Children live two hours away with Mom, who I learned through the kids has moved yet again (she moves once a year, atleast).&amp;nbsp;There are no orders prohibiting me from having her address, she just wants to be dificult, and&amp;nbsp;I hate dragging her to court over things like an address.&lt;/p&gt;  &lt;p&gt;Now, Mom is pregnant by a new boyfriend.&amp;nbsp;He was around in Sept/part of October&amp;nbsp;before he left Mom. Now, he is back in the picture and the kids&amp;nbsp;have begun expressing that they do not like the boyfriend and are scared of him. They would not say why at first, then broke down and told me that he threatens them with his belt often when he feels they are being bad. They have also witnessed this man &amp;quot;beating up on&amp;quot; their Mother on many occasions (and went into great detail about what he says/does when this happens.)&lt;/p&gt;  &lt;p&gt;I am at a loss of what to do here-- or what I can do, legally. I cannot call child services, as the man does not live with them, so I do not know when he is there... nor do I know where they live right now. My significant other has a very frustrating situation and we do not know what to do. Other than get a lawyer that we can not afford. He has three kids with his ex-wife.&amp;nbsp; His middle and only little girl that was recently hit and killed on the way to her bus stop with her older brother three weeks ago (10/28/09). I am not sure what all anyone knows, but the &amp;quot;accident&amp;quot; was a result of the selfish and careless &amp;quot;Mother&amp;#39;s&amp;quot; neglectful behavior. She has sole parental responsibility that Dad regretfully signed over to avoid further conflict.&amp;nbsp; She is pretty much the one that calls the shots and seems to be the way it always has been. I am sure that has much to do with her abusive and manipulating personality. &lt;br /&gt;&lt;br /&gt;The youngest of the three has not wanted to go back to her since the passing of his sister and until last night this was not a problem with Mom.&amp;nbsp; Last night (11/17/09) she wanted to let the boys hang out for a little while, or so was her excuse. I guarantee there was really an underhanded reason. We met her; she wasted no time trying to manipulate one son into staying the night with her and after several failed attempts she finally succeeded. Again Dad did not want any conflict so did not object but reminded her that the son wanted to come back home the very next day and her response was, &amp;ldquo;we&amp;rsquo;ll see&amp;rdquo; in a very hateful tone. I sat waiting in the truck after I said my not so &amp;ldquo;good&amp;rdquo; byes to the kids, because I am very worried for their safety I do not like even the idea of them being with her. Mom began talking down to Dad, but I am not clear on everything she was saying. Dad decided he had enough of her and wanted to kiss the kids goodbye, Mom kept saying that he already said good bye and that was harassment so he should leave or she would call the cops, he said, &amp;ldquo;Go ahead, I&amp;rsquo;m saying goodbye to my kids.&amp;rdquo; Ridiculous I know, but this is how she is. As he was walking away he said, &amp;ldquo;Keep them safe,&amp;rdquo; she took high offence to this, came running after him and got her arm around his neck and started punching him in the face. &lt;br /&gt;&lt;br /&gt;(Her brother got her off of Dad, who did nothing to Mom, just to make that clear) &lt;br /&gt;&lt;br /&gt;I got out of the truck and walked over to them because I wasn&amp;rsquo;t about to just sit there while she did that. Mom had her brother and sister-in-law with her (for &amp;ldquo;muscle&amp;rdquo; I&amp;rsquo;m sure, to make sure Dad gave the son to her willingly) so when I walked up ready to call the cops with my phone in my hand, Mom&amp;#39;s brother started making comments at me and sister-in-law took my phone out of my hand and tried to come at me, she did nothing more than pull my hair, I swung a fist at her but I do not know if I made any contact. Mom&amp;#39;s brother separated us and made some comment about how sister-inlaw would kill me, as if I was worried. Realizing the kids were in the car probably watching everything, I decided to go finish making my call to the cops. A few sheriffs came to the scene, after Mom and the rest left, with the kids, and we explained everything to them. A witness corroborated what had just happened with what we told the sheriff. The