FL Motorcycle accident, hit and run vehicle found injuries..

14 months ago I was involved in a motorcycle accident. I had a passenger and we were both wearing full safety gear. We were struck by a Jeep who fled the scene without ever slowing down. The motorcycle was destroyed, I incurred the typical road rash, and a shattered heal. My passenger suffered from a broken Tibia, and Broken fibia and required a metal rod to be surgically implanted in her leg.

They found the Jeep immedietly after the accident, but the driver had fled. It took many weeks for us to get any results of the case as the police department were very reluctant to actually find the driver. After weeks of calls to supervisors and superiors we finally had an agent go to the vehicles registered owner's residence for questioning. At the time the officer arrived the vehicle owner would not come out of the house and simply yelled out of the window that he wasnt driving and he wouldn't say who was. He said to call his lawyer.

Well I have talked to a couple lawyers and the police department who say he is not accountable since we cannot 100% ID him as the driver, even though witness picked him out of a photo lineup but without 100% certainty. Being as we live in FL, bodily injury insurance is not required (WHY!?!!) He had insurance, but no bodily injury so we are left with $120,000 in medical bills. (our insurance did not pick up the bill, and we did not have medical insurance at the time of the accident.) Both me and my partner suffer permanent injuries that will haunt us for the rest of our lives.

The few lawyers I spoke to all said the same thing. "There is nothing we can do since he did not have bodily injury." Well how do I go about sueing him in civil court so he is forced to make a statement? How can someone really get away with something like this? They have his vehicle, yet he can simply say he want driving and refuse to say who was on such a crime??? One lawyer told me he could go after a judgement but he wanted me to pay him $100,000 to do it. Is this really my only option? We have witnesses, police reports, etc, but that doesn't help the bills or the pain we will have forever.

me and a few friends were down at a train station about to leave. my buddy got out of the car, as a joke we thought it would be funny to lock the doors and drive away. once the doors got locked and my buddy was outside he decided to run around my car and to jump onto my hood. but before he jumped onto my hood i started to slowely drive away and just before he jumped on i pressed the gas a bit harder. my wheels were already turned so my car made a small turn. my friend on the other hand wanted to push off the car, when i noticed i quickly braked. when i braked he unfortunately fell breaking his ankle severely. after half a year he has decided to sue me...

during that day he did drink alcohol ( large corona beer ). while i was driving away i didnt go more than 15km... the 3 other people in my car wrote down basically the same thing on their statements, as i wrote down on this forum.

total 5 people in car, so enough seatbelts for people. he is underage to drink and drank, but i was the one who bought the beer for him since he asked.

after the accident the first thing he told me was he knows it wasnt my fault, sadly i wish i would have recorded him say that for proof. but now hes never going to agree that he said that. he also told me he likes getting money for not doing anything and hes all about money... basically him and his family are all about money and doing nothing for it.

i am wondering about what options i may have regarding this situation? how much could he possibly sue me for here in canada. if things get carried away is it possible for me to sue him for jumping onto my car while it has been already moving?

Got rear ended and wanting my car fixed

Late September I was involved in a four car accident, the last car was deemed at fault for causing it. I was 3rd car inline the car in front of me being the last. I'm not sure of the law in KY as far as how much insurance can payout to fix a car, I've heard different things, but the damages on my car is appx. 2000 dollars. The rear and front bumper covers needing to be repaired, the rear bumper/absorber needing replacement and frame damage on the rear.

The insurance comp is saying they'll only pay up to NADA value nothing more and have sent me a check for appx. 75% of the cars NADA value 1000k which isnt enough the cover the damages. My vehicle in question is in excellent condition and from what the adjuster told me they only care about the year of the car in terms of repairing the car and totaling it out. I really just want them to fix my vehicle since in all the damage isnt severe, I'm really wondering if its possible to get them to repair my car to pre-accident conditions, given I wasnt at fault nor played a role attributing to the accident.

I need to see if someone can give me some sort of direction.... last night 11/20/09 at 7:15pm my mom and a friend of hers were in a auto accident the other driver was a truck with 2 16 year girls in the vehicle and thats it. they both had the green light but the truck tried to turn and instead of making the turn totalled my moms car becasue there was no protected arrow... where do i go from here are there any laws in texas that state anything about 16 year old drivers and having an adult in the vehicle or can someone please shed some light for me please... my mother and her friend would like to go forward ith this becasue of the fact that while they were trying to pry my mom and her friend out of the car the 2 teens were laughing the majority of the time. could their parents be held liable..

