    Question [=?] Separated Parents, One taking kids out of state

    Friend planning to move out of state with her daughters to move to be near friends. She and her husband have been separated for years, no legal or formal separation or divorce. Father sees kids regularly and pays child support. Can she take the girls out of state? Can the father stop this move?

    Married parents can pretty much do what they want with their kids. If the father wants to prevent this, he needs to file for divorce. Upon filing and service, the mother will be subject to an automatice restraining order that prohibits either parent from leaving the state with the kids except pursuant to an agreement by the other parent or a court order.

    Kinda curious on this. After the divorce can the mother then leave the state with the child to be near a friend. Also if she can not leave then what situation does she have to be in to be able to move out of state. I.E Better Job or if she remarry's can she leave then.