sheriff we spoke to said that they were pressing charges for domestic violence and that they would go pick her up, but this morning (11/18/09) they said they were just going to summons her to court. I did not press charges for the assault because I am more concerned with what is going on with the kids and I didn&amp;rsquo;t get hurt, just extremely angry. &lt;br /&gt;&lt;br /&gt;This does not happen to be the first &amp;ldquo;flip out&amp;rdquo; and it is also not the only time she has been negligent. I was not apart of Dad&amp;#39;s life when he was married to her and I do not follow her around so I don&amp;rsquo;t know everything that she has ever done to put the kids in harms way, but I know that she started allowing the kids to go home from school and stay by their selves last year at ages 8 and 5. I voiced my opinion about the matter but that&amp;rsquo;s really all that I could do. Dad has been so worried about her taking the kids away completely, even though the law isn&amp;rsquo;t suppose to play sides just because of sex they still often play in favor of the mother on most occasions. I know that when we have the kids we will not even so much as let them play in the back yard by themselves, and it is fenced in, much less let them walk to their bus stop by their selves and definitely not let them come home and stay by their selves. &lt;br /&gt;&lt;br /&gt;So how is it that this woman was so negligent that a child died and another one got seriously injured, is able to continue to have control over them, supervise them, or even be able to see them? How is it she is able to get away with the things that she does? Ex filed papers to take me back to court to adjust travel arrangement section. The travel arrangements I made, I gave ex 3 months advance notice of arrangements (which I will never do again). My question is, can ex take this in front of the court and win the change to what it is ex is asking for? We are trying to nagotiate but we are hitting roadblocks. Should I tell ex that I am also going to seak contemp for ex&amp;#39;s violation of agreement as well to try as a nogotiation tactic? Ex has viloated several times from what is clearly written. My ex flat out lied to me and told me he was expelled from school. she then sent him to her sister to live with her and attend a different school. this was after i told her that i did not agree with that and if she did not wish to keep him that he could come live with me. i recently talked to the pricapal of the school he was supposedly expelled from, thats when i found out that he had in fact not been expelled but had only been suspended. my 10 year old definatly has an anger management issue. i can not get her to agree to seek proper counceling for this and i am unable to take him myself because i live 125 miles away. &lt;/p&gt;  &lt;p&gt;Now to my 13 year old. he is very belidgerant and constantly backtalks to most any adult. his grade are dropping&amp;nbsp; and he seems depressed at times. recently he has told me that he found a white powder and a straw in his moms car and asked me what it could be. i told him there is no way to know with out having it tested. he told me that he dumped it out on the ground. he also told me that he knows for a fact that his two older step brothers smoke pot.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;i want my kids out of this situation. i just feel that if i dont do something soon its going to be too late to help them.&lt;/p&gt;  &lt;p&gt;will i have any problem getting custody?&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;div style="clear:both;"&gt;&lt;/div&gt;</description></item><item><title>I need full custody fast my daughter is miserable !!!!</title><link>http://community.lawyers.com/forums/thread/434775.aspx</link><pubDate>Thu, 19 Nov 2009 02:00:48 GMT</pubDate><guid isPermaLink="false">cbeb030d-bab6-4a2c-9831-ca1feaac8ba9:434775</guid><dc:creator>jess.mom</dc:creator><slash:comments>1</slash:comments><comments>http://community.lawyers.com/forums/thread/434775.aspx</comments><wfw:commentRss>http://community.lawyers.com/forums/commentrss.aspx?SectionID=69&amp;PostID=434775</wfw:commentRss><description>  &lt;p&gt;Against my better judgment I have been returning&amp;nbsp;my daughter&amp;nbsp;to&amp;nbsp;her father&amp;#39;s mother&amp;#39;s &amp;nbsp;pre-school. For some time now I have been telling&amp;nbsp;her father&amp;nbsp;that I&amp;rsquo;m not okay with&amp;nbsp;our