Woman back into me insurance dispute please HELP!!

Hello this month i was involved in an auto accident where i was behind a lady and she backed up into me with enough speed where she affected my bumper and climbed the bumper (due to the incline and height of my bumper) and scratched my hood up about a inch and a half i hit my head when putting a reciept in the console looking down when she hit me. Well she came out immediately and wanted to go to every body shop available later right NOW to do an estimate later finding out is was the reason because her license was suspended. I called the police and they made a report. I went to the doctor the next day and they said that i has back pain took xrays and had me stay out of work for two days told me to take meds and go to work. After talking with the insurance company they was very friendly and told me that they was going to pay for my damages and hospital and pain and inconvenience. Well after the adjusted came to my job to do the estimate the person handling the injury claim said they arent going to pay for injuries because of the speed compared with the injuries that was reported stating that i had a aftermarket bumper which breaks easily. Is insurance trying to lowball me?? Can i do something with her license being suspended and she driving??

Child Hit by Moped/Streetbike while playing in Neighbor yard

There was a child playing with his friends in a neighbors yard making a leaf pile. While playing a man ( friend of the homeowner ) rode up the street on his bike - (was a Moped but has been altered to be bigger & faster) This man upon seeing the children building a leaf pile decides it would be funny to ride through the pile - upon doing so he inadvertenally runs over a boy who was in the pile - his bike is stopped by the boy & falls on him.The man picks up his bike and tells the boy that if he tells anyone he will be hurt more then rides off. Boy limps home bleeding with torn clothing & tells mom he tripped & fell and is taken to the ER. Mom tells boys sibling to go find out what he fell on and what happened - neighbor hood kids tell what happened and call is made to ER. CT scan xrays ect are done boy is glued back together ( couldnt stich due to location and width of wounds - but will be ok other than lrg scars. Police are called - homeowners ( not childs parents ) are spoken to first - he smoozes over police ( protects freind ) tells them its not a big deal - Police leave - Parents call police again - same officer tells them they cant do anything because it occured on private property - Parents call chief of police and mayor saying they are calling local news if police dont come and at least take a report and statements -Police change minds come take report from parents and pictures & finally talk with the offender - 6 hrs after incident occured - at this point in time no breathalizer could be done - the man is often drunk / high - The man has no insurance or license & dosent own a home,the place where incident occuered is owned by friend of the guy, Police seem to think it would fall under homeowners - who is financially responsible? Sorry for such a long post - I just keep hitting dead ends so I want to situation understood.

Car frame damage, totaled?

Hi, I live in Los Angeles. I was recently driving on a 4 lane residential street heading north. A vehicle parked at the curb on the south side of the street in the middle of the block initiated a U Turn and T boned me square in the door causing a lot of damage to the drivers side of my car. I recieved minor injury due to my head bouncing off the drivers window, my daughter who was in the passenger seat was uninjured. The driver has admitted fault, and so far his insurance has been very cooperative. They have already autherized a rental car, and have offered a settlement for my suffering(no amount has yet been mentioned). The paramedics did come to the scene to check things out, and I told them I did not need to go to the hospital and no one else was injured. They also told me that the police would not be coming to the scene, due to the fact there were no serious injuries. Since I was a short distance from home I opted to drive the car home, I did notice that the car was pulling somewhat. I took my time and made it home without incident. The adjuster came out yesterday to my house and did an initial inspection, and came up with a figure of $3800 and left it open for the body shop to suppliment as the impact sealed the driver door closed. Today I took the car to the body shop, the service writer explained that it looked like there was some frame damage, but would not know the extent of it until the car was torn down and looked at closer.

