Officer Wrote Location That Doesn't Even Exist

I'm in Texas. I received a citation for running a red light. When I got home to look at the ticket, I noticed that the issuing officer made a mistake and wrote in an intersection that does not exist. Would this be grounds for having the ticket thrown out? I'm barely keeping my head above water financially. The fine for this alone will cause my electricity to be disconnected and hiring a lawyer is out of the question but, at the same time, I definitely don't want to waste the court's time by trying to fight something that I don't have the smallest chance of winning. I should add that I have a commercial driver's license so deferred adjudication and traffic school are not options for me.

hello,

I was involved in an accident, police were called to the scene and responded quickly. after interviewing my self and the other driver involved, i was issued a ticket for an improper lane change. the officers were not on the scene at the time of the accident, i am not aware if the other party has been issued a citation, and to teh best of my knowladge no other witnesses were interviewed. without getting into the specifics of how the accident happend, is the officer not being on the scene an option worth exploring to try for a dismissal on the court date? thank you.

Pleading Leniency - CA Expired Driver's License and Tag

I was pulled over about two months ago in Hollywood for driving with an expired license tag and an out of state Driver's License (which, in California, means that you are driving without a Driver's License). The reason why the tag was expired was that my car didn't have insurance at the time and was thus suspended.

Cue sob story: I hadn't renewed the insurance because the magazine I work for has been laying people off and only paying freelancers (me) in restaurant trade. I honestly didn't have the money to pay for insurance, so I hadn't been driving my car. The only reason why I was driving that night is that I was going to use the restaurant trade to take my girlfriend out to dinner – she was flying to France to live there and teach English for a year. It was a goodbye dinner, so I thought we'd take my car. Big mistake. I was pulled over and cited for having an expired tag (infraction) and "driving without a license" (even though I had a valid MI license, it's a misdemeanor). The cop didn't say anything about the insurance and let me go without impounding my car or taking me to jail.

Since then, I've gotten both a CA driver's license and insurance and re-registered my car. The best possible scenario for my court date (this Thursday) is if the police officer doesn't show up. I don't know how likely that is, so I was wondering what would be best strategy for the courtroom. Do I give the judge the full sob story? Do I just say that I've corrected both of the problems and that I would prefer community service? Am I going to have to go to jail / spend money on a huge fine?

Your thoughts would be much appreciated - thanks!

I was traveling from aunts about 10pm, I came to an intersecton where my light was green, from the right side of the intersection a police officer was speeding to his light which was red, I slowed down thinking that he was going to turn at his light, ok....I past my first green light, moving on to the next light which was red...mind you the officer is about a 3/4 of mile behind me traveling in the same direction but he's in the left side lane beside me when he came to the same light that was still red.....moving on across the bridge coming to another main intersection with the light being red, the officer is still riding beside me in the leftside lane...mind you, there is NO SPEEDING going on, my seat belt is on, i wasn't talking on my cell, all my lights are in working order, and my tags are up to date...the light is now green, I pulled off first, after crossing the intersection, the police officer then switch to the right lane in which I was driving in and got really close to my rear, about 30-45 secs after getting behind me...he put on his lights.....ok, I pulled over to find out what was wrong, remind you, I done nothing illegal, he asked for my license and registration, I gave it to him politely, and I did asked why was I being pulled over, he stated "your license is suspended" ok???? here is where I got confused, I wasn't doing anything illegal so why was I pulled over? why did you run my plates on my car? was I random pick that night to make his quota, and I asked him again, what was I being pulled over for, he never answered just kept telling me the my license was suspended....I NEVER got a ticket that night for anything, just a notice stating that I surrendered my license to him and that it was suspended, can anyone make anything of this?

Here are some more information that i have today which raise some more questions ....

Like i said before i live in TN but the ticket is from VA, Wythe county, 88/65 which is reckless driving there. I called the court today, they informed me that i do not have to appear in person, the judge will take my absent as admittion of guilt and then he will set the fine. I have 15 days after to pay ...

