    Over 1 month and No Workers comp benifits

    Well its been well over a month now since my back injury and still no weekly benifits from work comp.I went to a clinic 2 times after the injury on my own the first week because i didnt want to file work comp because i knew how my boss felt about it and i like my job.That same weekend i was in such severe pain i had to have my family take me to the ER on a sunday.They gave me 2 injections in the butt.One like an epidermil and another like a relaxer.Gave me a refferal to see pain management mon.I filed that monday with my boss.It took over a week to find out there carrier for comp.I waited to talk to auto owners before i called pain management.Finally the girl from auto owners called and i had to say what happened.I was given a case worker.I talked to the case worker and told her about going to pain management like i was told to do and she said NO they dont know the right way to handle this.She said she would make an appointment with a doctor for me.So i get a ride to the doctor(a retired doctor) had to take Many pain killers just for the ride.He checks me out prescribes more pain killers and 500 mg Aleve wants me to go to physical therapy 3 times a week for 2 weeks(im still off work)Therapy isnt helping any!Come back and see him in 2 weeks.Keeps me off work tells me to see the therapist again for 2 weeks.I have had no x-rays or seen anyone that really wants to fix the problem.I going broke being off work and just want to get better so i can go back asap.I had this same problem 12 years ago and an epidermil fixed everything until now.They have ask for my med records i signed.Im sure it raised a red flag with the carrier but that was years ago and this happend right at work and they all saw it.Will they keep dragging this out and not fix the problem or pay me benifits???If they deny me beifits am i going to have to pay for the doctors visits they are sending me to???Or is this all normal procedure???Any one that has been in this position or knows let me know what to expect Please!!!Kurt from Iowa

    You haven't explained what the response was from the carrier when you discussed these problems with them. That's generally the first step whenever there are questions.
    Sounds like you need a change of doctors or at least a second opinion by a specialist. Under Iowa work comp laws the employer picks the doctor but you certainly have the right to ask for another one. If they deny then you'll have to go to the commissioners office to get a decision.
    If they've denied or are not paying your disability payments they have to explain why in writing. It may be just simple miscommunication with the employer about your time off.
    Again you can appeal to the commissioners office for a decision.
    After talking to them directly followup with a request in writing for another doctor and disability payments.
    Before deciding to go to the commissioners office you should contact a compliance officer to see if they can help resolve it.

    I talked to the girl at auto owners the carrier on Thursday told her i was inquiring about my claim and she told me she hadnt had the chance to look it over yet(she sounded not encouraging)she said she was taking the rest of the afternoon off and would also be gone on friday that she would try to look at it next week.