Here is my issue, my car is a 2009 Mini that is one month old(I just made my first payment) with just a 1000 miles on it. If it turns out that the frame is bent, I want the car replaced. I don't care how good the body shop is, the frame will never be the same. The jig that is used to straighten a frame pulls and pushes the metal back in place and this weakens the frame. This is a known fact. The body shop inspector told me he expects the repair bill to end up at around $8000 by the time the work is completed. This will include replacing the vertical support structor behind the door and straightening the floor pan on the drivers side. At closer look today I did notice that the driver rear wheel is toed in a bit, which strengthens my theory of a bent frame or at the very least a bent subframe. I understand that with an older vehicle that once you have a certain amount of repair cost to the value of the car that it would be considered totaled. In my case since the car is brand new(I don't even have plates yet) is there a chance the insurance company would total my car due to the frame damage? And if the above conditions are true, can I demand replacement? Another issue would be is that when I sell the car, I would have to disclose that the car was in an accident with frame damage, which would greatly reduce the selling price.

FL Auto Accident with injuries

I was involved in a 3 car accident whereby the driver at fault was driving someone else's vehicle. He was issued a total of 3 citations for expired registration, no proof of insurance and unsafe lane change. He is fighting this and neither the driver's insurance or the owner's insurance has accepted liability as yet although it is exepected that they will. The driver has the same insurnace company that I do but different than the owner's insurance. I was hospitalized for 3 days but have no permanent injuries and no medical care has been needed since my discharge. My PIP and my employer group plan will cover the necessary medical bills. They are approximately $25,000. The owner has 100K/300K/100K policy maximums. The driver only has the minimum state requirement of 10K PIP and 10K Property Damage. Would it be necessary to secure an attorney for pain and suffering since there are no long term injuries and no treatment since my discharge from the hospital or should I ask for a settlement on my own? What kind of a settlement should I ask for? Would an attorney even be interested in this case since there are no long term affects from the injuries? Since I was not at fault I do not feel I should have to pay any out of pocket expenses as a result of the other party being at fault.

Pregnant Wife's Car Sustains Significant Impact in Crash

Yesterday my pregnant wife was involved in an accident with another vehicle. My wife's vehicle sustained a significant hit in the front-passenger area. She was very upset and crying after the accident due to the trauma of being hit with such force while being 5 months pregnant. We drove to the hospital in my car immediately after the police left to ensure our baby was not harmed. The police officer stated to me when I arrived that both drivers were at fault. This I believe is a lapse of judgement on the officer's part. The other driver drove out of a gas station without looking and drove directly into my wife's vehicle. The accident did not happen at an intersection. Seeking attorney in the surrounding Eatontown area.

NJ auto accident injury claim time limt

I had an auto accident on 10/11/2007 and my insurance company took care of everything. All of sudden 11/3/09 I received a court summons and complaint from the other party suing me for body injury. I noticed the they filed the paper on 10/21/09, which was out of NJ two years limit of suing someone from the auto accident. Not even talking about whose fault it was, my question is how can they file the court paper to bring up the case from more than two years ago and why the NJ court took the case ? I did online research and it looks like state of New Jersey has two years limitation for the auto injury claim. Any comments are greatly appreciateed. Thank you.

Can I lose my house in a lawsuit

My 21 year old daughter had an accident 6 weeks ago in my car, she had edged out to see around a large tree and cars parked on the side of the road, and a man on a scooter skimmed off my bumper and off the road into a ditch. Wearing sandals and shorts there were no visible scratches or cuts, but he said his back hurt. I offered to call an ambulance, he declined, then finally said yes. The ambulance came as well as the state police ( we live in Pa.) but he declined the ambulance and said he was ok. I have pictures of the corner and how hard it was to see and the troopers said there are accidents there frequently because of poor visibility. My insurance paid $5000 in damages to the scooter, but he has now retained a lawyer, saying he has internal injuries and my agent has said they will exceed the $15,000 my policy has on it. I am afraid I will lose my house, I don't have anything else of value. Can I lose my house....

I was involved in a rear end accident on March 27 '08. The girl that hit me was going about 45-50 & hit me without using her brakes at all. She admited to the officer & it is on the accident report that she was looking down & did not see me stop. She was on her cell phone but, did not specify whether she was talking or texting. I assume she was texting or she wouldn't be looking down at her cell phone. I did have pain which steadily got worse over the first 2 weeks. I went through physical therapy for 2 1/2 months which did alleviate some of the pain. I still have some pain & does get worse when i stand for long periods. It has caused a problem in me being able to do some things that I could previously do without pain. It's eleminated the amount & lentgh of yardwork & working in my garden that do enjoy. I have not signed off on anything on the health part. They settled on the car as being totaled which was paid for & now I have a car payment that I didn't have before.

