I was 3rd car inline the car in front of me being the last. I&amp;#39;m not sure of the law in KY as far as how much insurance can payout to fix a car, I&amp;#39;ve heard different things, but the damages on my car is appx. 2000 dollars. The rear and front bumper covers needing to be repaired, the rear bumper/absorber needing replacement and frame damage on the rear. &lt;/p&gt;  &lt;p&gt;The insurance comp is saying they&amp;#39;ll only pay up to NADA value nothing more and have sent me a check for appx. 75% of the cars NADA value 1000k which isnt enough the cover the damages. My vehicle in question is in excellent condition and from what the adjuster told me they only care about the year of the car in terms of repairing the car and totaling it out. While playing a man ( friend of the homeowner ) rode up the street on his bike - (was a Moped but has been altered to be bigger &amp;amp; faster) This man upon seeing the children building a leaf pile decides it would be funny to ride through the pile - upon doing so he&amp;nbsp;inadvertenally runs over a boy who was in the pile - his bike is stopped by the boy &amp;amp; falls on him.The man picks up his bike and &amp;nbsp;tells the boy that if he tells anyone he will be hurt more then rides off. Boy limps home bleeding with torn clothing &amp;amp; tells mom he tripped &amp;amp; fell and is taken to the ER. Mom tells boys sibling to go find out what he fell on and what happened - neighbor hood kids tell what happened and call is made to ER. CT scan xrays ect are done boy is glued back together ( couldnt stich due to location and width of wounds - but will be ok other than lrg scars. Police are called - homeowners ( not childs parents ) are spoken to first - he smoozes over police ( protects freind ) &amp;nbsp;tells them its not a big deal - Police leave - Parents call police again - same officer tells them they cant do anything because it occured on private property - Parents call chief of police and mayor saying they are calling local news if police dont come and at least take a report and statements -Police change minds come take report from parents and pictures &amp;amp; finally talk with the offender - 6 hrs after incident occured - at this point in time no breathalizer could be done - the man is often drunk / high - The man has no insurance or license&amp;nbsp;&amp;amp; dosent own a home,the place where incident occuered is owned by friend of the guy, Police seem to think it would fall under homeowners - who is financially responsible? I was recently driving on a 4 lane residential street heading north.&amp;nbsp;A vehicle parked at the curb on the south side of the street in the middle of the block initiated a U Turn and T boned me square in the door causing a lot of damage to the drivers side of my car. I recieved minor injury due to my head bouncing off the drivers window, my daughter who was in the passenger seat was uninjured. The driver has admitted fault, and so far his insurance has been very cooperative. They have already autherized a rental car, and have offered a settlement for my suffering(no amount has yet been mentioned). The paramedics did come to the scene to check things out, and I told them I did not need to go to the hospital and no one else was injured. They also told me that the police would not be coming to the scene, due to the fact there were no serious injuries. Since I was a short distance from home I opted to drive the car home, I did notice that the car was pulling somewhat. I took my time and made it home without incident. The adjuster came out yesterday to my house and did an initial inspection, and came up with a figure of $3800 and left it open for the body shop to suppliment as the impact sealed the driver door closed. Today I took the car to the body shop, the service writer explained that it looked like there was some frame damage, but would not know the extent of it until the car was torn down and looked at closer.&lt;/p&gt;  &lt;p&gt;Here is my issue, my car is a 2009 Mini that is one month old(I just made my first payment)&amp;nbsp;with just a 1000 miles on it. If it turns out that the frame is bent, I want the car replaced. I don&amp;#39;t care how good the body shop is, the frame will never be the same. The jig that is used to straighten a frame pulls and pushes the metal back in place and this weakens the frame. This is a known fact. The body shop inspector told me he expects the repair bill to end up at around $8000 by the time the work is completed. This will include replacing the vertical support structor behind the door and straightening the floor pan on the drivers side. At closer look today I did notice that the driver rear wheel is toed in a bit, which strengthens my theory of a bent frame or at the very least a bent subframe. I understand that with an older vehicle that once you have a certain amount of repair cost to the value of the car that it would be considered totaled. In my case since the car is brand new(I don&amp;#39;t even have plates yet) is there a chance the insurance company would total my car due to the frame damage? And if the above