We have no children. Will we have a say as to how the debts and assets are divided, or must we comply strictly with California&amp;#39;s 50/50 division of assets and debts? I advised I would check out my schedule to make sure I had no prior plans with my son. I did not have plans so I agreed that she could pick him up on the requested sunday at 10am (regular pick up time on weekends). &lt;/p&gt;  &lt;p&gt;Now she is throwing a fit and trying to bully me into letting her pick him up at 9am as she requested in her first email. He has a girlfriend who was the object of his extramarital affair prior to our breakup. The Girlfriend was a friend of mine so I am fully aware of her character which I find is not someone I want my children to be in the care of. The issue I have is both the mediator and the Judge have reccomended but not enforced that he spend time with his girlfriend when it is not his week with the children. That reccomendation has been ignored. It is is in the order of the Judge that the father does not consume alcohol when the children are in his custody and for 24 hrs prior. One of my children have confirmed that he continues to drink and the she is drinking as well when around the children. She and her two children (3 yo boy, 7 yo girl) come down every weekend they are with their father (and sometimes during the week) and will stay for 3-4 days. It has been brought to my attention that they are being left in her care while he is gone and that she has taken on a parenting type role and enforcing dicipline. When asked to not dicipline my children I was told by her &amp;quot;If they didn&amp;#39;t misbehave I wouldn&amp;#39;t have to&amp;quot;. It was brought to my attention today of the sleeping arrangements when they are all in the home. The father has a two bedroom apartment. One bedroom is for my oldest son (17) ( which he keeps himself locked up in when the girlfriend and her children are there) and my ex and the youngest (10) share the master bedroom. This room has one large bed and a smaller bed. It has come to my attention that My ex, his girlfriend, her son, her daughter and my 10yo son are sharing 1 bed. On occasion the three children will sleep in the larger bed and the two adults will share the smaller bed in that same room. I find this entire sleeping arrangement inappropriate and a possible problem for all parties involved. What is reccomended to prevent her from parenting my children and stopping her and her children from sleeping over when my children are staying there? It was suggested I obtain a restraining order but I don&amp;#39;t know if I have the grounds to do so. Should this be handled with an &amp;quot; Order to show cause&amp;quot; and mediation?? I have been paying the same amount of child support for the past 6 years with no review that I was told would be done through the CA child support dept every 3 years. I have filed papers with them for modification twice and never received any correspondence. Phone calls to them go unanswered, or am forced to stay on hold for hours (long distance no less as their &amp;quot;toll-free&amp;quot; number does not work outside of CA) to speak with someone. The interstate liaison only has a voice menu of what to bring to your appt, and office hours and locations. No contact information.&amp;nbsp;I have been unemployed due to a lay off since January of this year and they are taking half of my unemployment benefits. I tried applying for a modification in NY where they were enforcing the order but was informed that one state cannot modify the court order of another and I would have to file for a modification with the CA courts. Is there any suggestions of what other measures I can take? His mother and I got divorced when he was one. For the first three years I had him three weekends out of the month and any other time I could get out of work. For the last year&amp;nbsp;I have taken a job that is 7 days on and 7 days off in near Santa Barbara, so I had him for 12-14 days a month. This year he started k so&amp;nbsp;I only get him 4-6 days a month and&amp;nbsp;I hate it! I live in Temecula and&amp;nbsp;they live in San Diego. (Hour and some change&amp;nbsp;apart) The original agreement was that she could&amp;nbsp;move to SD to go to school and when she was done she would move back to&amp;nbsp;Silver Lakes (the high desert is where we lived together and had our boy) so we could have 50/50. It was not court ordered but it was notarized.&amp;nbsp;I have always paid CS and he is my world. I not involved with his school really, but I did go to his preschool graduation and&amp;nbsp;pick him up every once in a while. I don&amp;#39;t know if that makes me a bad father? We do go camping with the boat to the lake, river and take trips out to the desert to play in the dirt.&amp;nbsp;I have a girlfriend of 4yrs and she has 3 kids from&amp;nbsp;a&amp;nbsp;previous marriage, we all live together and are a family.