landlord and I could come in my tentant&amp;#39;s unit without advanced notice.&amp;nbsp; I did not feel comfortable at all but I did anyway...&amp;nbsp; At the end, he found I had one keylock in one of my bedrooms and one keylock in my living room.&amp;nbsp; Then he said I should not have keylocks in any of my rooms inside the unit.&amp;nbsp; By the time he left, he said to me he would check on my electrical wires.&lt;/p&gt;  &lt;p&gt;Since then I had called city hall and trying to find out who was the neighbor who reported me.&amp;nbsp; But they only said that was confidential and they said I would received the result of this finding in two weeks.&amp;nbsp; Therefore,&amp;nbsp; I was waiting uncomfortably because what the inspector said it was my responsibility if the electrician did not get the permit.&amp;nbsp; I thought it should be the electrician&amp;#39;s business as long as I knew they had license.&amp;nbsp; After two weeks I received&amp;nbsp;a same letter as the first time but just indicated final.&amp;nbsp; I&amp;nbsp;called the city hall building inspection and asked what was going on to the inspector who signed the letter.&amp;nbsp; That inspector said I was not home when he was at my property.&amp;nbsp; I asked if he was sure because the named inspector had visited my property two weeks ago.&amp;nbsp; Then, silent with no explaination and asked me to speak to the inspector who visted my house.&amp;nbsp; I was insulted by this inspector right away.&amp;nbsp; He said I did not have permit to do the wires in the basement and renting rooms in my unit to different people base on my keylocks.&amp;nbsp; He also convinced me that he never had keylocks in his house for his wife and two children and they trust each other.&amp;nbsp; Arguement was on,on... not going any where.&amp;nbsp; So I said please send me your findings and I will see.&amp;nbsp; I waited for another week, no letter came.&amp;nbsp; And I called again, this time he said I rented my living room and repeating the wires without permits.&amp;nbsp; I knew no matter I explained he would not accept.&amp;nbsp; It seemed to me he just wanted me accepted his findings and assumsions over the phone!&amp;nbsp;&amp;nbsp;It would make it worse each time I called in because he always had new accusation toward me.&amp;nbsp; Then&amp;nbsp;I said, &amp;quot; Could you please send me the letter first?&amp;quot;&amp;nbsp; He said he was in a good mood and he would write my letter right away.&amp;nbsp; That was in the afternoon 2:30pm on Monday.&lt;/p&gt;  &lt;p&gt;On Thursday, I received the certified mailed.&amp;nbsp; This letter stated that two keylocks which one keylock in the livingroom converted into bedroom; Ilegal electrical wires in the basement; fixture in the basement bathroom without permit.&amp;nbsp; Then ordered me to remove keylocks and cease renting, basement finished without permit, Ilegal wires in the basement, need eletrician and plumber with license to remove all within 14 days from the date on the letter which the date I called.&amp;nbsp; I called yesterday because the inspector was not in on Friday.&amp;nbsp; I said I agree with the wires if the electrician I hired did not get permit and I will follow the order.&amp;nbsp; But he should not accused me on the renting room based on the keylock in my living room.&amp;nbsp; I said I did not want to appeal your findings but I would prefer to work with you.&amp;nbsp; He said appealing would cost me more.&amp;nbsp; I spend 45 mins and he finally agreed to take the cease renting from the letter.&amp;nbsp; He also said the letter would be today and could not be back date.&amp;nbsp; Five minutes after the phone call I found the vate meaning of the basement finished without permit.&amp;nbsp; I&amp;nbsp;called him again but was told&amp;nbsp;he was in a meeting and should call him back&amp;nbsp;in 20 mins.&amp;nbsp; I did and &amp;nbsp;asked what the order of basement finished without permit meaned.&amp;nbsp; He said&amp;nbsp;I had new toilet and vanity without permits.&amp;nbsp; I said the toilet and vanity should not need a permit and he said that said that in the building zone law.&amp;nbsp; Since he had a edited letter handy and he was not going to make any changes and complainting too much paper work.&amp;nbsp; Ah...&amp;nbsp; I only can wait for the letter.&amp;nbsp; Guess what, I received the letter today and found that he only simply took off the cease renting from the order but not the introduction beginning accusing the keylock in the living room converting into a bedroom.&amp;nbsp;He also backdated to the first letter even he just sent this letter out to me&amp;nbsp;on this Monday.&amp;nbsp; Eventually I set up a camera and we caught the person who was breaking in. He has since been convicted and I have moved out of the apartment because I didn&amp;rsquo;t feel safe there. The police found that the person breaking in was using a key to get in and that he had multiple keys and was entering multiple units in the same complex. He did not, however, say how he got the key other than to say that he found it.&lt;br /&gt;  My problem now is that the apartment complex is coming after me for money because they say that I broke the lease. My opinion is that it was their fault that my apartment got broken into, since the thief had &amp;ldquo;found&amp;rdquo; multiple keys that must have been from them. I don&amp;rsquo;t feel like they have the right to expect me to stay. The problem is that I cannot prove that it was their fault that the thief got the key, but it seems fairly obvious that it is their fault, since he got multiple keys for that complex.&lt;br /&gt;  I just wanted to see if you think that I have any legal ground to say that I shouldn&amp;rsquo;t have to pay the apartment complex in order to break the lease.