daughter&amp;nbsp;going to this pre-school because I&amp;rsquo;m not allowed inside to see what is going on and every time that I drop&amp;nbsp;her off when my visitation is over with she is terrified and doesn&amp;rsquo;t want to go to&amp;nbsp;&amp;nbsp;her grandmother&amp;#39;s. She clings onto me and will cry and screams &amp;ldquo; mommy no, mommy I want you, mommy don&amp;rsquo;t leave me&amp;rdquo;. The other day when I went to drop&amp;nbsp;my daughter&amp;nbsp;off she cried all the way there then when we got there&amp;nbsp;her grandmother&amp;nbsp;opened the door and I tried explaining to her that&amp;nbsp;she was having a hard time, before I could finish what I was saying&amp;nbsp;her grandmother&amp;nbsp;rippe... daughter&amp;nbsp;out of my arms and went in the house with my daughter screaming mommy don&amp;rsquo;t leave me mommy want to stay with you.&amp;nbsp;Her blanket fell on the ground and&amp;nbsp;grandmother picked it up and threw it at me at said here is your stupid blanket. (This blanket being&amp;nbsp;my daughter&amp;#39;s&amp;nbsp;security blanket). I then grabbed the door as she went to shut it and handed the blanket back to&amp;nbsp;my daughter&amp;nbsp;as she was screaming for it. I then sad Mommy loves you baby and before I finished saying what I was saying the door was slammed in my face. I could still hear her cries for me inside. Later that day I returned to pick her up and everything went well till&amp;nbsp;her father&amp;nbsp;came to pick her up he was very angry screaming and yelling at me and my mother as he was walking up the driveway&amp;nbsp;my daughter crawled up onto my lap clenching onto me crying saying &amp;ldquo;No daddy no want stay with mamma daddy bad, Mommy want stay here, please mommy&amp;rdquo;.&amp;nbsp;Her father&amp;nbsp;tried taking her from me and I told him no she not ready to go yet she is to upset, she was so upset she peed her pants and he got mad. He then grabbed her from me and she was still crying saying mommy stay with you reaching out to me, I told her mommy will come get you tomorrow and&amp;nbsp;he yelled back no you wont (which we had already agreed upon me having her that day) He keeps telling me I can then I cant have her he will never agree to a long term schedule and its affecting my daughter. I feel so wrong about leaving her with&amp;nbsp;her father&amp;nbsp;and his mother because she is terrified and doesn&amp;rsquo;t want to be with them but at the same time I want to go about everything the right way, and this is why you&amp;rsquo;re my last hope.&amp;nbsp;Her father&amp;nbsp;has violated the custody agreement in many ways since it was put in place. I recently found out that he moved and was living at the residence for months without informing me, I never knew because&amp;nbsp;my daughter&amp;nbsp;wasn&amp;amp;amp... staying with him she was staying with his mother, which is also not okay with me I am always able to take&amp;nbsp;care of my daughter&amp;nbsp;and know she is better off with her mother not her father or grandmother especially since she is terrified of her. I have made multiple attempts to talk to her father and work something out with him so that I can have her while he is working, or doesn&amp;rsquo;t want her staying with him, (because he has told me that his girlfriends son doesn&amp;rsquo;t get along with&amp;nbsp;my daughter&amp;nbsp;and when he is there she can&amp;rsquo;t stay with him). &amp;nbsp;Because I want her to be with her parents and I&amp;rsquo;m perfectly capable of taking care of her however he refuses to let me have her for that long. When he does agree that I can have her outside of the bare minimum of the agreement it&amp;rsquo;s a fight just to get her I have to beg and usually he has every excuse in the book why I can&amp;rsquo;t take her. He says there always busy yet he never has her, his mother does. He has made multiple threats to me, my fianc&amp;eacute;e, and mother to our face and through my daughter who&amp;#39;s only three.