I settled in 2005 and in 2007 the fund was approved and settled also. I moved to another state after my settlement. Last month I called MSPRC seeking help with the OMFS fee schedule. I was told they couldn&amp;#39;t help and I was to call my attorney. Called my attorney and they didn&amp;#39;t have a clue what I was talking about. I was referred to the company which prepared the submission of papers to Medicare. I called them and they said they could not help me, as I was never their client. Odd statement, since their fees came from my settlement.  &lt;/p&gt;  &lt;p&gt;So I called MSPRC back and tried to follow up. They said that they could not help nor would they direct me to some place that could. Then, I was told they never&amp;nbsp;received a copy of my C&amp;amp;R for the future medical. I located one and faxed it to them. Two weeks later I received a &amp;#39;Determination: Request for Refund&amp;quot; letter from MSPRC. I was able to refute each item, using the Diagnosis/ICD codes they provided. So, I replied with a request for a appeal and a waiver. I just couldn&amp;#39;t send all that money to them, when their own documentation proved them to be in error. &lt;/p&gt;  &lt;p&gt;Will this kind of event happen on a regular basis? Has the delay in sending the papers in, changed any of the terms of the agreement? Do they have to accept it, even if it&amp;rsquo;s two years late? &lt;/p&gt;  &lt;p&gt;I was able to get someone to answer my one billing question. Now I realize how little I know about the way I should administer the fund. I am now being told I need additional surgeries done on my spine. I asked for a pre-operation billing statement from the providers, so I could have an idea of how much the fund will cover. &lt;/p&gt;  &lt;p&gt;I am unable to adjust the out-patient-surgery-ce... costs, as the fee schedule is not clear on specific amount for services. After several days, I have found next to nothing in the way of help. Is there any type of class or training which can educate me on how to manage the fund? Is there any type of help out there, when it comes to administering this type of fund? &lt;/p&gt;  &lt;p&gt;I am finding out that my fund may cover 30% +/- of the estimated costs, leaving about $12K for me to cover. Is there any assistance available to help cover the amount left after subtracting the OMFS amount? &lt;/p&gt;  &lt;p&gt;Is there something I missed in all of this? As my doctor doesn&amp;#39;t accept the OMFS as full payment. I have seen some debate over this issue and believe the doctor can accept or not whatever they want as full payment. &lt;/p&gt;  &lt;p&gt;One thing that stands clear is that the future medical settlement is short of it should have been. All my doctors I have seen have told me I need a total knee replacement. Anyhow after seeing the QME he has concluded that this is an industrial injury, there may be an apportionment factor due to the fact I had an injury as a teenager which never required any treatment. He stated that my sudden onset of problems (pain, difficulty walking, difficulty sleeping and driving due to severe pain in my knee that travels into my ankle and hip).are all industrial.&lt;/p&gt;  &lt;p&gt;Anyhow once he has determined it is industrial when can I seek treatment? I need to see a ortho MD and have asked the claim adjuster for an auth to see a Dr. of my choice and they are putting me off.&lt;/p&gt;  &lt;p&gt;Last year I also had 2 claims that were 100% work related and I was told I had an 8% total body disability. So far I have handled everything on my own without legal assistance but I think I&amp;#39;ll probobly need to get a lawyer sometime soon as we have not settled. I am back at work from my injuries last year and am having alot of pain and difficulties performing due to my latest injury and my employer, I believe is trying to find reasons to get rid of me.i really need the auth to see a Dr. soon so I can keep my job and medical insurance. Can a employer make you pay cobra premioums when out on a work comp injury? After 1 year as overnight stocker I suffered a back injury which aggravated several pre-existing problems(2 crushed vertabrae,degenerative bone and disk disease,Scheuermann&amp;#39;s disease,severe arthritis,etc.).The diagnosis was mid-back sprain/strain,for which I was treated with drugs, therapy, accu-puncture,decompre... to no avail.