The reason why the tag was expired was that my car didn&amp;#39;t have insurance at the time and was thus suspended.&amp;nbsp;&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;Cue sob story: I hadn&amp;#39;t renewed the insurance because the magazine I work for has been laying people off and only paying freelancers (me) in restaurant trade. I honestly didn&amp;#39;t have the money to pay for insurance, so I hadn&amp;#39;t been driving my car. The only reason why I was driving that night is that I was going to use the restaurant trade to take my girlfriend out to dinner &amp;ndash; she was flying to France to live there and teach English for a year. It was a goodbye dinner, so I thought we&amp;#39;d take my car. Big mistake. I was pulled over and cited for having an expired tag (infraction) and &amp;quot;driving without a license&amp;quot; (even though I had a valid MI license, it&amp;#39;s a misdemeanor). The cop didn&amp;#39;t say anything about the insurance and let me go without impounding my car or taking me to jail.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;Since then, I&amp;#39;ve gotten both a CA driver&amp;#39;s license and insurance and re-registered my car. The best possible scenario for my court date (this Thursday) is if the police officer doesn&amp;#39;t show up. I don&amp;#39;t know how likely that is, so I was wondering what would be best strategy for the courtroom. Do I give the judge the full sob story? Do I just say that I&amp;#39;ve corrected both of the problems and that I would prefer community service? I have 15 days after to pay ...&amp;nbsp;&lt;/p&gt;  &lt;p&gt;I asked her if i can filed a motion to dismiss due to errors on the citations by mail and she said that i can ... The cop wrote down wrong date of the offense by a month on the citation but according to the the court website, it has correct date on the court information. &amp;nbsp;There are also a couple of errors on the ticket, year of my car, wrong spelling on my last name and middle name, also the address ...&amp;nbsp;&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;Do you think it will do me any good if i don&amp;#39;t show up and just file motion to dismiss thru the mail? My citation is violation of CVC 21460 which is driving left of double solid. However, per CVC 440 speed hump is&amp;nbsp; not&amp;nbsp; a official&amp;nbsp;traffic control device. The double solid line is only before and after the speed hump. I found local engineering guideline which shows speed hump should be built with dbl solid line. Speed humps are splitted for emergency vehicles.&lt;/p&gt;  &lt;p&gt;My question is: since speed hump is not an official sign in California and solid lines painted for purose of speed hump in order to prevent vehicles from driving through split, can I request dismisal of case on technicality?&amp;nbsp;Any help is appreciated.&lt;/p&gt;  &lt;p&gt;well i speeded up close to the speed limit which was 45 mph and the rig in front of me about 3-4 car lengths was turning right so i turned on my signal and moved into the inside lane pretty fast but didnt cut anyone off &lt;/p&gt;  &lt;p&gt;well there was a cop in the turn lane coming at me about 4 car lengths and he saw me do this well after me and about 4-5 other cars went by he turned and pulled a u turn and came after me he cut in and out of traffic without any blue lights he used his turn signal then when i finally caught up to me which was like 2-3 blocks or about 2500 feet he turned on his blue lights and pulled me over &lt;/p&gt;  &lt;p&gt;i never was going fast than 45 mph which was the speed limit and he pulled me over because he told me i had cut the cars off when i changed lanes both times and he asked me if i was in a hurry and i said i just want to go home and go to bed thats it then he came back wrote me a ticket for careless/ prohib. driving 27-51-104 and everywhere i looked up online says the ticket will only be 100 bucks but i called up there and they want 185 for it &lt;/p&gt; There was no price to be able to just pay off the ticket and everytime I called the phone number on the ticket, there were no records found!!&amp;nbsp; But there was a date on the bottom of the ticket to show up (I thought in court) at the justice center.