I said I was thinking about it. He asked if he could make payments on the truck. I said sure. A contract was written up with the stipulation that a nonrefundable $1000 deposit was applied, and that weekly payments were to be made. Also he would not get the truck till it was completely paid for. He agreed to these stipulations and signed a contract on june 15th of 2009. I have not received any payments since and he will not answer his door when he is home. I have been to his house 18 times. I have left 2 notes for him, one taped to the windshield of his vehicle and one taped to his front door. I now have someone else interested in the truck. Though we accepted full responsibility and handed the bike over to repo guys with the hopes of making the payment that day, they began to load the bike on to their truck. As soon as our backs were turned they dropped the bike, breaking off the brake handle, scratching and denting the chrome exhaust pipes and ripping the rubber grips on the handle bar. Claiming an accident, they promised to write an accident report in front of us stating they caused the damage and would fix it.

We called the fiance company and they merely stuck us on hold for hours. When we finally got through to someone they told us we could pay the late fees and what we owe. As we attempted to make the payments, including late fees and interest the repo company has begun to tell us that they "purchased" vehicle and in order for us to again take possession of our bike we have to pay them 12,000 dollars.

The title is still in our names, with no lienholders on it. We never saw any kind of paperwork from the repo guys, I understand that they don't necessarily need to show anything nor does the creditor need to warn us that it will happen. My question is, how, if possible, do we get our motorcycle back from the repo guys having claimed they "purchased" the bike without having to pay more than what the bike is worth now? The mechanic said that the car would not pass inspection unless I had the shocks changed. My father called me up and told me that the mechanic said that I can't pass inspection without new shocks and it will cost $500 to fix. I said okay.

I got suspicious because I had just bought this car used and had a pre-sale inspection on it. I called up the mechanic who did the pre-sale inspection and he said, "No way, I looked at that car twice, and it didn't need shocks." I immediately called the garage with my car to get them to stop, but he had apparently already disassembed it, and oh, by the way, $500 isn't the total cost to fix, that's just the cost of parts for the front. There's parts for the back, and labor, and it's going to cost about $1300 for new shocks and struts.

I was totally furious that I was getting all this work done that I probably didn't need and never would have authorized had I been told the actual amount. I asked my father how he could have been confused between $500 and $1300? And what did the work order say exactly? Turns out there is no work order. I never signed anything. My father never signed anything. My father claims that $500 total is what the guy verbally said, but then changed it around once he had the car in pieces.

Do I have to pay him? Do I have to pay him the full amount? Can the mechanic put a lien on the car in NJ without any work order?

Co-Signer for a Motorcycle.

Just need some help here and I hope I can get some info on what to do with an issue I'm having right now. L and wife S need money. L calls friend D to ask for loan. Friend D says no that he needs to purchase a vehicle. L asks D if he wants to purchase a truck from him and his wife S. (Truck in wife S's name). L & S owe D $300 and they want $800 for vehicle so they say they will take $500 in cash less the $300 they owe D. D tells L that he needs a vehicle that is road ready, pass inspection, safe. L assures D the vehicle needs nothing but an inspection so D agrees to purchase vehicle. Later L says it needs windshield wipers and a headlight. D says that is ok. L later picks up D to look at the truck and it is running rough. L assures D that it is a part that he has purchased and will put on truck and truck will be fine. D says that will be fine. After purchase of truck when D putting plate & tags on truck so he can move it to get it to a garage as it did not have a plate or tags prior - L informs D that the truck may need a starter. L & D argree that if the vehicle needs anything more than $500 (all the money he has left) to pass inspection, be road ready and safe that L & S will take the vehicle back and return D's money. At inspection the vehicle needs phenomenal repairs. L says he will give D money back when L & S get their income tax check. Then L says he wants vehicle checked by his mechanic. D agrees but states their original agreement stands. L becomes incarcerated. S says she wants to continue with her husbands wishes. D drives truck to their mechanic because S cannot drive stick. D gives S possession of vehicle by handing her the keys. S puts keys and check in an envelope and drops it into a drop box at mechanic. The mechanic calls S then S calls D and tells D to call mechanic. Mechanic says it will only cost $250. After D explains he already had truck inspected and it failed and why, mechanic says he thought he doing favor for L & S and says he would recheck it. Mechanic calls D with same info D's mechanic had and more. D calls S tells her what her mechanic says and since she could not drive stick asks what she wants to do with truck. D offers to have AAA tow it but AAA says it has to be inspected so S tells D not to worry about it they know the mechanic and they will take care of it. D's mom contacts S to have truck put back in her name S says she doesn't have the money. D's mom says she will pay for it. D's mom never hears from S again and S never contacts D's mom. D eventually contacts S to ask what is going on and S informs D they do not have the money and there is nothing they can do about it. There is no further contact after that. L & S never show up to DJ hearing but appeal the decision. L & S now have an attorney but we cannot afford one. It is working on the levels of arbitration. We just went to the court to see if the judge would allow the complaint. The judge dismissed everything but the story of what happened. Have info from D's mechanic but L & S's mechanic said he never wrote one up. More detail but would be much longer.

Auto Straw Purchase

I know a car straw purchase is illegal and that its a type of fraud...so how much time car you get if convicted of a straw purchase and since its a type of fraud is it going to be considered as a felony??

Friend stops payments on car in my name

My friend asked me to buy (finance) a car from a car dealer.
