Biological father wants child

    Do you think that section of Utah Code is enforceable (whether by the mother or by the state if the mother has received public support) due to the voluntary nature of a father's claiming the child as his own?  I.e. can it be said that the father CHOSE to be subjected to that provision and that it can therefore be enforced against him?

    I don't really see the point of debating abstract concepts (esp. when the OP doesn't appear to be participating in the discussion anymore).  Suffice to say that, if the mother were to seek child support fromt he OP, federal law would preclude an award of retroactive support for any period prior to the date of filing the petition, regardless of whether any state law says otherwise.
