how do I move divorce case from one county to another

    Question [=?] how do I move divorce case from one county to another

    Hi

    I filed my divorce case in Alameda County 3 yrs ago. It is still going on.
    I have moved out of that county 2 yrs ago.
    my ex doesn't live there anymore either.

    How can I move the case to where I live now?
    any pointers or help is greatly appreciated.

    You can file a motion to change venue, but I think it's unlikely that a judge with THREE years invested in a case is going to pass it off on a new judge who will have to catch up on three years worth of proceedings. Talk to your lawyer about whether this would be a worthwhile thing to do.

    thanks for your response.

    but let me ask this: neither my ex nor I lived in that county for over 2 years. my ex doesn't even have a residence in US right now (she is living abroad with my son)

    so, would that be a reason to have the case moved to where I live at? I mean, am I wasting my time and money to think of this? if someone has any thoughts, would be great.

    So why didn't you seek to change venue two years ago? Your delay may waive your right to seek a change now.

    You need to ask your lawyer research this. There are several issues here; the delay is the most critical.