I asked her if i can filed a motion to dismiss due to errors on the citations by mail and she said that i can ... The cop wrote down wrong date of the offense by a month on the citation but according to the the court website, it has correct date on the court information. There are also a couple of errors on the ticket, year of my car, wrong spelling on my last name and middle name, also the address ...

Do you think it will do me any good if i don't show up and just file motion to dismiss thru the mail? Should i also ask for later court date if the judge refuses to dismiss the case?

What are my chances and where can I find a sample of motion to dismiss so i can use it as an example ?

I got a ticket for doing 75 in a 65 zone. I didn't admit it to the cop, but I was actually going a little over the speed limit, about 70 mph. Sped up to go around some old people who were running neck-and-neck in the left two lanes of the three-lane highway. If he'd have put 70 mph instead of 75, I might have just paid it and went on.

Here's the stupid part: I was in my personal vehicle. But when the cop saw that I had a Commercial Driver's License (CDL), he said he was going to accuse me of going 87 mph.

On the Missouri Uniform Traffic Tickets, there is a little box marked "CDL" which is supposed to have a letter code in it. That would be "A" for a tractor-trailer, "B" for a straight truck, or "C" for a license to haul hazardous materials or 16 or more persons. This cop wrote the number "87" in there. He told me that "his judge" knows how he operates (by writing a different speed in the CDL box), and that if I fight this ticket, he's going to get the judge to find me guilty of going 87 mph. He kept making threats against my CDL as well, as a ticket above 15 mph is considered a "serious traffic violation" and if I get another one in three years, my CDL can be suspended for 60 days.

I'm wondering if I shouldn't transfer the case to county, so that the cop won't have "his judge" there, and then show the county judge the how the cop is basically a liar and a trucker-hater, because he's willing to say I was going two different speeds.

Also, the cop pulled me over because I was driving my old rusty work car, rather than my nice one that I use on weekends. This is kind of an uppity, snotty neighborhood where I live.

I wanted to post this here before I go attorney-shopping.

Citation for "unofficial sign" question

Hi:

I have been cited for passing through a split speed hump, which has a double solid line. My citation is violation of CVC 21460 which is driving left of double solid. However, per CVC 440 speed hump is not a official traffic control device. The double solid line is only before and after the speed hump. I found local engineering guideline which shows speed hump should be built with dbl solid line. Speed humps are splitted for emergency vehicles.

My question is: since speed hump is not an official sign in California and solid lines painted for purose of speed hump in order to prevent vehicles from driving through split, can I request dismisal of case on technicality? Any help is appreciated.

careless driving in lowell arkansas

My question involves a careless driving ticket from the State of: Arkansas
On 9-28-09 at 12:16 pm i was driving threw lowell, ar and i was in the inside lane at a stop light

i was the 3rd car back and next to me was a chevy pickup pulling a trailer the light turned green and we went

well there was enough room for me to change lanes into the outside lane with no problems so i did i used my turn singal and moved over

well i speeded up close to the speed limit which was 45 mph and the rig in front of me about 3-4 car lengths was turning right so i turned on my signal and moved into the inside lane pretty fast but didnt cut anyone off

well there was a cop in the turn lane coming at me about 4 car lengths and he saw me do this well after me and about 4-5 other cars went by he turned and pulled a u turn and came after me he cut in and out of traffic without any blue lights he used his turn signal then when i finally caught up to me which was like 2-3 blocks or about 2500 feet he turned on his blue lights and pulled me over

i never was going fast than 45 mph which was the speed limit and he pulled me over because he told me i had cut the cars off when i changed lanes both times and he asked me if i was in a hurry and i said i just want to go home and go to bed thats it then he came back wrote me a ticket for careless/ prohib. driving 27-51-104 and everywhere i looked up online says the ticket will only be 100 bucks but i called up there and they want 185 for it

they didnt say if that was with court cost or not and im going to fight this ticket so honestly did i mess up or is it cause he wanted to write a ticket for his quote and when i asked for my driver license and insurance but never asked for my registration which i had and i got a clean record i pleaed non guilty and i got court on 11-9-09 at 1pm so should i talk to the protector or what should i do?