&amp;nbsp; So I take a day off of work to deal with this speeding violation.&amp;nbsp; After waiting about an hour, like the DMV, I got up to the window to find out there was nothing on record for my speeding violation.&amp;nbsp; They stamped the ticket and initialed it like nothing ever happened.&amp;nbsp; Now 2 days ago I get a certified letter in the mail fromt the DMV saying my license will be revoked in about a month if I don&amp;#39;t pay the ticket!!&amp;nbsp; He&amp;#39;s very very upset. Apparently, after checking the notice myself, the sheriff&amp;#39;s off of Jefferson parish in Louisiana has made a blaring mistake. This notice has a snapshot of the rear of the offending vehicle with a fairly CLEAR view of not only the license plate number, but alos the make and model of the vehicle and also a clear shot of the trunk having a large spoiler. I can easily see that the mistake is that the first 3 letters of the plate on the offending vehicle is ROT. The notice identifies the vehicle as being RQT, which is my Dad&amp;#39;s vehicle. The notice identifies my Dad&amp;#39;s vehicle correctly as being a &amp;#39;96 Chevy Malibu,(no spolier)&amp;nbsp;but in the photo, the vehicle is clearly a Mitsubishi Lancer (with the spoiler). Here&amp;#39;s the rub. The notice offers 3 choices; pay the fine; get the true offender to pay the fine; or fight the offense in court in person. Dad had a stroke 7 months ago and along with other medical issues, he has been medically suspended from driving since May. He relies on SS for his only income and can&amp;#39;t travel 250 miles to defend himself in court due to medical and financial limitations. Besides, it is the sheriff&amp;#39;s office mistake. There doesn&amp;#39;t seem to be a provision in the notice to address simple mistakes. My dad is now in the hospital with high BP and plummeting weight due to his extreme fear and can&amp;#39;t eat. During my  approach to the roundabout I was applying breaks slowing my speed down from the  roads limit and was roughly at 15 miles per hour coming from a 35mph zone  (officer marked my speed as 20-25mph with a safe speed of 5mph&amp;hellip;) coming toward  my direction was a small semi-like truck towing a 10-12 foot trailer (purple truck).  The truck had his right turn indicator on and when I saw him initiating his  turn, toward my direction, I felt there was no longer a need to stop, feeling I  could no way impede his right of way and safely enter the roundabout. There was  a sheriff on my left, coming from the west, who appeared to be stopped at the  yield (the red cut away expedition). I recall looking to my left in the  direction of the stopped sheriff SUV when I entered the roundabout and was  unable to see his vehicle because it was obstructed by the box trailer the  truck was towing. His explanation of roundabout laws was  a bit sketchy to me saying that as soon as a vehicle enters the roundabout all  other vehicles must yield for that vehicle, which I did. I understood that, but  the rest sounded like it was meant for one car at a time. From what I  understood that officer&amp;rsquo;s argument is that I entered the roundabout after he  did and that he had the right of way because of that. My argument is that I  didn&amp;rsquo;t come to a complete stop and continued through the roundabout because the  truck was turning in my direction, and being unable to see any oncoming  traffic, making it safe for me to enter.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;All opinions are good opinions. So with that I live in a subdivision and their is a ford F550 and a dual wheel ford Utlitly van that also parks in our subdivsion. And after looking up vehicle specs I know for a fact that those vehicles are over the 12,000 GVW. But on a another note I had to come home to take my wife to the ER after she fell down the stairs Sat. Morning. I talk to a person at teh Court House and said if I had documents proving it I might beaable to get this dismisses... Ok their is more. My wife can&amp;#39;t drive so I have really no way till today to park the truck anywhere to get a ride home. To make a long story short, on the road, the speed limit signs are sporadic and some are almost invisible until you are within 30 ft of them because they are covered with growth.