I signed a 12 month townhouse lease in Fargo, ND on September 1st, 2009. After the 12 months, the lease went into a month to month status. On my rental agreement, I initialed a "60 Day Notice to Terminate Lease" which my landlord says applies even on a month to month basis. I am trying to confirm if this is the case, or if 30 days notice is sufficient in ND once the lease goes month to month. Based on what I've found online, if I'm reading it correctly, 30 days may be sufficient in my case:
"After August 1, 2007 if the term lease is going to convert on a month-to-month basis, the landlord will no longer be allowed to require 60 days notice to terminate from the resident, even if the resident initialed such language. In other words, if you have a one year lease that will expire on July 31, 2007 and the resident remains in possession, the lease will be presumed to convert on a month-to-month basis, and it can be terminated by 30 days calendar notice from either party."
Can anyone confirm if 60 days notice is required in my situation or is 30 days sufficient? Since my landlord says 60 days is still required, how should I approach it?
