    I think what you're saying is that he put up a fence on his property instead of on the property line and that he needs to enter upon your property to maintain the small strip of his property that is on "your side" of the fence.  No, he doesn't have a legal right to do that.  If you can't work out something with him civilly, you'll have to have this matter decided in court.
