    Question [=?] Question on property. Was a inheritance.

    We are seeking a uncontested divorce. No problems with the seperation of property on our parts, we agree. Property was purcased during marriage in both names but it was with husbands inherintance from Mother. Do we need to file or do anything besides just file for a uncontested divorce. Honestly we are looking for the easiest, quickest and most economical way to get through this. Any suggestions will be appreciated. We live in Texas.

    Unless he paid for it completely with the inheritance vs. you all getting a mortgage, there's still a marital property component.

    Not sure what you mean here. You will want to memorialize the agreement in a written property-marital settlement agreement even if you're separating the property (say selling it and splitting the proceeds) before the actual divorce.

    You should talk with a lawyer for your sake even if husband isn't interested in seeing one for his. It's worth the $$$.

    The inheritance is no longer separate property. The house will have to be divided in the property settlement.