&amp;nbsp;&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; So my ex gets married to a guy in the National Guard and they have 1 child and 1 on the way. He has been stationed in SD the last 7yrs and they have fought the last 2yrs to stay there because of our little boy and she is in nursing school. (I&amp;#39;m thinking more nursing school than me, because she only thinks of her self) So it&amp;#39;s that time of year again and they are saying it is vary unlikely that he get to stay in SD. They said they had to argue with the military to just be able to stay in CA. So they said they might get Los Angeles, Sacramento, San Francisco, or Humboldt. She is saying if I don&amp;#39;t want them to go 10hrs away and put me or my lil boy on a plane to see each other then he will get out of the military and go 6hrs away to Atascadero to live with her Dad until she is done with her school and can afford to live with her husband making $8 an hour. And have her family take care of the kids so she won&amp;rsquo;t have to pay childcare. In my opinion that is where she really wants to be. I know she&amp;nbsp;did her&amp;nbsp;research before telling me, I have found most of the information that she has told me online. For example; she will forfeit my child support so I would be able to come see him, that no judge will make them stay in the area with no form of income with 2 kids and 1 on the way. With me having a 7 and 7 work schedule and not being married. Now that we are in Florida he has taken me to Court for Content to show cause for leaving the State I had sent him a certified letter stating that we were planning on moving give him the address and phone numbers of where we would be at but he never responded to the letter. I went to court on 10/23/09 in California, the&amp;nbsp;Judge postponed it until 01/11/10, while in court my ex-husband&amp;#39;s Lawyer served me with papers for a Deposition hearing on 11/06/09 in California. I am not able to fly back and forth due to money issues and my father is ill. That is why we moved here. I am looking to see if I can get help with either postponing the hearing or via phone. My kids have expressed no desire in visiting or seeing their father they are ages 17th &amp;amp; 15th. I&amp;#39;ve seen  all the general forms available for the Cal. O.C. Supreme court. But I&amp;#39;m still  not sure on these specifically:&lt;/p&gt;  &lt;p&gt;&lt;b&gt;&lt;i&gt;First Action-&lt;/i&gt;&lt;/b&gt;&lt;b&gt;Request&lt;/b&gt; &lt;b&gt;examination/copies&lt;/b&gt;  of court documents (evidence) of all CPS/Soc Serv reports made since &amp;#39;05---these  were accessed by the court investigator and used in the custody report.( &lt;i&gt;A  friend said he had a similar situation and filed to see what was in these and  planned out his defense during his divorce.&lt;/i&gt;) I need to do this as there is  questionable circumstances regarding the entity that initiated the first report  because they were not a &lt;b&gt;mandated reporter&lt;/b&gt;, so no one could have  witnessed the allegations made that caused all this to begin with and this was  found to be a &amp;quot;fact&amp;quot; by the CPS worker that interviewed me and I was  told back then to petition the court for this report but didn&amp;#39;t then and want  it, and another 3 that were done against me by the same 2 people each time (&lt;i&gt;my  spouse and her mother&lt;/i&gt;) when I had custody but was NEVER informed by Soc  Serv/CPS that they had received these.&lt;/p&gt;  &lt;p&gt;&lt;b&gt;&lt;i&gt;Second Action&lt;/i&gt;&lt;/b&gt;-During a &lt;b&gt;Custody Investigation &lt;/b&gt;my rights were  denied as follows: &lt;b&gt;1&lt;/b&gt;-Was told on two occasions that I would receive a questionnaire  to fill out prior to the meeting. After which the statements would be entered  in the custody investigation as my testimony and this is stated in the final  report as being a &amp;quot;right given by the court&amp;quot; to each parent to  fulfill. But even after we determined twice that current address/email  information was correct, I NEVER received one. &lt;b&gt;2&lt;/b&gt;-During the meeting I  was told that I would be allowed &amp;quot;3 contacts&amp;quot; as character witnesses  or to verify my testimony on custody concerns and they subsequently interviewed/contacted  &lt;i&gt;NONE&lt;/i&gt;. Then this investigator &lt;b&gt;erroneously entered in the  report&lt;/b&gt; as PERSONS INTERVIEWED, &amp;quot;&lt;b&gt;a letter&lt;/b&gt;&amp;quot; I received  from one of my contacts. When no such action took place and I was only showing  them the letter to give them the correct address of that contact. &lt;b&gt;3&lt;/b&gt;-After  receiving the report and contacting the court investigator supervisor within  the 5 day window that was by the court rules that I disagreed with the certain  entries as facts in the report, I initiated my &amp;quot;right to question the  investigator on the stand in court in front of the Judge&amp;quot; and was told  that I had to pay $135.00 for this before it could take place even after I  asserted that this case was in process with the &amp;quot;fee waiver&amp;quot; accepted  and enacted as signed by the Judge. I exclaimed it would be &amp;quot;denying me my  right&amp;quot; and that was against the court rules as this was the process I was  following and they just said &amp;quot;someone has to pay us&amp;quot; after which I  was told sorry and &amp;quot;good luck&amp;quot;.&lt;b&gt; 4&lt;/b&gt;-The report totally made  incorrect entries on dates when incidents took place, and these can be  countered by the files that is in the DA&amp;#39;s office who initially contacted my  spouse and explained she &amp;quot;could not divorce me in another state that was  not the home state of our children where custody was to be determined on&amp;quot;  and this would be in addition to the Declaration I filed with all the facts and  dates and incidents correctly stated and verified by Police Reports I made  during these incidents after which I gave the court investigators a copy.