Now the doc has released me with a rating. The workers comp insurance company called me to ask if my address was still the same because they wanted to send me out some papers to sign so they could get the NC comm to approve payment. Well I knew and they knew they had the correct address because they paid me for mileage. But I did call them to give them my address and answer a few other questions. Well this was over 2 months ago now and have heard nothing back, nor have I got any papers in the mail. &lt;/p&gt;  &lt;p&gt;Now I have heard the NC has passed a new law for WC so that companies will have to pay 10% less starting next year. Are they waiting until next year so they will have to pay me less ? Do I need to get a lawyer ? Now I would like to switch back to OWCP due to a death in the family and financial reasons.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;I read on a website that I would be eligible for retroactive pay from OWCP for the difference in pay between OPM and OWCP for the 2 years that I have been with OPM. Is this accurate?&amp;nbsp; &lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;If so, does the retroactive date (when I switched to OPM 2 years ago) go on the &amp;quot;election date&amp;quot; line on Form CA-1105? It wasn&amp;#39;t evident until the following week that I was in pain, and didn&amp;#39;t even at first tie the fall and pain together. One manager is a friend of mine, and she knew what happened. I was filling out the paperwork and she, in an&amp;nbsp;unmistakeable way told me she wouldn&amp;#39;t fill it out if she were me. The doctor I saw (we work in a medical clinic) went to&amp;nbsp;my lead and a manager saying I needed 4-6 weeks off. They were quite disturbed and their response was quite underwhelming. I said to all of them,,,&amp;quot;forget it, I&amp;#39;ll work,&amp;nbsp; I&amp;#39;ll wear a boot (cast like) and just get through it. I&amp;#39;ll use my own insurance.&amp;quot; I have no experience with workers comp. I was told by the 1st doc&amp;nbsp;the pain&amp;nbsp;was most likely a stress fracture or maybe&amp;nbsp;arthritis. So it was difficult to say for sure that what I had&amp;nbsp;was&amp;nbsp;an on the job injury at that point. I just wanted to do things the easy way and keep work happy.&lt;/p&gt;  &lt;p&gt;Now 14 months and 4doctors later I finally get a true diagnosis after an mri and bone scan. Clearly it was an&amp;nbsp;injury from the trauma and I will need surgery to repair a ruptured tendon, and I have a fracture that hasn&amp;#39;t healed as well as some other problem with the facia in my arch that needs surgery to repair. &lt;/p&gt;  &lt;p&gt;I just filed the claim because I just got a proper diagnosis. I&amp;#39;ve been told that foot problems can be slow to diagnose. That and the first two doctors I went to left their practice shortly after my first couple appt, and&amp;nbsp;the third doc wanted to&amp;nbsp;go right to surgery. Finally I have a doctor that has a plan and is very respected in his specialty. He said absolutley it happened on the job. The fact that I had a fall at the job has always been very well documented in my medical chart, as well as my supervisor and a manager clearly knew what happened. Ive been told now from HR that because&amp;nbsp;It&amp;#39;s been over a year&amp;nbsp; the claim will be submitted (my company is self insured) but it may not be allowed or covered. Too much time since the injury to be reporting it now. &lt;/p&gt;  &lt;p&gt;Is there any way around this if my company won&amp;#39;t cover the claim?&amp;nbsp;&amp;nbsp;I would think that the manager would have known better than to allow this to go un reported. How would I know the proper way things should be done? It was never a secret that I had a fall. And&amp;nbsp;it&amp;#39;s stated all over my medical chart too that I fell at work.&amp;nbsp;Also the diagnosis was certainly slow in coming. Is there really a chance it could be denied? It is clear at this point that I am PPD and my DR. is about to label me as such. I have a&amp;nbsp;pending section 32 settlement agreement that I am second guessing. NYSIF offered 5 1/2 yrs at my current rate of 129.50&amp;nbsp;for a total of 38k. Doesn&amp;#39;t this seem low? Its a lot less than we offered but my lawyer seems really&amp;nbsp;eager to settle for what they offered. He will get 6K of that. Would I get more money if labeled PPD... since I was hurt prior to 2007? Wouldn&amp;#39;t they offer my current rate for a lot longer than 5 1/2 yrs since I am only 30? Should I retract the section 32 and opt for pmnts instead? I hate going for that IME every year. Their Dr. never agrees with mine. The only medical care I receive now are reg check ups, occasional chiropractor visits when I hurt bad, and 1 med. Help me please???!!!! It has a ball of nerves at the end and is extremely painful. I have also been diagnoised with carple tunnel. He said that has developed due to compusating for not being able to use my finger due to the pain. BWC is sending me in front of the Industrial Commission for the second time. I wouldn&amp;#39;t even be hurt had I not been told by my suppervisor and trained to go against OSHA standards.&amp;nbsp; I kept shutting the line down to fix it, I was threatened with being demotted. I am throughly fed up with being in pain and all the aggrivation brought on by BWC and former employer. I am in school, this is affecting every aspect of my life and has since Feb. 20 2007 I live in Ohio, I was told origianally, laws&amp;nbsp;are written to protect big companies.&amp;nbsp;&amp;nbsp;... this is silly i&amp;#39;m in terrible&amp;nbsp;pain and can barely use my right hand any more for doing my job and trying to provide for my family?&amp;nbsp; Would I have a case for pain and suffering?&amp;nbsp; I really don&amp;#39;t see why big companies can&amp;nbsp;openly abuse employees then let BWC toy with them for years while they suffer.&amp;nbsp; I&amp;#39;m in&amp;nbsp;culinary school,this is holding me back. This process took nearly 3 months of pain, at one point they needed to get more information, which confirmed the need for the operation. Between the MRI and finally getting the request, my boss told me that this was going to cost the company a lot of money since they were self insured. He ask me more then once if I had hurt it before so they could subrogate for a portion of the costs. This adjuster is not governed by HIPAA and can desiminate this information at will. Also that pre-existing conditions are being used to defeat claims on the basis of false information on applications for employment.&lt;/p&gt;  &lt;p&gt;I feel that the WOOTEN / Sarah Palin WORKERS COMPENSATION issue brought to light is a perfect example of this. At the time, I felt it was an isolated incedence of abuse &amp;quot;under the colour&amp;quot;. Since then however, I have seen several more instances and seems to be evolving into a trend of fraud even blackmail.&lt;/p&gt;  &lt;p&gt;If in fact this is true, I would like some guidance. But my disk flares up and when it does they should pay for it. I would not have it if not for the work injury that occurred.&lt;/p&gt;  &lt;p&gt;During all of this I have been seeing a doctor for my back.&amp;nbsp;&lt;/p&gt;  &lt;p&gt;This new case manager I have is the one causing all of the problems. &amp;nbsp;I don&amp;#39;t think she has liked me from day one.