&lt;/p&gt;  &lt;p&gt;When stable and stationary doc. put 3 permanent restrictions on me that wal mart must comply with for ever,theoretically.1-no prolonged standing or sitting,2-no bending or lifting of anything over 10 lbs,and 3-must rotate my activities every 2 hours,which the doctor said could be interpreted as I be allowed to sit for 2 hours, every 2 hours,as needed,and later added with lumbar support as sitting for any length of time causes great pain in no time also.&lt;/p&gt;  &lt;p&gt;After several months of initial treatments that did&amp;#39;nt improve my pain at all,the doc. released me from sitting only-people greeter position to go to work in any position in the store except stocking of course,with limitations that increased bit by bit over time.iI was put in sporting goods dept.where my duties were cust service behind the counter,cash register, selling hunting/fishing licenses,customer service,etc,with only minimal stocking now and then very light items,etc.&lt;/p&gt;  &lt;p&gt;For the next 4 years I came to be known by hundreds of regular customers throughout the store as the person to go to for any kind of help or information on anything anyone needed anywhere,by associates as the one who was always willing to help with training issues,fillinf in for people,literally anything anyone needed for whatever,any time.My dept. mgr. always said upper managment was happy with my work,as was he,my evaluations were always at least &amp;quot;meets expectations&amp;quot; on all points,was never reprimanded for any issues,of course not perfect,but was a very good associate,as I always tried to make up for my physical limitations in other areas.&lt;/p&gt;  &lt;p&gt;[The store]&amp;nbsp;made the necessary&amp;quot;reasonable accomodations&amp;quot;,with only a few discrepencies in interpretation of limitations (like sitting issue a few times,but resolved shortly thereafter),and it seemed things were good to go for the most part.Then one day was called into mgr&amp;#39;s. office and informed due to word from corp. office on hour cut backs,that although I had seniority in my dept.,because of my limitations for my back,I was the person in sporting goods whos hours were going to be cut,and only me.The cuts were only 4-6 hours less a week every 3 weeks,so as I was still full time,I did&amp;#39;nt stress it much.&lt;/p&gt;  &lt;p&gt;Then in June was called into mgr&amp;#39;s. offfice again and this time i was told that they&amp;#39;d received a new report from my doctor with revised limitations all of a sudden that made it where I no longer met the minimum requirments for working in my dept. or any where else for that matter,other than a position as a people greeter,P/T of 20 hours a week, and with a reduction in my hourly wage.When I asked doc. of this he said&amp;nbsp;[the store]&amp;nbsp;solicited report and told him what they&amp;nbsp;wanted in report,then told me it was out of the blue from the doc.and i had 1 week to decide whether or not I wanted their job offer or not.No one would give me any info on what assisstance I might be entitled toSDI,SSI,unemployment... applied for unemployment,food stamps,and thru the doc,whom I&amp;#39;m sure felt bad but couldn&amp;#39;t admit certain things to me,he and I filled out and submitted SDI papers to make up the difference in my income,which has since been approved,as was unemployment initially,but interview date hasn&amp;#39;t even arrived yet,so I&amp;#39;m on SDI &lt;/p&gt;  &lt;p&gt;To make up diff.,but i wonder if I can get unemployment til it runs out,maybe I should do that instead of using up available SDI as dont knoe if when it runs out,if unemployment will still be avail.Also dont know if i must report SDI income on taxes and pay withholding on that or not.There have been several other issues arise concerning this whole mess but this is more than long enough as is.Can anyone offer me any advice on any thing I&amp;#39;ve mentioned or anything I havent and where can i find a lawyer to represent me in this?&lt;/p&gt;  &lt;p&gt;Briefly about me: I work for a large company (300K employees) as a Finance Program Manager.&amp;nbsp; My daily job function includes 90% of computer related work and keyboarding.&amp;nbsp; I have been with this company for 9 years and have never filed a WC claim.&amp;nbsp;&amp;nbsp;I am a 44 yo Female. &lt;/p&gt;  &lt;p&gt;I have been experiencing pain, numbness, spasms in my right side upper extremeties (neck, shoulder, hand) for the past 1 1/2 years.&amp;nbsp; In light of the&amp;nbsp;economy and ongoing lay-offs in the company I work for, I&amp;nbsp;opted to treat my pain through pain medications so I could&amp;nbsp;continue to work&amp;nbsp;and not jeopardize my employment status.