They made a offer that doesn't even cover my lost wages while going through rehab. I just want to be fairly compensated with all my lost wages which I have documented & to cover the health expenses. They verified my time lost with a verbal conversation with my employer. I don't want to get an attorney involved as this isn't a large claim. What options or recourse do I have. I feel the insurance company isn't being fair in my true lost wages compensation. This is actual time lost that wouldn't have occured if the other driver wasn't negligent in the accident by being distracted by talking or texting & not even looking in front of her while driving on a highway while in rush hour traffic.

Non-Injury Auto Accident - Pain and Suffering?

I was in an auto accident in May. The other driver tried to take a left hand turn from a side street onto a 6 lane main road (3 lanes of traffic in each direction) and she hit my car in the rear passenger side which caused my car to roll twice. The car was totaled. I had my seat belt on, so thankfully, I was not injured. I was 8 months pregnant at the time and had the baby examined in utero and thankfully she was ok as well. The other driver's insurance company settled on the car, but now I have to close the medical portion of the claim. I never got an exam. My main concern was the baby and I felt ok. Her insurance company will cover the hospital bill and a week of lost wages. They offered $1000.00 for pain and suffering. I don't feel as if that is enough. I worry that medical issues may surface later on due to the accident and if I accept this settlement, I have no recourse for the future. I also feel like I went through a lot of stress because I was so far into my pregnancy at the time of the accident. I called two lawyers offices and they can't do anything unless I have been injured. Is there a case here? What type of lawyer should I try to contact? What is a reasonable amount for pain and suffering in a case like this?

I was backing out of my driveway and hit my roommates car who sticking out into our driveway more than 5 feet. The spot he parked in was a 10 foot spot with a residential mailbox (obviously not a parking spot). His car is 15.9 feet long plus license plate. We have told him multiple times not to park there. This time I was backing up and lightly scraped his bumper. I was just going to fix the scratches but he wont drop the subject. Would I be legally responsible to fix the scratch? I live in Southern California.

I was driving on a country road and had a t-bone collision February 2009 and am still under the last doctors care for pain management. There is not an issue of fault in the accident and the other partys insurance company has accepted full responsibility ! I was driving 55 mph the posted limit and the other driver had a stop sign but did not stop and my vehicle collided with the side and was totalled with over $12,000 worth of damages! I suufered a torn rotator cuff and tendon repair in my right shoulder, that was repaired in surgery and an impingement in my left shoulder that still is painful but no surgery was performed on the left shoulder! I was driving a 2002 Mustang and upon impact the top section above the seat ( approximately 6 inches by 48 inches and approximately 10 pounds) broke loose and hit me in the back of the head knocking me unconscious for a brief period of time. The impact and this object caused occipital nerve damage on the right side and I have had 2 cotrizone injections that has alleviated about 40 percent of the headache pain I was getting every day ( migrainne type). I also developed tinnitus a very loud ringing in my ears that is permanent injury. I am taking Oxycodone to deal with the pain, daily and have not worked since the accident! I still have moderate to heavy pain in my nech and head and the center of my back every day. I have had several MRI and ct scans that have shown the injuries including 2 herniated bulging discs pressing the thecal sac.

I do not have an attorney yet and will first see what the insurance company offers me before soliciting legal council! My first question has to do with an existing condition I had prior to the accident! I was in very good health, probably exceptional for a 61 year old male. I was diagnosed with a abdominal aortic aneurysm in 2006 and it was very stable at about 3.3cm from 2006 to december 29, 2009 and was not a concern to my Vein specialist MD. He had me on yearly checkups. I went to er in march about 3 weeks after the accident and got an mri and was advised the aortic aneurysm was not leaking but was now measured at 3.9 cm or about 20 percent larger than it was measured a month prior to the accident! I discussed this with my Vein specialist MD and he could not explain why the vein got 20 percent larger in a couple of months but would not attribute it to the accident!

My opinion is : I think there is no logical explanation other than the accident to cause the increase in size since i had a severe blunt force trauma to my chest an stomach with heavy bruising on over half of my body from the impact of the accident. My Vein specialist MD told me that the accident would not have causes this but he was lost for any other explanation. He said it was a mystery but dont worry about it because it does not require surgery yet and to come back every 6 months to have it checked.