&lt;/p&gt;  &lt;p&gt;What I intend on asking for relief/sanctions  on these is that they be corrected/removed according to what is found as the  initial true facts regarding these.&lt;/p&gt;  &lt;p&gt;I gave the detail because this is what I  intend to file with the court to let the Judge hear that this is what in fact  happened and what I am not seeing is what exact form should/could be used or  made to be used to get this enacted upon. The detail was necessary to assure  the correct information is given on the forms I need. (Sorry about the length)&lt;/p&gt;  &lt;p&gt;If  it&amp;#39;s one of those forms you have to design yourself if you&amp;rsquo;re a paralegal or  lawyer specializing in Family court issues, then I have to try it on my own as  I have no money but I need to file this as soon as possible because I&amp;#39;m almost  done with some court ordered actions that were on me to complete. After which  they will start a custody determination which I intend to make the balance as  even as possible with correctly asking for sanctions on this custody report and  some other litigation that will remove some other actions against me. Both my  spouse and I are Pro Se and I also intend on making the court aware that these  certain actions were taken to stop me from any future custody with my children.  And all these &amp;quot;actions against my spouse and I&amp;quot; was instigated from  my mother-in-law throughout our entire relationship just because my spouse had  a son from a prior relationship where the father left and never wanted any part  of his son and me finding her and him and starting a serious relationship that  would take away her caring for her daughter and her grandson caused this  enormous rift that was in the end what ended our relationship after 2 more  children and 15 years of marriage. I learned today that DCSS is claiming that I owe nearly $3000 in overdue support for which they have issued a demand for the release of the lien that they have placed on my house which is being sold by court order. Where they found such a number I have no clue and they certainly have not produced any such number in the various monthly accounting statements mailed to me. But as I learned earlier this year, when they siezed a portion of my tax refund, they are well armed with an array of extra-judicial powers (would you give a child a sack of hand grenades or a machine gun? then why give confiscatory powers to an organization that can&amp;#39;t hire competent accountants?).&lt;/p&gt;  &lt;p&gt;But I digress ....&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;Once before I faced their attorneys in court and thought that after going through the process of a judicial accounting this problem was resolved. Well, I knew that they would continue their improper monthly accounting scheme, which combined with my biweekly wage assignment, leads mathematically to a shortage every 5 of 6 months (which accounted for the automatic confiscation of about $200 of my tax refund ... which I was told would be return to me upon my child&amp;#39;s emancipation!) but that could in no way produce such a large lien demand. The maximum shortage under their default accounting scheme is only one half of one month&amp;#39;s support payment. And in this case, that maximum is already reduced by a further $200 that they have already seized.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;What to do? Submit an ex parte motion for injunctive relief pending an order to show cause? Punitive damages should really be awarded. Anyone who seizes a chunk of your house should really have their numbers in order. When I got to the school I was greeted in the front of the school in my car in the main line for every student that was picked up there, by a police officer which made me sit there while she read me 4 order of Protection orders 2 for each child for me and my husband. I really was mad then,&amp;nbsp; It was NO CONTACT Orders... they were saying that my present husband had touched my daughters *** and that I had beat both children with a belt buckle. He of course didn&amp;#39;t have any proof but did this stop this from happening NO!!! I was outragged!!! So I then waited on&amp;nbsp; the court date again which they still kept it a no contact order. I live in a small town in TN but that is how it works..I have always been a great mother to my children and I&amp;#39;m very outragged about this... I have been through two attorneys and now honestly I&amp;#39;m out of money 6000.00 I could have had raising my chilren that now I can&amp;#39;t. And Im not downing all attorneys because I know there is some great ones out there I just haven&amp;#39;t had good luck yet. The only thing that burns me is my ex&amp;#39;s Attorney is the local city judge 5 min from the county he represents my ex in which where he is the judge and where my court is there the same county..What is wrong with this picture, am I supposed to believe that 2 judges that work in the same county are going to be able to be impartial with one another. I have been going through this for the last year and I still have not spoken to my kids yet. One other thing an investigation was opened through DCS , which was dropped after the first time they (DCS) spoke with my husband and I. They said there was no evidence of abuse..So why can I still not have visitation with my kids???
