Hello ? i just officallly settled my personal injury case but i won't recieve check for at least 2 months. I also have a WC case pending i was getting 400 a week i just recived my WC check it is now 137 a week can anyone give me a idea of what happen thanks/
Your WC claim rep is the one to ask.
But I'm guessing that WC had a lien on your personal injury claim and rather than collect a large piece of the settlement, adjusted the payments to pay it off over time.
I repeat, ask your WC claim rep.
Hello Jack thanks for the reply. Jack i did call WC lawyer they said they would get back to me which means i won't be hearing from them till next week!!!! but does that mean they settled wc case as well? wc just had me attend a few ime's last week 1 for ortho doc and a physc doc.
Best bet is to wait and get the right answer from the lawyer.
Tony20:but does that mean they settled wc case as well?
No. You don't get to "double dip" on the wages. WC replaces up to 60% of your total wages. If you got a personal injury settlement for wages during the same WC period then they recover that amount from your PI settlement. The reduced checks likely reflect the offset of wages from the PI settlement.

Clydesmom is the 60% just wages or do i also have to pay back medical treatment?