&amp;nbsp;My daughter&amp;nbsp;has told me that daddy said he is going to kill mommy and grandma (my mother) and my fianc&amp;eacute;e. He told me that if I ever got full custody that he would make sure&amp;nbsp;my daughter&amp;nbsp;didn&amp;amp;amp... live long enough to make it into my arms. That we are bad people and has made the same threats to our faces. He is brain washing her. There have been times when he has picked her up and I have yelled &amp;ldquo;I love you&amp;rdquo; while he was taking her and I could hear him plain as day say &amp;ldquo;no she doesn&amp;rsquo;t&amp;rdquo;. &amp;nbsp;I am so worried for&amp;nbsp;my daughter&amp;nbsp;because every time I pick her up she is covered in flea bites and scratches. When I bring this to&amp;nbsp;her father&amp;#39;s&amp;nbsp;attention, he says he knows and its none of my business how she got them, she is constantly sick and he wont tell me what dr. they took her to or what he said, when they do say they took her, I&amp;rsquo;m never informed about anything especially anything to do with her health and well being. I have discussed her being terrified of him, her health, what she is doing in school and much more and when there are problems he always admits there is a problem yet never tells me what he will do to fix it and tell me it&amp;rsquo;s not my business.&amp;nbsp;Her&amp;amp;amp... told me multiple times if he doesn&amp;rsquo;t have at least 50% custody in writing that his mother will cut him off and no longer help support him in paying some of his bills,&amp;nbsp;He&amp;nbsp;has manipulated the courts to get partial custody of&amp;nbsp;my daughter&amp;nbsp;so that his mother will support him and in reality&amp;nbsp;my daughter&amp;nbsp;isn&amp;rsquo;t even with the father.&amp;nbsp; I feel like this has reached a point to where&amp;nbsp;my daughter&amp;nbsp;is no longer safe physically or mentaly&amp;nbsp;in there care. I can no longer stand by while she is miss-treated, when I&amp;rsquo;m fully capable of taking full care of her in a safe caring environment. I have tried many times to get as much time with her as I can to get her out of the situation but her father is like a emotional roller coaster and uses&amp;nbsp;my daughter&amp;nbsp;to control the situation. He rarely lets me have her and I strongly feel she is not safe I have an appointment with mediation on the 18&lt;sup&gt;th&lt;/sup&gt; of December 2009&amp;nbsp;but this cannot wait until then. She needs to be in a safe environment now everything else can wait till we can go to court but for now I need to know that she is in a safe place where nobody is hurting her and I am fully capable of being the one who takes care of her. Our schedule as of now is I have her two days a week and every other weekend due to the terrible lawyer I had when I didn&amp;#39;t know any better. He gets his way in court by actually crying in the courtroom and making false accusasions of me and my fiancee saying we abuse her and that we do drugs which is entirely untrue, but for some reason the judge sees his tears and believes him and when I bring up reasons why she shouldn&amp;#39;t be around her father even when I can prove the claims with witnesses, text messages, and phone records the judge just sais he doesn&amp;#39;t want to hear it. I have tried calling CPS and local law enforcement but they just say that they cannot do anything and that I have to go back to court. I don&amp;#39;t know how to handle this. And now that my daughter gets punished by her father for saying she wants to be with me I&amp;#39;m very scared that when we go back to court the judge will continue to be one sided.&amp;nbsp;This can&amp;#39;t wait for court, there is no time for that. Is there anything I can do? My son has always lived with me. &lt;/p&gt;  &lt;p&gt;My teenage son is&amp;nbsp;insisting on living with his father because he recently got caught lying about something&amp;nbsp;pretty serious&amp;nbsp;and the consequences were that he was no&amp;nbsp;longer allowed to see his girlfriend. &amp;nbsp;He does not like the fact that he has restrictions at my home. My ex is like a giant child himself and allows my son to do what he wants, whenever he wants. &lt;/p&gt;  &lt;p&gt;My ex agrees with my son and says that he will now fight me for custody and that my son hates me. My question is: What are the chances of him winning and what can I expect when this goes to court? I pay all of his expenses.  she has gotten behind in her day care for her daughter and owes 1268.00.  Her daughter was put out and now on the weeks that my son is with her she keeps him out because the daughter can&amp;#39;t go back.  I am seeking full custody.  What direction should I go?  Is there a way to get an emergancy hearing?  