He had a prior court order to do so. He sent me a medical card for the children. The next month the coverage was dropped, but he did not tell me information. A few months later my son became seriously ill. I took him to the emergency room and used the insurance card from his father. The next day at a follow up at the doc's office they told me the insurance had been cancelled. I payed $80 cash for that visit. The hospital later sent me a bill of over $4,000 for the care my son reieved. I think they are about to sue me for the money. I really can not afford this, and it has gone on my credit. I live in GA... the kids father lives in CT. Can I sue him to get the money I owe? How do I go about this? Thank you for your time.

Unwed Fathers Parental Rights for an unborn fetus?

I briefly dated this person and had broken up with him and the break-up was really bad. I found out that I am pregnant and I contacted him. I told him that I don't want to have any type of contact with him nor do I want any support from him. He indicated to me that he was going to hire an attorney . I received a letter from a attorney demanding that produce a letter from the doctors office so that they can verify my pregnancy and that I have to allow the ex-boyfriend to participate through out the pregnancy? I am scared because I feel that he is using the attorney to continue to harrass me considering that I have blocked him all my email accounts and also changed my phone numbers. I admit I barely knew him how ever Im not even sure if I want the pregnancy? All I do know is that I feel like my rights have been violated towards my medical privacy? I dont want my ex to contact the doctors and harass them for information or to try have any contact with me. Honestly I just want him to leave me alone and I if I choose to continue this I dont want him around. I understand after the child is born I have an obligation to contact him. But untill then what are my rights? I AM IN DIRE NEED OF HELP. ABOUT A YEAR AGO THE MOTHER OF MY DAUGHTER AND STEP SON TOOK MY KIDS TO CALIFORNIA BECAUSE OF RELATIONSHIP PROBLEMS WE WERE HAVING STEMMING FROM THE DEATH OF OUR SON A YEAR AND A HALF PRIOR TO HER LEAVING. INITIALLY IT WAS TO GIVE US TIME APART TO HEAL. AS TIME WENT BY IT BECAME EVIDENT TO ME THAT THAT WASN'T HER PLAN ANYMORE AND FOR THE PAST THREE MONTHS I HAVEN'T EVEN BEEN ABLE TO GET A HOLD OF MY KIDS, I HAVE NO NUMBER, I HAVE NO CLUE WHERE THEY RESIDE, I HAVE BEEN RENDERED COMPLETELY HELPLESS AS A FATHER. THE ONLY TIME I GET A CALL IS AT HER LEISURE, USUALLY ONCE EVERY WEEK OR SO, CONVENIENTLY WHEN MY KIDS ARE NO WHERE AROUND HER. SHE CALLS ME DESPERATELY TELLING ME SHE'S DOING HORRIBLY AND SHE WANTS TO RETURN TO SEATTLE, SO I BUY TICKETS FOR THEM AND THEN I DON'T HEAR FROM HER AGAIN TILL AFTER THE FLIGHT IS SCHEDULED TO LEAVE TO TELL ME SHE'S NOT COMING. THEN I AM LEFT TO WONDER WHAT'S GOING ON THERE AND IF MY KIDS ARE OK. SHE HAS A HISTORY OF DRUG ABUSE PRIOR TO US BEING TOGETHER AND I AM FEARING THAT SHE HAS GONE BACK TO THAT WAY OF LIFE. I AM SO TORN APART BY THIS. I AM NOTHING IF I AM NOT A FATHER, BEING A FATHER TO MY KIDS IS AND ALWAYS HAS BEEN MY REASON FOR LIVING. I AM SO LOST AS TO WHAT I CAN DO SINCE I DON'T EVEN NO WHERE THEY ARE AT. I HAVE BEEN RELUCTANT TO DO ANYTHING LEGALLY DUE TO THE CALLS I'VE BEEN GETTING THAT SHOW PROMISE THAT WE CAN WORK THINGS OUT AND BE A FAMILY AGAIN BUT IN THE MEAN TIME I'VE SEEN MY KIDS ONLY ONCE IN THE LAST YEAR. ANOTHER PROBLEM I HAVE IS THE MONEY TO PAY THE 4000 DOLLARS THAT WAS ASKED OF ME BY A LAWYER I CALLED A MONTH AGO. I DO WORK AND I AM WILLING TO WORK SOMETHING OUT TO PAY. OR IF THERE IS ANY TYPE OF PRO BONO AVAILABLE I DON'T KNOW HOW THAT WORKS. ALL I KNOW IS I AM VERY LOST AND I AM STILL RECOVERING FROM MY SON DYING IN MY ARMS AND LOSING MY OTHER TWO CHILDREN LIKE THIS HAS RENDERED ME HELPLESS AND I FEEL LIKE JUST GIVING UP. IF THERE IS ANYWAY YANYONE CAN HELP ME I WILL BE FOREVER IN YOUR DEBT. THANK YOU FOR YOUR TIME.