No records found, now coming back to haunt me!!

I received a ticket back in March 2009. There was no price to be able to just pay off the ticket and everytime I called the phone number on the ticket, there were no records found!! But there was a date on the bottom of the ticket to show up (I thought in court) at the justice center. So I take a day off of work to deal with this speeding violation. After waiting about an hour, like the DMV, I got up to the window to find out there was nothing on record for my speeding violation. They stamped the ticket and initialed it like nothing ever happened. Now 2 days ago I get a certified letter in the mail fromt the DMV saying my license will be revoked in about a month if I don't pay the ticket!! When there was nothing at all on record!! Why is that coming through now and is there any way around this problem, like not having to pay it cause Highway Patrol is worthless and can't put in there info right or on time?!!!!!!!

Incorrect Information on Traffic Ticket

I recently was pulled over for speeding in Maryland. Before I just avoid going to trial and pay the speeding fine, do I have grounds for dismissal if the officer wrote down incorrect information on the traffic ticket (Incorrect last name)? And if so, do I need to take it to trial, or can I avoid that, appear at the district court before the court date and have the charge dropped?

Ive tried to find another post similar to mine, but to no success. Hope to get some helpful responses.

Traffic camera snafu

My 82 year-old father received a traffic offense notice via mail 3 days ago. He's very very upset. Apparently, after checking the notice myself, the sheriff's off of Jefferson parish in Louisiana has made a blaring mistake. This notice has a snapshot of the rear of the offending vehicle with a fairly CLEAR view of not only the license plate number, but alos the make and model of the vehicle and also a clear shot of the trunk having a large spoiler. I can easily see that the mistake is that the first 3 letters of the plate on the offending vehicle is ROT. The notice identifies the vehicle as being RQT, which is my Dad's vehicle. The notice identifies my Dad's vehicle correctly as being a '96 Chevy Malibu,(no spolier) but in the photo, the vehicle is clearly a Mitsubishi Lancer (with the spoiler). Here's the rub. The notice offers 3 choices; pay the fine; get the true offender to pay the fine; or fight the offense in court in person. Dad had a stroke 7 months ago and along with other medical issues, he has been medically suspended from driving since May. He relies on SS for his only income and can't travel 250 miles to defend himself in court due to medical and financial limitations. Besides, it is the sheriff's office mistake. There doesn't seem to be a provision in the notice to address simple mistakes. My dad is now in the hospital with high BP and plummeting weight due to his extreme fear and can't eat. He says he feels like he's being stalked by the government. Even though he realizes the mistake, he still is in extreme fear as he's only had one traffic ticket in his entire life. Obviously, his age has him thinking irrationally but this incident is killing him and I am so angry and frustrated that there doesn't seem to be an easy sollution. If I could make a call and point out to a rep to recheck the photo and insert an "O' instead of the 'Q', this would be solved. Anyway, I've made this plan, to try and meet with our local sheriff in Union parish and see if he will help. I don't expect much help there. If that doesn't pan out, does my Dad have a civil case? Against the parish(county)? Against the sheriff's office? I don't want to sue but doggone it, why should a CLEARY innocent person have to suffer intently when the sollution is so easy? Any adice would gretly appreciated.

Philadelphia Parking Tickets

The other night I did a dumb thing and parked too close to a fire hydrant. I received, in two days, THREE parking tickets. I saw one written for 930 am for one day, another at the same time the next day. I know I made a mistake, and although a little harsh, I feel as if those two tickets are rational. The third I find ridiculous. An officer issued another ticket on the first day 35 minutes after the first one, which was clearly posted on the windshield. Is there any recourse I can take to drop this one? Is there any time period in which they can write another ticket?

Court charging more than state max fine/ ok to talk to DA?