&lt;/p&gt;  &lt;p&gt;I have the 75 PA.C.S. code book infront of me, for 2008, and it states:&lt;/p&gt;  &lt;p&gt;No maximum speed limit established shall be effective unless posted on fixed official traffic control devices...and require posting at the beginning and at the end of the speed zone, AND AT INTERVALS NOT GREATER THAN ONE-HALF MILE.&lt;/p&gt;  &lt;p&gt;The area I got signaled to pull over has their speed limit signs are 1.3 miles apart, instead of the 0.5 mile increments that the statute requires. &lt;/p&gt;  &lt;p&gt;So, I have a court date. In the case of the 2nd offense, I was given an HOV ticket for taking an exit ramp that I was forced onto due to construction. My 3rd offense was due to trying to pass a vehicle and when I realized I was in the HOV lane, I shot back over to the right. A state trooper saw me do this as he was sitting about 100 yds up the road. Although I was in the lane less than 20 seconds and didn&amp;#39;t pass his spot while in the HOV lane, he still pulled out came over in the right lane and pulled me over after I went by him. My first question is whether I can fight these two tickets at all. My 2nd question is whether the judge will hold the 3rd offense over my head if I go to court to fight 2nd offense. Aren&amp;#39;t I innocent until proven guilty and hence able to fight the 2nd offense (with an earlier court date) without having the judged swayed by the 3rd offense whose court date is a month later?) For the record, I paid my first offense out of court (and that too was for taking an HOV marked ramp that I thought was a normal exit). I lived in a highly congested area of Northern VA for less than 2 yrs and I didnt even know these ramps were HOV. But now I don&amp;#39;t know whether I can fight these straight up, or if I should get an attorney. The total fines come to $750 and 6 points if I pay out of court or if I&amp;#39;m found guilty. I didn&amp;#39;t think I was guilty for the first, and I definitely want to fight these other two. Can a lawyer do anything for me here? I paid the first simply out of convenience and b/c I couldn&amp;#39;t take off work to attend the court date. The 2nd and 3rd are agregious fines for tickets I don&amp;#39;t deserve at all. I&amp;#39;m not even sure the cop has the right to ticket me for HOV if I honestly realized I was in the HOV lane, and moved out WELL before I approached the spot where he was sitting. &lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;Help please!&lt;/p&gt;&lt;div style="clear:both;"&gt;&lt;/div&gt;</description></item><item><title>Speeding ticket without use of radar</title><link>http://community.lawyers.com/forums/thread/424049.aspx</link><pubDate>Thu, 01 Oct 2009 00:01:12 GMT</pubDate><guid isPermaLink="false">cbeb030d-bab6-4a2c-9831-ca1feaac8ba9:424049</guid><dc:creator>fdegrano</dc:creator><slash:comments>4</slash:comments><comments>http://community.lawyers.com/forums/thread/424049.aspx</comments><wfw:commentRss>http://community.lawyers.com/forums/commentrss.aspx?SectionID=44&amp;PostID=424049</wfw:commentRss><description>&lt;p&gt;A couple weeks ago, I was pulled over in Maryland on I-95.&amp;nbsp; I was driving side by side with a police officer on an empty highway about 9:30pm on a Sunday night.&amp;nbsp; Knowing it would be a bad idea to pass the officer, I tried not to.&amp;nbsp; On a left curve on the highway, I inched pass the officer because I was in the inside lane.&amp;nbsp; After my full car had completely passed the officer, she pulls me over.&amp;nbsp; She &amp;quot;claimed&amp;quot; that she was going 65 in a 55 and I passed her (which I believe was totally bogus because I had my cruise control set below that).&amp;nbsp; She writes me up for 70 in a 55, which is even more bogus because I couldn&amp;#39;t have been going more than 1mph greater than her speed.&amp;nbsp; My actual speed was 63mph, but I was ticketed for going 70.&lt;/p&gt;  &lt;p&gt;My options are to plead guilty, and the judge will give me probation before judgement and take away any points (I have a squeaky clean driving record), or plead innocent and tell the story I just told you.&amp;nbsp; Any suggestions?&lt;/p&gt;&lt;div style="clear:both;"&gt;&lt;/div&gt;</description></item></channel></rss>