&amp;nbsp;&amp;nbsp; &lt;/p&gt;  &lt;p&gt;Last month I filed a WC claim after initial diagnosis from a&amp;nbsp;Neurologist&amp;amp;nbs... Soft Tissue Syndrome due to overuse with likely nerve damage issues in my right side.&amp;nbsp;&amp;nbsp; I am in the &amp;quot;90-day delay&amp;quot; period in the WC process.&amp;nbsp; The WC company sent me to Kaiser Occupational Therapy who examined me and declared I likely had MS or some other neurological disorder unrelated to work.&amp;nbsp; The WC adjusted told me to go back to the Neurologist for another exam to rule out MS, which I did via a&amp;nbsp;Brain MRI paid for via my health insurance plan through HP.&amp;nbsp;&amp;nbsp;No MS, again another diagnosis of&amp;nbsp;Soft Tissue Injury due to&amp;nbsp;overuse.&amp;nbsp; &lt;/p&gt;  &lt;p&gt;The WC adjuster has now directed me to get an EMG through my private pay insurance.&amp;nbsp; I have no issue with this request, however, I am unclear on how it plays into the decision on if this claim will get approved or denied.&amp;nbsp; In the meantime, the WC adjuster did approve 3 physical therapy sessions and more pain meds.&lt;/p&gt;  &lt;p&gt;The PT has told me that in order to determine if my injuries will ever heal, I am going to have to stop working for a while.&amp;nbsp; I assume this means going on TD via WC or STD through my employers disability plan.&lt;/p&gt;  &lt;p&gt;I understand you can&amp;#39;t direct me on the path I choose, but at this point, (Question) would it be in my best interest to obtain an attorney who can send me to a Doctor who can put me off work or should I wait for the official response from the WC adjuster on if they are going to deny or approve my claim?&amp;nbsp;&lt;/p&gt;  &lt;p&gt;I suspect the claim will be denied based on some of the adjuster&amp;#39;s comments that I waited too long to turn this in as a claim and have passed the statute of limitations of 1 year. After 2 days on the job my condition started to go downhill rapidly to the point I quit my job on the 6th day because I thought I might end up in the hospital. I spent the next 6 days in bed in pain. That week I received a letter from workers comp stating my disability payment had stopped because I had returned to work and my claims adjuster said she agreed with the doc findings at that time for me to return to work and it was to early to determine if I was P&amp;amp;S but she would have all the info by Sept 15th to make that determination. I made it to my next appt. and I told the doc what happened and that I had quit. I made sure he documented I had reinjured my foot and was now having other physical problems due to my injury. He sent me for a blood test and put my work status as able to do regular work. He wanted to see me in 2wks. I returned to get my results and he said that my level of rheumatoid arthritis was high, 76 he said normal was 14. He wanted me to see my primary doc for the testing but I told him I was not insured anymore since I quit. He said he was going to see if workers comp would approve a referral to a specialist. He said he wanted to see me in 4wks. He changed my work status report to totally disabled pending rheumatoid testing. I returned in a month and told him my condition was the same as before. He said hadn&amp;#39;t received a response yet. He said he was going to try again. He left my work status as totally disabled, pending testing. My next appt is in a mo. the day after workers comp is supposed to make their determination for P&amp;amp;S. I don&amp;#39;t expect workers comp to approve the specialist seeing how there was no response after a month. &lt;/p&gt;  &lt;p&gt;Will this stop my claims adjuster from making a determination on my case? &lt;/p&gt;  &lt;p&gt;Can I request a QME to decide my case at anytime or do I have to wait for the claims adjuster to make her determination on P&amp;amp;S?