I recived a traffic ticket for violating the GA moveover law, which I say I did not violate. I have no representation as of yet, and since this is a misdemeanor here, judge can sentence me to a year in prison, so I hesitate to submit to the jurisdiction of the court(in State court, not traffic or municipal), I have the following questions;

1. The max penalty according to the statute is $500, however, the court told me if I wanted to pay the ticket and not show up for the hearing at all it would be $730 (they are adding some fines). One attorney told me they could charge $10,000 if they want but that seems unreasonable. Is there no limit as to how much fees the county can tack on if I choose to not fight the ticket?

2. It has been suggested I contact the prosecutor to see if he will work out a deal so it does not go on my record and I don't have to make a court appearance (paying or safe driving school, etc). Can my talking with the DA prejudice my case or hurt me in any way?

Any help appreciated. I am afraid to fight this (at least w/o an attorney) but am looking for work which this could jeopardize.

Stop Sign Approval Sticker

On October 3rd, I was cited a ticket for disregard of a stop sign. I was told a couple of years ago, that the stop sign must have a state approved installation sticker on the sign to be considered government property. For example, a stop sign in a Target parking lot would not require me to stop by law because it is Target's property, not the state's. This particular stop sign I failed to fully stop at has no sticker, as well as the rest of the signs in the small neighborhood. I took a date stamped picture on my cell phone immediately after I was cited.

I hope this is true because I currently am very tight on money, wanted to bring in a picture of the stop sign with no approval sticker, and plead not guilty in court to avoid having to pay another fine.

I have read through the Texas Transportation Code under section 544, but cannot seem to find what im talking about. Is what I heard an urban legend or did I overlook it?

Any help would be very much apreciated.

I would like opinions on if I should fight this ticket or not. Last time I fought a ticket in traffic court I lost, loosing my chance to receive traffic school as well as having my fine doubled. It was a rainy night and I lost traction at an intersection, but I regained control. It was almost like an unexpected drift. The officer cited me for crossing a double yellow line, which was false.. just not possible, and the judge took their side throwing the officer bones in the courtroom. My opinion, in the past, neither here nor there... Anyways

So I only want to fight this ticked if I have a sure chance at winning. I don’t want a repeat of what happened before. I still feel wronged about the past events. Onto the more recent topic and ms paint PICTURE INCLUDED!!

The weather was clear and sunny and time was close to 2pm. I was traveling northbound towards a roundabout (I’m the red car). During my approach to the roundabout I was applying breaks slowing my speed down from the roads limit and was roughly at 15 miles per hour coming from a 35mph zone (officer marked my speed as 20-25mph with a safe speed of 5mph…) coming toward my direction was a small semi-like truck towing a 10-12 foot trailer (purple truck). The truck had his right turn indicator on and when I saw him initiating his turn, toward my direction, I felt there was no longer a need to stop, feeling I could no way impede his right of way and safely enter the roundabout. There was a sheriff on my left, coming from the west, who appeared to be stopped at the yield (the red cut away expedition). I recall looking to my left in the direction of the stopped sheriff SUV when I entered the roundabout and was unable to see his vehicle because it was obstructed by the box trailer the truck was towing. This is also how I made my decision to not come to a stop and continue through the roundabout.

I continued through the roundabout exiting northbound. The sheriff entered the roundabout after the truck and followed me out. The SUV was roughly 25-35 feet behind me upon his exit and turned on his lights. I immediately turned onto the side of the road, rolled down my windows, and turned off my car.

The officer said that I failed to yield for his vehicle. He also said that the car following me almost failed to yield as well, but that car was able to apply his breaks in time. The sheriff said that this other car would have hit him if he hadn’t stopped. His explanation of roundabout laws was a bit sketchy to me saying that as soon as a vehicle enters the roundabout all other vehicles must yield for that vehicle, which I did. I understood that, but the rest sounded like it was meant for one car at a time. From what I understood that officer’s argument is that I entered the roundabout after he did and that he had the right of way because of that. My argument is that I didn’t come to a complete stop and continued through the roundabout because the truck was turning in my direction, and being unable to see any oncoming traffic, making it safe for me to enter.

