    Improper towing

    My son was in an accident and his truck was totaled.

    Tow truck came and he instructed them to tow it to his house.

    They agreed and took off.

    Later he found out that they had towed it to their impound lot instead.

    By the time he got over there to get it, it had been a few days and he had to pay storage fees to get it out.

    Fees were more than we can probably get for selling it as salvage.

    They basically stole the truck and then held it for ransom.

    Very possibly, it was an honest mistake. Most tows, they probably take to their lot for impounding by the police. I can imagine the driver just doing it automatically out of habit.

    Is this a reasonable case to take to small claims court?

    Alternately, would it be reasonable to file a police report against them for stealing and holding the vehicle?

    Small claims, yes.  Police report, no.

    Might not be out of habit.

    Did your son call the tow truck or did the police call the tow truck?

    If the police called the tow truck the driver may not have had a choice if it was part of the towing company's contract with the city.

    If your son called the tow truck did he get any paperwork showing instructions to tow home?

    I agree with Jack, most towing companies have contracts with the city and most of the time they tow to a lot because many neighborhoods and cities dont want a smashed up car sitting in the street.