I have already filled but it will be served 2-3 weeks from now. The judge also ordered that on every odd number year, my boyfriend has his daughter for every holiday, including her birthday. This year for her birthday, the mother refused to let my boyfriend see his daughter. It is his year to have her but she claims that he was supposed to see her the day before.....but she never made an attempt to set up any plans. The judge clearly said that he is to have his daughter for all holidays this year. So, we settled for picking her up from daycare early to spend a few hours with her before her mother comes to pick her up. She has a party planned and everything. The entire day was spent trying to get a hold of her to see if we could pick the daughter up from daycare because we were supposed to have her but the mother never answered. Finally, my boyfriend gave up and went to her work....she told us that she never works on that day but she WAS there. He went inside to talk to her and she yelled at him in front of everyone in the restaurant. He calmly explained to her that it was his time with her and that she had a birthday party for her last year. She didn&amp;#39;t say anything and then said, &amp;quot;I&amp;#39;ll pick her up at 6pm&amp;quot;. ((She knew she was in the wrong for doing this))&amp;nbsp;&lt;/p&gt;  &lt;p&gt;The mother is also sending their daughter to my boyfriend&amp;#39;s parent&amp;#39;s house on the weekends and he doesn&amp;#39;t even know about it. She does this on the weekends she has the daughter so she can go out and party instead. In the last 2 weeks there have been 2 seperate times that arrangements for visits have been made and then custodial parent gets mad about something or has a bad day and revokes my visit. Meanwhile&amp;nbsp;I have already told my daughter that I will be there. We have a mediation appointment scheduled for the middle of January 2010, but I cannot go on like this until then. I have a 5 year old daughter, to whose mother I wasn&amp;#39;t married to.&lt;/p&gt;  &lt;p&gt;We have a visitation agreement, however the mother constantly violates it by not showing up, making excuses (example: she says my daughter is in CCD and can&amp;#39;t stay over on Saturdays..... my daughter is only 5 and I&amp;#39;m told CCD doesn&amp;#39;t start &amp;#39;till 6 years of age, and also I&amp;#39;ve been allowed to take her a couple of times on Sunday when it&amp;#39;s convenient for the mother, obviously no CCD here.)&lt;/p&gt;  &lt;p&gt;I&amp;#39;m supposed to receive phone calls from my daughter at specified times. More days go by without phone calls then with phone calls.&lt;/p&gt;  &lt;p&gt;She&amp;#39;s mentally unstable in that she swears and yells constantly in front of my daughter. My daughter dropped the &amp;quot;F bomb&amp;quot; when she was 4, and I know where she got it from. The mother constantly bad mouths me in front of my daughter. Basically, the mother is angry white trash. &lt;/p&gt;  &lt;p&gt;The mother is now married and allows my daughter to call her husband &amp;quot;daddy&amp;quot; and tells my daughter that I&amp;#39;m a dead beat, and a loser, etc.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;This is not the case. I have no criminal record, I work 2 jobs, I pay my bills, I don&amp;#39;t do drugs, I don&amp;#39;t drink, and I enjoy spending time with my daughter.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;I&amp;#39;ve taken her to court for contempt before, but the only thing that happens is we sit in a room with a family services worker, fill out a financial statement, and then discuss how much more I&amp;#39;m going to pay in child support even when there&amp;#39;s no open motion for modification. Then, nothing happens other than what I mentioned above.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;I work 2 jobs so I can pay child support, AND support myself.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;Can someone tell me what I have to do to get joint physical custody of my daughter, and&amp;nbsp;eliminate the child support so I don&amp;#39;t have to work 2 jobs? I&amp;#39;d like to only have to work 1 job, financially support my daughter on my own terms, and spend half the week and every other weekend with her.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;This is a case where busting my chops and not seeing my daughter in order&amp;nbsp;to pay child support isn&amp;#39;t in her best interest.&lt;/p&gt;  &lt;p&gt;&amp;nbsp;&lt;/p&gt;  &lt;p&gt;I can&amp;#39;t afford a lawyer even though I know everyone is going to tell me to get one.
