    My ex owes me money

    My ex owes me a lot of money.I have 2 seperate contracts with him which he signed saying he owes me the money and a payment scheme.I think i could take him to small claims court for each contract.

    I threatened to take him to court so he agreed to start paying me back but it was not much and i had to chase him up for it every time he got paid.He was paying me back $100 every 2 weeks for 3 months.Then he said he did not have enough so i got 2 payments of $50 and then nothing ofr the last month.The rate he is going it will take 10 years to get all my money back..yes i was stupid enough to lend him THAT much money.

    I wanted to find out if the court says he owes me how i get my money back.He has just told me he has now lost his job so i have no idea how i will ever get money from him.I will not know wether he is working or not and if it is on the books.If its off the books i cant prove it!!! AH!!

    Can i hire a debt collector?

    Any advice would be great.I am getting stressed out with it all and very frustrated.This should be a priority for him and i know its not.

    PS  he has no assests either!!

    You could probably take him to court but depending on how much he owes you would depend on the court.

    You could probably even win if you have a signed contract but collecting is a completely different story.

    You might want to negoitate with him for a lump sum to avoid goig to court. Maybe one of his relatives woud loan him enough money to pay you half or 3/4 of what he owes you.

    He owes me $14000.00.The first contract was for $5000 and the other is for $9000. The first i could go to small claims.The 2nd i would have to go to civil but they said it is much harder to take someone to civil court so it might be easier to loose $4000 and take him to small claims twice.

    He does not have anyone that would lend him the money. He also has lied to me in the past so when he says he has nothing to give me i never know if thats the truth.

    I feel hes going to get away with not paying this back.

    I know!!! He only seems to work to earn enough to pay for his rent/bills food but nothing extra.

    If i get a judgement against him but he does not have work on the books how can i get the money? How can i prove anything?

    Will the judgement affect him in anyway if i dont get any money from him? ie bad credit?

    Can you hire someone to get the money back for me after we go to court?

    Perhaps i should go on judge judy..might be easier!! lol

    Even if somebody handed you a judgement for $15,000 on a silver platter--just how do you propose to get blood out of a turnip!

     

    If you think judgement are worth much--I have a pile of them I will sell you for 50 cents on dollar.

     

    I agree- a judgement sure helps--it gives you a hunting license of sorts.

     

    So go for a judgement on the first smaller contract and see if that works?

     

    But remember it really only gives you a hunting license

    so really what you are saying is i got screwed out of $14000.00 and probably not much chance of getting it back!!!

    Even if he gets a great job next week he could keep telling me he has no money.

     

    At least i have learnt my lesson on lending people money..I will never do it again!!!  ;o)

    If you find out that he is working, has a bank account and you win your court case you can most likely file a wage garnishment so that his employer has youpay you X amount of dollars out of his check or get the money from his bank.

    It might be harder to prove that he is working off the books but if you can prove it, then you might be able to notify the IRS because most likely he is not paying taxes and neither in the employer.

    Small Claims court is cheap and informal but I don't know if you can sue for one note in Small Claims then sue for the other in the regular court - best advice is consult local council.

    Most people on this board are not lawyers so we can only give advice, how you proceed is up to you.

    You need to get a judgement first before you can seek a wage garnishment and if he is off the books a garnishment doesn't produce results.

     

    But go get seek  judgement for the first contract--then later go get one for second.

     

    I'd ask for cost, fees and interest as well.

    I am in the EXACT SAME SITUATION. Leant money to an ex who doesn't have a real job, etc. etc. I even got him to sign contracts on the debt - nothing. He's a construction worker and keeps telling me he's going to pay me...nothing.

     

    so what happened in your situation?

    Iam sorry you are going through this as well.I would not wish it on anyone.

    I kept listening to his excuses and not getting payment each month.Then he would pay a little then more excuses.Last wednesday i had had enough of him calling and not getting my money back so i went to small claims court and filed the first judgement against him.We go to court in december.If i get the judgement then i deal with a sherif who will help me get my money back..garnish his wages/assets/bank account.The judgement lasts 10 years so even if he has not got it now,when he does i can get it.

    The judgement against him will mean he will have bad credit and wont be able to get a credit card/morgage until iam paid back.

    The 2nd judgement i will file in the new year for the other contract.

    My ex is angry that i did this and does not understand why! Everyone else seems to get it but him!!

    I hope you get your money back and if i can be anymore help please let me know.

    I dont know where you live but some places have law night which is free and you can go talk to a lawyer and get advice. I did it and they were great.Answered all my questions.

    Well, I'm happy to hear that you can actually get your money, because my dumb ex is a construction worker and everyone that I've talked to (friends, etc.) are saying I've got to say bye-bye to the money. I have two promissory notes that he signed and I'm trying to get him to sign another one (he does not know that I will eventually, probably take him to court).

    Another question: It looks like your ex also works off the books. What state do you live in? Is it hard to get wage garnishment if they don't pay taxes?

    I'm looking to get things sorted out and file in circuit court in the state where my ex currently lives. He owes me a little more than $12K so it's way too much for smalls claims court. Thanks.