Hiring an attorney?

I am looking at two seperate attorneys to hire. The mother of my step-daughter has just recently for the past two years been involved with her daughter seeing her one weekend a month, holidays and birthdays would be shared, untill this summer.

This summer was agreed between my husband and his ex that their daughter would go for the summer and return for school with dad, this is not the case now. The ex has decided to enroll my step daughter into school in the same state, but different city.

The mother has cut off all communication between my husband and his daughter my husband has tried to contact her through phone, and social networking sites, she will not respond it has been several months of this. It is coming closer and closer to the holidays and my husband misses his daughter dearly, it is so hard to have to see him go through this and I have to be the strong one when all I want to do is break down and cry. I have two beautiful angels myself and they miss thier sister so much too. My husband will be filing for custody very soon, he has an appt with an attorney in about 3 weeks.

I have been studying the AZ child custody laws and it states that untill paternity is established the father does not have any rights to his child, even if the father has signed the birth certificate?

The mother thinks that what she is doing is right because she is the mother and she will have no repercussions, is this correct?

Will her actions giver her less of a chance of winning custodyy?

I would appreciate any feed back any one has

NEED HELP GETTING MY DAUGHTER BACK

I AM A 26 YR OLD MOTHER. Since then I've moved four times in search of work. My ex-husband has residential custody of my children. I was ordered to pay $300.00 a week in child support for our two sons. This was based on the amount of money I made back in 2005. I am in a situation where I don't have a car, I don't have a job, and I don't have my own place to live. I've been living with family and friends trying to find work. I've moved out of state seeking work to no avail. My situation is so bad that I am unable to obtain a lawyer to help me reduce child support payments or to help in this situation.

My children are not suffering in any way. Their father has more than enough means to support them. I don't want to shirk my responsibilities in any way but I don't have the means to pay the child support and need help in how to change the amount imposed. I have been in constant contact with the courts apprising them of my status but the amount continues to accumulate.

Once I fill out the needed forms and I file a motion to reduce my child support obligation, how long does it take for it to be adjusted? And, can the courts put a freeze on me paying until I can obtain a decent job? I am attending the University of Phoenix online am will graduate in 2011. I have informed the courts of this as well. Will they allow me to postpone my support payments until I can get a job and finish school?

I was divorced in New Jersey but live in Florida for now.

Pre-Marriage Debt Question?

Hello,

I am new to the site but had a simple question regarding PRE-marital debt.

My fiance' and I are debating if we should get married sometime early after the new year; we have sat and discussed our different 'pre-marital situations' and debt seems to be the biggest discussion.

I have a small amount of debt, mainly small medical bills and that's about it; I just finished paying off my auto loan and don't have any other loans (home, business, etc.). He on the other hand doesn't have alot of 'other' debt but he does have back child support and he also owes the IRS about $4,000.

I just want to know before I take such a huge step, if we do decide to go ahead and marry next year, will I then become responsible for his back child support and IRS debts?