All opinions are good opinions. Like I said I only want to fight this if I will win. I have a point on my record from my previous loss, and do not want two. If there is a possibility I will loose, I don’t want to chance it. I will also try a trial by declaration first.

tailgating

I have experienced multiple occasions of other drivers tailgating me. I call 911 and am told by dispatch that the police will not do anything unless an officer actually witnesses the tailgating. It can't be a situation were one citizen reports on another. How else can anyone get the other driver charged with an infraction or more. My understanding is that a vehicle can be determined to be a deadly weapon, when there is injury. I was told that I should not even drive after the tailgater to get the license plate number. How can anyone get protection from law enforcement in a case like this. I want this stopped before myself or other passengers are hurt.

No Insurance No License

I was pulled over and given a court citation. I didn't have insurance at the time and I was driving using only my driver's permit (I was due to take the driver's test exactly a week after).

The officer didn't let me show him my permit (it was in my trunk, inside my backpack) and wrote down "License never issued" and refused to take into account my diver's license from Mexico (I was told officers could take that into account while I was in the process of getting my CA license).

He put "Infaction" for all counts and I'm due to appear in court soon.

What should I expect? Do I need a lawyer?

Since I've bought insurance and have a working CA license. Could that affect things in my favor?

Texas traffic tickets

My son was in Gainesville, TX and received about 4 tickets, speeding, didn't have his insurance card and driver license. The total came to about $600. He didn't have the money and called the court to see about sitting the tickets out. They told him he couldn't do that as he didn't live in that county and they sent the tickets to a collection agency? They now have sent a letter to the DPS saying he can't renew his license I have never heard of the courts not letting someone sit tickets out and turning them into a collection agency. What can he do about getting his license?

Can you "follow too close" an unoccupied vehicle?

My husband was traveling down a moving highway, when he glanced away for a second. As soon as he looked up, the car in front of him changed lanes to reveal a tractor trailer parked in the road. He slammed on the brakes, but the car wouldn't stop in time. The officer wrote the citation before getting out of his car to speak with either party involved. After he presented my husband the ticket, my husband pointed out to the officer there were no security cones placed and the driver wasn't in the truck. The truck driver confirmed this. The officer got an "oh crap" look on his face and said he would see them in court. The truck driver received no citation.

So, is that "following too close"?

Ok I am in Williamson County, texas....

I was issues a citation for no Heavy truck parking in the City limits. On Sat the 10 . I drive a Sevice truck that has gross vehicle rating of 26,000. After looking up the city codes anything over 12,000 is Illegal. So with that I live in a subdivision and their is a ford F550 and a dual wheel ford Utlitly van that also parks in our subdivsion. And after looking up vehicle specs I know for a fact that those vehicles are over the 12,000 GVW. But on a another note I had to come home to take my wife to the ER after she fell down the stairs Sat. Morning. I talk to a person at teh Court House and said if I had documents proving it I might beaable to get this dismisses... Ok their is more. My wife can't drive so I have really no way till today to park the truck anywhere to get a ride home. So last night, on Oct 14 at midnight the same officer wrote me two citation with one having three violations on it and the second one only having two?? The first one was for Vehicle parked int eh wrong direction of traffic...(which it was not) , the second violation was commercial vehicle in residential area( which my neighbor accross the streets plumber van was parked their also..he had not citation), and no heavy truck parking . This one was written at 12:17 am

Ok the second citation was written at 12:29 am 12 minutes later for heavy truck parking and Comercial vehicle in residential area. I am looking for any suggestion here.. I feel theri is a little discrimination going on and possible a persoanal attack on my truck for not moving it the first time. NO officer has discussed thsi with me or even talk to me about any of this.. The other thing is that their was a warning supposedly for this sometime in July but I never recieved anything.. Also these two citation I got last night only one was left on my door?? Needing some help here..Email me if anyone local can help..

15 over in a 35 MPH zone...Statute 3362

Hello everyone, hope all is well. I am in Pennsylvania.