conditions are true, can I demand replacement? My wife&amp;#39;s vehicle sustained a significant hit in the front-passenger area. She was very upset and crying after the accident due to the trauma of being hit with such force while being 5 months pregnant. We drove to the hospital in my car immediately after the police left to ensure our baby was not harmed. The police officer stated to me when I arrived that both drivers were at fault. This I believe is a lapse of judgement on the officer&amp;#39;s part. The other driver drove out of a gas station without looking and drove directly into my wife&amp;#39;s vehicle. The accident did not happen at an intersection. The girl that hit me was going about 45-50 &amp;amp; hit me without using her brakes at all. She admited to the officer &amp;amp; it is on the accident report that she was looking down &amp;amp; did not see me stop. She was on her cell phone but, did not specify whether she was talking or texting. I assume she was texting or she wouldn&amp;#39;t be looking down at her cell phone. I did have pain which steadily got worse over the first 2 weeks. I went through physical therapy for 2 1/2 months which did alleviate some of the pain. I still have some pain &amp;amp; does get worse when i stand for long periods. It has caused a problem in me being able to do some things that I could previously do without pain. It&amp;#39;s eleminated the amount &amp;amp; lentgh of yardwork &amp;amp; working in my garden that do enjoy. I have not signed off on anything on the health part. They settled on the car as being totaled which was paid for &amp;amp; now I have a car payment that I didn&amp;#39;t have before.&lt;/p&gt;  &lt;p&gt;They made a offer that doesn&amp;#39;t even cover my lost wages while going through rehab. I just want to be fairly compensated with all my lost wages which I have documented &amp;amp; to cover the health expenses. They verified my time lost with a verbal conversation with my employer. There is not an issue of fault in the accident and the other partys insurance company has accepted full responsibility ! I was driving 55 mph the posted limit and the other driver had a stop sign but did not stop and my vehicle collided with the side and was totalled with over $12,000 worth of damages! I suufered a torn rotator cuff and tendon repair &amp;nbsp;in my right shoulder, that was repaired in surgery and an impingement in my left shoulder that still is painful but no surgery was performed on the left shoulder! I was driving a 2002 Mustang and upon impact the top section above the seat&amp;nbsp;( approximately 6 inches by 48 inches and approximately 10 pounds) broke loose and hit me in the back of the head knocking me unconscious for a brief period of time. The impact and this object caused occipital nerve damage on the right side and I have had 2 cotrizone injections that has alleviated about 40 percent of the headache pain I was getting every day ( migrainne type). I also developed tinnitus a very loud ringing in my ears that is permanent injury. I am taking Oxycodone to deal with the pain, daily and have not worked since the accident! I still have moderate to heavy pain in my nech and head and the center of my back every day. I have had several MRI and ct scans that have shown the injuries including 2 herniated bulging discs pressing the thecal sac.&lt;/p&gt;  &lt;p&gt;I do not have an attorney yet and will first see what the insurance company offers me before soliciting legal council! My first question has to do with an existing condition I had prior to the accident! I was in very good health, probably exceptional for a 61 year old male. I was diagnosed with a abdominal aortic aneurysm in 2006 and it was very stable at about 3.3cm from 2006 to december 29, 2009 and was not a concern to my Vein specialist MD. He had me on yearly checkups. I went to er in march about 3 weeks after the accident and got an mri and was advised the aortic aneurysm was not leaking but was now measured at 3.9 cm or about 20 percent larger than it was measured a month prior to the accident! I discussed this with my Vein specialist MD and he could not explain why the vein got 20 percent larger in a couple of months but would not attribute it to the accident! &lt;/p&gt;  &lt;p&gt;My opinion is : I think there is no logical explanation other than the accident to cause the increase in size since i had a severe blunt force trauma to my chest an stomach with heavy bruising on over half of my body from the impact of the accident. My Vein specialist MD told me that the accident would not have causes this but he was lost for any other explanation. He said it was a mystery but dont worry about it because it does not require surgery yet and to come back every 6 months to have it checked.