&amp;nbsp;&amp;nbsp; &lt;/p&gt;  &lt;p&gt;I have&amp;#39;nt had an income since mid June. The jobs I did&amp;nbsp;were completed satisfactorily according to both the States of Florida and California&amp;nbsp;WC Case Managers. &lt;/p&gt;  &lt;p&gt;The WC&amp;nbsp;Case Managers are &amp;nbsp;who do the authorization to&amp;nbsp;perform &amp;nbsp;the work&amp;nbsp;and also for the&amp;nbsp;approval of payment on&amp;nbsp;the completed&amp;nbsp;work. The Prime Contractor is the one who pays the person who does the work. The Prime Contractor has not paid me and it has been 90 days. Workers Compensation Offices tells me the Prime did get paid for the jobs. The Prime tells me over and over again, and I quote, &amp;quot;don&amp;#39;t worry you&amp;#39;ll probably get paid someday&amp;quot;&lt;/p&gt;  &lt;p&gt;What I have tried so far came back to me this way:&lt;/p&gt;  &lt;p&gt;&amp;nbsp;1). The California&amp;nbsp;Labor Board was told by the Prime Contractor I was an independent contractor and&amp;nbsp;not under the authority of State Labor Board regulations. Therefore, no such wage claim is valid.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;2).&amp;nbsp;The Small Claims Court attempted to serve papers to the Prime Contractor but the Prime Contractor&amp;#39;s&amp;nbsp;address listed at the Secretary of State Business Portal for Corporations is invalid. Therefore, the Secretary of State may look into&amp;nbsp;an incorrect address,&amp;nbsp;but not too soon in the future so Small Claims is out.&lt;/p&gt;  &lt;p&gt;3). I went to the Police Department in the city in which&amp;nbsp;the Prime Contractor&amp;nbsp;claims to have an office&amp;nbsp;in and was told &amp;quot;no crime has been committed&amp;quot; so nothing the Police&amp;nbsp;could do.&lt;/p&gt;  &lt;p&gt;All agencies have tried to be helpful, and Workers Comp Managers are not concerned if the worker who performed the work&amp;nbsp;gets paid, and probably its not their job to know who&amp;nbsp;gets a check. &amp;nbsp;As long as&amp;nbsp;WC Case Managers pay the designated person to receive payment for work completed I guess WC don&amp;#39;t care.&lt;/p&gt;  &lt;p&gt;Since these jobs I did were at a cost of $55.00 to $333.50 I felt that although I am an unlicensed contractor since the jobs were under the $500 threshold requiring licensing I would be OK if in fact I was deemed an independent contractor and not an employee. I was paid hourly. I was walking across the concrete without knowing the powder went everywhere. After discussing with Doctor that spouse would probably come up on Military Orders to move, Doctor was hesitant to do surgery unless I was stable in one place for at least 6 months, Doctor opted to further restrict my duties which then lead to my employer putting me on Temp Disablity until next Specialist visit which will be 6/19 (one month from the last visit). My question is what should I do in regards to handling this since &amp;nbsp;I will be moving from Ca to Wa state? The surgery has to be done but the move will occur by the end of this month. How does it work with me being in another state? I am tired of being painful and would just like to be done already , it has been since mid-Feb. that the injury occured. Do I need to hire a lawyer? This leave of abscence is only for 30 days and was told I would have to pay my medical insurance after the 30 days....Isnt the company supposed to pay for the medical copays until workers comp is approved?&lt;/p&gt;  &lt;p&gt;I asked them why and they said its the policy. He often sneezes&amp;nbsp;openly without covering himself when there are people very close by.&amp;nbsp; My sister has been using lysol in the office to protect her work area.&amp;nbsp; Last week&amp;nbsp;she used the lysol (never when&amp;nbsp;the coworker is in the room)&amp;nbsp;When he came back into the office, he asked to speak with her in private in another room.&amp;nbsp; This coworker was holding up a ruler in his hand between them (he had never gone anywhere with it in his hand before this), and spoke to her in a threatening tone, &amp;quot;if you don&amp;#39;t stop spraying, I&amp;#39;m going to make a big stink about it!&amp;quot;&amp;nbsp; My sister felt very much harrassed and threatened.&amp;nbsp; She reported the incident to HR.&amp;nbsp; My question is what should she do if HR does nothing to help her? I had 3 surgeries last year all accepted by WC. I have returned to work and I&amp;#39;m pretty much able to preform all my duties. I do suffer from alot of weakness/numbness with my hand and elbow. ( both surgery sites)also I still get alot of aching in surgical areas. Dr. said injurys 100% work related&amp;nbsp; &amp;quot;apportionment is not an issue in this case&amp;quot;&lt;/p&gt;  &lt;p&gt;The impairment rating on both surgical areas came out to 0%. What does that mean. I would think that weakness and numbness would be considered a disability.&lt;/p&gt;  &lt;p&gt;I do not have an attorney.I never felt the need because WC always helped me when I needed anything.