The other week I was driving home from school. Got signaled to pull over when the officer was in the middle of the road. I was doing 50 in a 35, and the officer was using a mobil speed device. To make a long story short, on the road, the speed limit signs are sporadic and some are almost invisible until you are within 30 ft of them because they are covered with growth.

I have the 75 PA.C.S. code book infront of me, for 2008, and it states:

No maximum speed limit established shall be effective unless posted on fixed official traffic control devices...and require posting at the beginning and at the end of the speed zone, AND AT INTERVALS NOT GREATER THAN ONE-HALF MILE.

The area I got signaled to pull over has their speed limit signs are 1.3 miles apart, instead of the 0.5 mile increments that the statute requires.

So, I have a court date. What do you think about my defense?

Officer filled out trafic ticket incorrectly

I was stopped for speeding. When giving me the ticket the officer informed me that I was driving 11 miles over the limit, going 51 mph in a 40mph zone, and wrote up the ticket as such. Later on while driving down the same road, I noticed that it was not a 40 mph zone but rather a 45 mph per the posted speed limit signs. Additionally, the the speed limit sign I had passed just before he stopped me was obstructed by a tree branch to the degree to where you would not see it clearly until you were practically right on it, and then only by taking your eyes off the road because you would have to turn your neck 45 degrees to look to the side.

Do I have a good enough basis because of these two elements to fight the ticket in court?

Multiple HOV tickets

I recently received 3rd offense HOV ticket while awaiting the court date on a 2nd HOV offense. In the case of the 2nd offense, I was given an HOV ticket for taking an exit ramp that I was forced onto due to construction. My 3rd offense was due to trying to pass a vehicle and when I realized I was in the HOV lane, I shot back over to the right. A state trooper saw me do this as he was sitting about 100 yds up the road. Although I was in the lane less than 20 seconds and didn't pass his spot while in the HOV lane, he still pulled out came over in the right lane and pulled me over after I went by him. My first question is whether I can fight these two tickets at all. My 2nd question is whether the judge will hold the 3rd offense over my head if I go to court to fight 2nd offense. Aren't I innocent until proven guilty and hence able to fight the 2nd offense (with an earlier court date) without having the judged swayed by the 3rd offense whose court date is a month later?) For the record, I paid my first offense out of court (and that too was for taking an HOV marked ramp that I thought was a normal exit). I lived in a highly congested area of Northern VA for less than 2 yrs and I didnt even know these ramps were HOV. But now I don't know whether I can fight these straight up, or if I should get an attorney. The total fines come to $750 and 6 points if I pay out of court or if I'm found guilty. I didn't think I was guilty for the first, and I definitely want to fight these other two. Can a lawyer do anything for me here? Or, are my efforts completely futile?

2 out of 3 of these tickets were on ramps that I was unaware were HOV. I paid the first simply out of convenience and b/c I couldn't take off work to attend the court date. The 2nd and 3rd are agregious fines for tickets I don't deserve at all. I'm not even sure the cop has the right to ticket me for HOV if I honestly realized I was in the HOV lane, and moved out WELL before I approached the spot where he was sitting.

Help please!

Speeding ticket without use of radar

A couple weeks ago, I was pulled over in Maryland on I-95. I was driving side by side with a police officer on an empty highway about 9:30pm on a Sunday night. Knowing it would be a bad idea to pass the officer, I tried not to. On a left curve on the highway, I inched pass the officer because I was in the inside lane. After my full car had completely passed the officer, she pulls me over. She "claimed" that she was going 65 in a 55 and I passed her (which I believe was totally bogus because I had my cruise control set below that). She writes me up for 70 in a 55, which is even more bogus because I couldn't have been going more than 1mph greater than her speed. My actual speed was 63mph, but I was ticketed for going 70.

My options are to plead guilty, and the judge will give me probation before judgement and take away any points (I have a squeaky clean driving record), or plead innocent and tell the story I just told you. Any suggestions?
