    Question [=?] What is an Affidavit Judgment?

    I have a small claims case in Maryland.

    I have a hearing for an affidavit judgment.

    What does this mean? What do I do? I am the plaintiff.

    But what if I cannot serve the defendant because he is purposely avoiding the service?

    Is my case still eligible for the affidavit judgment?

    If you haven't served the defendant the case cannot proceed. You can't get a judgment against someone that has not even received notice of the suit. Consult local counsel.

    The defendant is a business and certified mail is not coming back with a wrong address. He is just not picking it up.

    He is simply avoiding the service.

    What is it you expect? He has to be served and it's your duty to see that it happens or your case cannot proceed. He doesn't have to accept service by certified mail. The law provides for other means of service. I'd wager, however, that it's too late to effect service now and you'll likely have to start over. Consult counsel.