P.S. I have a 2 year old daughter and her father, my ex-boyfriend, has been threatening me about taking me to court. There are no court oders in place, except for child support. None for custody or visitation. We both did sign papers for him to be on her Birth Cert. She was born in 2/07 and he did not start making payments till 5/08. She leaves with me in a stable environment and has everything she needs. We live in Ohio, and I have done some research and I believe that if her father wants more it is up to him to file with the courts. My problems are I do not trust him enough to take my daughter and I have set up a visitation agreement-no court involvment--last month and he has already missed 2 visits, and also have never once called during the time period I set up for him to speak with her..or any other time. He has a strong history of drug and alcohol abuse, one of the many reasons I left him, and has multiple DUIs. He also has a charge from last year of theft from his former employer. I think he may be on probabtion still. He was actually born out of the country, but is a perm. resident. I do not want him in and out of my daughter's life when ever its good for him, or when he doesnt have something better to do. I also do not trust him to be alone with her because of his drinking and drugs. He also has a 4 year old with another woman, whom he sees for 4 hours every other Sunday. Her mother set up that schedule and he seems to be ok with it..only difference is he can take her and do whatever he wants during the time period. I do have contact with the other girl's mother and basically she says she does the very minium to keep him "happy" so he will not try to take her to court. She is older then my daughter and has had more bonding then my daughter. He has been off and on, more off, since my daughter was a newborn. My questions are is there anything I can do before, if, he does file in court. He has been saying this for a while now and my personal belief is he wont cause he doesnt want more responsiblity as a father. I am just tired of the disrespect and abuse I have to take from him. He has no appreciation for all I do as a single mother and has had over 2 years to act like a real father. He swears and yells at me in front of my daughter and it scares her and she is too little to know whats going on. To her Daddy is someone she plays with once in awhile. The last straw was when he told me to shut up yesterdat at chucke cheese while he was holding my daughter. She told me in the car on the way home she doesnt like when Daddy yells at me. Please help me I am scared of what could happen..

I am Not The Father

I recently found out that I was not the father of a child by a legal DNA test and want to get off a birth certificate....I know that I have to get a petition to get a court order of non-paternity to be taken off the birth certificate and it needs to be signed by a judge this is expensive .....My question is if the mother is willing to consent that I am not the father based on the legal test that she had done can this speed up the process in terms that she does not have to be served with court papers....and also how can this be accomplished.....Thanks JT

a mom who is wanting to move and get away from babies father

I am currently 7 months pregnant and i am trying to move out of state to get away from the babies father. he is very mentally and verbally abusive and i have had to call the cops on him for harrassment. i have ended up in the hospital twice for having contractions after he has called and harressed me and threatend me. i do not want him to have any visitation or custody of my son.i feel that i can not trust him to be sober when my son is around because he has 2 dui's for heroin and one is pending right now. he has a record for busting out windows of ex-girlfiends cars and harrassing them. he has shouved me through doorways and smacked me in the belly while pregnant. he keeps telling me to get rid of my son and talks about aborting the baby with a rusty bent coat hanger. he has also said that no judge will give me custody because i am currently at my dads and have a minimum wage job..he says he will get full custody because he is still at home with mom and dad and they have money for a lawyer and i dont and the judge wont look at him not having a job as a problem because his parents have money. i have talked to a lawyer and he has told me that it is very hard to get visitation away from the father and the only way i can get away is to move either before i have my son or with in the 6 months that i have my son and then he will have to petition the courts of the state i move to. if i move can i be drug back to illinois if wants dna test and we go to court? the lawyer has also told me that i cant afford a lawyer with what i make..i dont know what to do besides move out of state but i dont want to be drug back. i have a job transfer waiting for me as soon as i have my son and i dont want it to get ruined by him dragging me back to illinois. can someone give any kind of advise?

Unmarried Father in VA trying stop mother from moving away

I'm a father to a little boy. I am 17 living with my father in Michigan. My best friend and her family have agreed to take me in and I will be going to school for another year. I was told that under Michigan law I can leave the house at 17 and the police will not consider me a runaway. I have a good place to go, one far better than the situation currently. Is this true or will my friends family get into trouble taking me in. Thank you for any help. The biological father (17) and my daughter (M., 17) were together in the hospital when she found out she was pregnant. The biological father became abusive so M. dumped him.

She then began dating a boy that she had dated 2 years prior to her pregnancy (R, 18). He knew that she was pregnant (approx. 3 months) and wanted to be there for her. They became engaged and were very happy together. M. gave birth to a beautiful little girl on March 28, 2009. I was not at the hospital when these kids filled out the birthcertificate. They decided to put R. down as the biological father. I knew this was a bad idea but, my hands were tied because in NY state M. was medically emancipated. I could not believe that the hospital would allow a 17 and an 18 year old fill out a birthcertificate!

It was agreed that R, M., and the baby would spend three day at his house and three days at her house, just so they had the assistance from both families. Everything was fine until R. became very controlling. R. and M. had a final blow out on August 6, 2009 in which he threw M. and the baby out of his mother's house. I picked M. and the baby up - my daughter was obviously distraught.