&lt;/p&gt;  &lt;p&gt;Should &amp;nbsp;i try to find another Vein specialist MD that would be sympathetic to my situation and case or just write it off as not associated based upon his opinion? &amp;nbsp;I may eventually need a very expensive operation as this aortic aneurysm gets larger and weaker and would like to assign some monetary blame to the insurance company if they are indeed responsible through the blunt force trauma. Before taking her to HR I had two one on one meetings with her to discuss how she was treating me in the workplace. Both of these meetings were requested by me and in the meetings I express to her my concerns. No change resulted from the meetings! Since taking her to HR and reporting her behavior which I had documentations of the numerous rude and unprofessional behavior that she displayed I have not been able to get a promotion. I have been on five interviews in the company and I have even went on second interviews but none resulted in a promotion. When ask why I was not the chosen candidate the supervisor could not give me any real reason beside the other candidate was a better fit! I even went after an entry level data entry position and was told they had no position for me and they hired from outside the company. My direct supervisor hired a guy that I trained and then in six months she promoted him as my lead. This promotion was done with the position not even being posted for others to apply for.&lt;/p&gt;  &lt;p&gt;The company I work for offers education assistant that has to be approved from your supervisor. The information is all online and has to be approved within three days information she was aware of. She failed to approve my application and went on vacation which resulted in my application being denied. So I reported her to her Director. Once I reported her for the second time the application was approved and soon after they created a new department for her to supervise. Now she has promoted the same guy that she promoted as my lead to her new department. This is now leaving his lead position open! I of course believe that I should be promoted to the lead since I have been there the longest and I have great reviews...In my review she told me that there is NOTHING bad she can say about me she did make a comment that I reported to HR. she said that she felt I had an attitude and was angry at everyone I ask her if she made that comment because I was a Black women because I did not feel she was describing me or my personality.&lt;/p&gt;  &lt;p&gt;I do not believe that I am going to get the lead position because I ask our Director if the lead position was going to be filled or of they were just going to hire a third Financial Aid processor. Her reply was that they were going to hire a processor first then they would hire within for the lead position. I feel that they are going to hire a friend of the guy who got promoted and have me train him just so he can be my lead the same thing that happen before! I feel this way because I also ask for access to a system that they usually give to the lead and was told that I would not get access no time soon! which to me sounds like I will be in the same position and the new lead will get the access.&lt;/p&gt;  &lt;p&gt;I am really confused because I don&amp;#39;t know what I can do. I have yet to recieve any monetary compensation for my injuries. The other driver admitted fault for the accident to the officer&amp;nbsp; but was not cited or ticketed. The other driver was on the job at the time of the accident as a postal worker in a postal truck. I do have an attorney and lawsuit has been filed. Should it be taking this long? I thought I at least should have been compensated for the total loss of my car. My wife had to stop suddenly and was able to avoid hitting the car in front.&amp;nbsp; However, the car behind her did not react quickly enough and rear-ended my wife&amp;#39;s car.&amp;nbsp; There was heavy damage to both vehicles.&amp;nbsp; The trooper told my wife that the original car that spun out was at fault and given a ticket.&amp;nbsp; The next morning, we called our insurance.&amp;nbsp; Surprisingly to us they wanted nothing to do with the accident and told us to call the insurance company of the car that was in front of my wife.&amp;nbsp; Their adjuster is now claiming that they are disputing&amp;nbsp; the fact that their client was at fault.&amp;nbsp; They think there were two separate accidents and that the insurance company of the vehicle that rear-ended my wife&amp;#39;s car should be responsible for&amp;nbsp;our repairs.&amp;nbsp; We now seem to be caught in the middle.&amp;nbsp; All we want is for our car to be repaired and it looks like it may take some time before this all gets resolved.&amp;nbsp; What options do we have?&amp;nbsp; Do we need to contact a lawyer to represent us since our insurance agent doesn&amp;#39;t seem to have our best interests at hand?&amp;nbsp; How long does this need to play out before we consider a lawsuit?&amp;nbsp; What advice would you give us to make sure we are treated equitably during the claim process.&amp;nbsp; I have already received two estimates for the damage repair in case the adjuster tries to low-ball me.&amp;nbsp; Is&amp;nbsp;it reasonable to also ask for a &amp;quot;dimenished value&amp;quot; payment since now even after the repairs are made, my car will not have the same value to a dealer or private party, once they are aware the vehicle was in a wreck?&amp;nbsp;