Should i try to find another Vein specialist MD that would be sympathetic to my situation and case or just write it off as not associated based upon his opinion? I may eventually need a very expensive operation as this aortic aneurysm gets larger and weaker and would like to assign some monetary blame to the insurance company if they are indeed responsible through the blunt force trauma. Yes there are already a lot of other injuries that are already part of this case. Please advise what you would do if you were representing me!

a older gentlement pulled out infront of me and hit me. The cops came out and wrote him a ticket. I was then taken to the emergency room and diagnosed with a c3 fractured vertrebrae. I was not able to work for 3 months cause i was on vicatin and in a neck brace. This didnt require surgery but i do have lots of pain everyday nothing they can do for it. My medical bills are at 20,500. We have settled on the car it was a total loss. my question is how much should i ask for the adjuster for i have never had to deal witht his kinda thing before.

Rear Ended in auto accident

I was rear ended a couple weeks ago. I was pushed into the car in front of me. The car who hit me first was not able to be driven from the scene due to the front end damage. I went to CareNow that evening and they did some x-rays and diagnosed me with some muscle sprains and spasms and i was to take a couple days off from work. Since the accident was on a Thursday I only took off Friday and returned to work on Monday. The other driver's insurance has accepted full liability for me as well as the car I was pushed into. My car has been fixed to the tune of 1450.00 which included a new rear bumper and a front bumper overhaul. In my ignorance I had agreed with the insurance adjuster to settle for 650.00 which included the cost of my prescriptions lost day of work and the 4-6 anticipated visits to the chiro for pt. That 650.00 did not include the time off work Im having to take to go to these pt appointments. When I accepted this offer I didnt realize my car was going to be 1450, because the initial estimate had been 890.00. I also didnt realize that my pain was going to carry on so long. Since accepting this offer, my pain has gotten worse, and the chiro got my x-rays from CareNow and are thinking that its going to take more treatments (its still soft tissue but just more than they originally thought). I do not know what to do now. I have sent a demand letter to the adjuster for 2000.00 and he called back and flat out refused to go over the original 650.00. I have the check for 650 but I have not and do not intend to cash them. I dont know what to do now.

Rear Ended

I was rear ended by another driver about two weeks ago. Since then I have been called by no less than FIVE quackopracters offering free "consultations" because they are convinced that I may have some hidden injury that they can treat me for.

No one was injured at the scene and EMS wasn't even called. I haven't had any problems and have no need for any work up from any of them. If I had a problem I would see a my family doctor, a REAL physician. I am certain if I were to take up their offer for the "free consultation, xrays, and hydro massage" it would then turn into an automatic undiscovered injury and huge "payout" for THEM. Of course when they call they are all "miracle workers" according to the person on the phone who wants to set me up for the appointment and they can't believe I am not having: headaches, neck pain, back pain (insert littany of symptoms here) after the accident. There is a heavy push to get me into the office for a visit and consultation, view a website, told of credentials etc. I am again warned that I am at great risk of injury and continued pain (that I DON'T have).

How on earth are these scheister's getting my phone number to contact me as I am certainly NOT contacting them?

I've work for this employer for 2 1/2 yrs and last year I had to take my direct supervisor to HR for her nasty attitude towards me. Before taking her to HR I had two one on one meetings with her to discuss how she was treating me in the workplace. Both of these meetings were requested by me and in the meetings I express to her my concerns. No change resulted from the meetings! Since taking her to HR and reporting her behavior which I had documentations of the numerous rude and unprofessional behavior that she displayed I have not been able to get a promotion. I have been on five interviews in the company and I have even went on second interviews but none resulted in a promotion. When ask why I was not the chosen candidate the supervisor could not give me any real reason beside the other candidate was a better fit! I even went after an entry level data entry position and was told they had no position for me and they hired from outside the company. My direct supervisor hired a guy that I trained and then in six months she promoted him as my lead. This promotion was done with the position not even being posted for others to apply for.