We have been to family court a couple of times now. This last time (Nov. 6th) was particularly confusing. We were attempting to vacate paternity using Fraud as our reasoning. The judge argued with our lawyer that it was not Fraud and refused to order a paternity test. My lawyer said that that is absolute nonsense. R. will not admit to knowing that he was not the father even though everyone knows that the child is not his (he has admitted this to several people).

My lawyer and I have spoken and he wants my daughter to play the bad guy saying that she convinced R. that he was the father and manipulated him into signing the birthcertificate. This leaves me feeling very uneasy. For one, it is not the truth and secondly I am afraid that doing this would come back to haunt us when we go to court with the actual father. M. does not want the actual father in the picture at all because he was (sexually) abusive while she was pregnant.

I know this is all very complex and the kids really screwed up. I just need some advice or even some direction so that I can do my own research (case law, etc). What would you suggest?

Another lawyer said this:

6) The court may order the mother, the child and the man whose paternity of the child was determined by the paternity judgment to submit to blood tests. In deciding whether to order blood tests, the court shall consider the interests of the parties and the child and, if it is just and equitable to do so, may deny a request for blood tests. If the court orders blood tests under this subsection, the court shall order the petitioner to pay the costs of the blood tests.

(7) Unless the court finds, giving consideration to the interests of the parties and the child, that to do so would be substantially inequitable, the court shall vacate or set aside the paternity determination of the paternity judgment, including provisions imposing child support obligations, and enter a judgment of nonpaternity if the court finds by a preponderance of the evidence that:

(a) The paternity determination was obtained by or was the result of:

(A) Mistake, inadvertence, surprise or excusable neglect; or

(B) Fraud, misrepresentation or other misconduct of an adverse party;

(b) The mistake, inadvertence, surprise, excusable neglect, fraud, misrepresentation or other misconduct was discovered by the petitioner after the entry of the paternity judgment; and

(c) Blood tests establish that the man is not the biological father of the child.

(8) If the court finds that the paternity determination of a paternity judgment was obtained by or was the result of fraud, the court may vacate or set aside the paternity determination regardless of whether the fraud was intrinsic or extrinsic.

Taking British born children back to the UK

Hello, I and my children are born-bred british citizens and have recently arrived in Senegal, then moved onto Cameroon, Africa so that my husband could establish a business. I have always travelled alone with our three children (ages, 15,11 and 9) with no problems. My husband decided to place our children in boarding schools in Cameroon and the children and i are extremely unhappy. I have told him that i want to return to the Uk with the children and at first he agreed. We have had several other arguments whenever i bring up the fact that the children and i are unhappy and want to go home. It has come to a point where he's made statements such as 'I can never allow the children to go back to England', which has scared me. When left Senegal in September on a visitors visa to come to cameroon and have no residency or plans to become residents here. My daughter who is 11 years old, suffers with a skin condition and has been out of school practically every week, since being here. She has never spent a full 4 weeks in the boarding school. I am terribly concerned for my children's health and wellbeing, as they are not used to the harshness of a boarding school and certainly unaccustomed to the culture and ways things are done here. I am 7 months pregnant and will be returning to the Uk next month before my baby is born. I want to take my children home with me, but i know my husband will continue to be stubborn and argumentative about it. I am afraid that if i continuouisly let him know that we all want to go home, he will do what he can to prevent the children from returning. Cameroon is a very corrupted country and he would not hesitate to pay someone to stop me. My question is this, as i have travelled from Senegal to Cameroon, to the UK alone with no questions asked about consent from the father, i want to know if i took the children the same way as per normal would i be breaking any laws. We are still together in a relationship, but i'm just extremely unhappy, isolated and lonely without my children. They are also unhappy especially my 9 year old son and 11 year old daughter who needs to be at home (in day school) so that she can be cared for. Please help with any advice you may have. Kind regards, BarbJ

How to have a name changed?

My grandson who is 10 years old, has his fathers name along with my daughters name. He has been burned in the past by his exes and says he wants me to see his lawyer before we concieve a child together for "Our protection". I couldn't help but be a little offended by this, especially since I have been more patient with him than anyone has ever been with him, and he admits this. He is a workaholic and we do not live together and therefore do not spend as much time together as a "normal" couple do. I love him dearly and I am almost 39 so time is rapidly running out for me to have a successful pregnancy. Should I be concerned that he wants to "protect" himself from basically ME? He says he plans on marrying me when the time is right (he is twice divorced) and that my child will be his last but he wants to finish getting his career on track before we get married.