The company I work for offers education assistant that has to be approved from your supervisor. The information is all online and has to be approved within three days information she was aware of. She failed to approve my application and went on vacation which resulted in my application being denied. So I reported her to her Director. Once I reported her for the second time the application was approved and soon after they created a new department for her to supervise. Now she has promoted the same guy that she promoted as my lead to her new department. This is now leaving his lead position open! I of course believe that I should be promoted to the lead since I have been there the longest and I have great reviews...In my review she told me that there is NOTHING bad she can say about me she did make a comment that I reported to HR. she said that she felt I had an attitude and was angry at everyone I ask her if she made that comment because I was a Black women because I did not feel she was describing me or my personality.

I do not believe that I am going to get the lead position because I ask our Director if the lead position was going to be filled or of they were just going to hire a third Financial Aid processor. Her reply was that they were going to hire a processor first then they would hire within for the lead position. I feel that they are going to hire a friend of the guy who got promoted and have me train him just so he can be my lead the same thing that happen before! I feel this way because I also ask for access to a system that they usually give to the lead and was told that I would not get access no time soon! which to me sounds like I will be in the same position and the new lead will get the access.

I am really confused because I don't know what I can do. I feel I am a good employee who starts work at 7am everyday and I am there until 6:00 pm some nights. I work really hard, I do not require any assistant and I know my job. I have received nothing but good reviews and have never had any other issues besides the issues with her. What can I do I feel this is so wrong and it will be such a slap in the face again to train someone that will be my lead. I have the education (Bachelor's Degree) and I have the experience! Please give me some advice! Thank you

Rear ended by drunk driving about 90 mph

I was driving with traffic on an interstate and a drunk driver was traveling about 90 mph. He was driving a full size truck and rear ended my 2 day old new car. Girlfriend and I were in the car, both have prior brain injuries that have healed pretty well over the last several years but once you have one you are more succeptable to damage with a second hit. We are both experiencing problems in that area, and she is having physical problems as well. The state police officer hauled him to jail at the scene so at least there is a breathalyzer reading and a report written up on the situation. I think I should hire a lawyer but know very little about these matters. Any advice on finding a good lawyer or on the entire case itself would be greatly appreciated. Thanks in advance.

auto accident

I was involved in an auto accident on September of 2008. I have yet to recieve any monetary compensation for my injuries. The other driver admitted fault for the accident to the officer but was not cited or ticketed. The other driver was on the job at the time of the accident as a postal worker in a postal truck. I do have an attorney and lawsuit has been filed. Should it be taking this long? I thought I at least should have been compensated for the total loss of my car. As of now I have recieved nothing...

middle of three car accident

Yesterday, a car fishtailed on a wet road (interstate highway) in front of my wife and that car eventually hit a barrier. My wife had to stop suddenly and was able to avoid hitting the car in front. However, the car behind her did not react quickly enough and rear-ended my wife's car. There was heavy damage to both vehicles. The trooper told my wife that the original car that spun out was at fault and given a ticket. The next morning, we called our insurance. Surprisingly to us they wanted nothing to do with the accident and told us to call the insurance company of the car that was in front of my wife. Their adjuster is now claiming that they are disputing the fact that their client was at fault. They think there were two separate accidents and that the insurance company of the vehicle that rear-ended my wife's car should be responsible for our repairs. We now seem to be caught in the middle. All we want is for our car to be repaired and it looks like it may take some time before this all gets resolved. What options do we have? Do we need to contact a lawyer to represent us since our insurance agent doesn't seem to have our best interests at hand? How long does this need to play out before we consider a lawsuit? What advice would you give us to make sure we are treated equitably during the claim process. I have already received two estimates for the damage repair in case the adjuster tries to low-ball me. Is it reasonable to also ask for a "dimenished value" payment since now even after the repairs are made, my car will not have the same value to a dealer or private party, once they are aware the vehicle was in a wreck? Judge dies before he can sign order

he ruled in my favor.Before he could sign the order he dies.Am

I correct in assumming that my attorney hs to go to another judge

and get the final order signed

My lawyer kept stalling about filing a lawsuit & he finally "claims" he did it.How do I know

he did it & is not just waiting for the statute of limitations to run out?(he's acting really weird lately)

will he or should I get something in writing(subpeona or anything) to prove that its been filed &/or get a court or arbitration date?

any input would be helpful,sorry if i could'nt explain or word it better.Im just nervous about the statute of limitations(date) passing & I get left out in the cold

(I know people say lawyers dont sell people out..but I need things in writing because my future hangs in the balance & the other guy admitted he was 100% at fault,and im the only one who lost everything)
